<p class="MsoNormal" style="text-align: justify; text-indent: 0.5in;"><span style="font-family: Tahoma, 'sans-serif';">Earlier the industry was granted 'Consent to Established' under Water Act, 1974 and Air Act, 1981 vide no CTE/Fresh/LDH1/2018/8571381 dated 18.10.2018 valid upto 17.10.2019 with special conditions mentioned therein.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 0.5in;"><span style="font-family: Tahoma, 'sans-serif';">The industry was visited by officer of the Board on 31.10.2022 and observed that the industry was in operation. But it could not inform date of its commissioning. Due to off season it was in operation for a small production only as observed during visit. It has installed ETP but the same was not in operation and trade effluent was being lead into its collection tank. The condition of ETP was that it is not being operated by the industry since long. The industry has plantation area within its premises but same was not found maintained properly as lots of undesired bushes were there. It has not provided water meter at source of water supply or at outlet of ETP. During visit it could not show the record of operation of ETP. It has not provided storage arrangements for hazardous waste nor provided 6 ft x 4 ft Board displaying environment data at its main gate. The stack of boiler was without sampling arrangements. It has not obtained consent to operate under Water Act, 1974 and Air Act, 1981. It has also not obtained authorization under Hazardous and other Waste (Management & Transboundary Movement) Rules, 2016.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 0.5in;"><span style="font-family: Tahoma, 'sans-serif';">The industry was issued show cause notice for violation of the provisions under Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act 1981 and Hazardous and other Waste (Management & Transboundary Movement) Rules, 2016 with hearing before the Senior Environmental Engineer of the Board on 19.12.2022.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 0.5in;"><span style="font-family: Tahoma, 'sans-serif';">During hearing the Competent Authority of the Board decided as under:-</span></p>
<p class="MsoListParagraph" style="margin-left: 0.75in; text-align: justify; text-indent: -0.25in;"><em><span style="font-family: Tahoma, 'sans-serif';">1.<span style="font-style: normal; font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span></em><em><span style="font-family: Tahoma, 'sans-serif';">The industry shall operate its ETP regularly and efficiently, so as to achieve prescribed standards.</span></em></p>
<p class="MsoListParagraph" style="margin-left: 0.75in; text-align: justify; text-indent: -0.25in;"><em><span style="font-family: Tahoma, 'sans-serif';">2.<span style="font-style: normal; font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span></em><em><span style="font-family: Tahoma, 'sans-serif';">The industry shall apply for consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 and authorization under Hazardous and other Waste (Management & Transboundary Movement) Rules, 2016, within 07 days.</span></em></p>
<p class="MsoListParagraph" style="margin-left: 0.75in; text-align: justify; text-indent: -0.25in;"><em><span style="font-family: Tahoma, 'sans-serif';">3.<span style="font-style: normal; font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span></em><em><span style="font-family: Tahoma, 'sans-serif';">The Environmental Engineer, Regional office-1, Ludhiana shall verify submission of the industry and process consent/ authorization applications on merit and send further recommendations in the matter, accordingly.</span></em></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-family: Tahoma, 'sans-serif';"> In compliance to above, the industry has now applied for consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of Ice Kulfi @ 1000 Nos./day, Ice cubes @ 0.5 Metric Ton/day, Kulfi @ 1000 Nos./day and Ice cream @ 3.0 kl/day.</span></p>
<p class="TableParagraph" style="margin: 0.3pt 0in 0.0001pt; text-align: justify;"><span style="font-family: Tahoma, 'sans-serif';"> The industry has deposited Rs. 86400/- vide no. SDL120278580 dated 30.12.2022 under Water Act, 1974, Rs. 32400/- vide no. SDL120278580 dated 30.12.2022 other Late Fee, Rs. 500/- vide no. SDL120278580 dated 30.12.2022 application form fee, Rs. 86400/- vide no. SDL120278282 dated 30.12.2022 under Air Act, 1981, Rs. 32400/- vide no. SDL120278282 dated 30.12.2022 other late fee, Rs. 3600/- vide no. SDL120278282 dated 30.12.2022 as NOC regularization fee, which is adequate upto 30.12.2027</span></p>
<p class="TableParagraph" style="margin: 0.3pt 0in 0.0001pt; text-align: justify;"><span style="font-family: Tahoma, 'sans-serif';"> The industry has filled online application form and submitted Site plan location plan, approved building plan issued by additional Director of Factory, CLU issued by DTP vide no. 4982 dated 04.09.2017, compliance report, Feasibility report of effluent treatment plant, Analysis report from Sima Lab, CA certificate, manufacturing process chart.</span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-family: Tahoma, 'sans-serif';"> The site of the industry was visited by officers of this office on 13.01.2023 & observed that:-</span></p>
<p class="MsoListParagraphCxSpFirst" style="margin-left: 0.5in; text-align: justify; text-indent: -0.25in;"><span style="font-family: Tahoma, 'sans-serif';">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: Tahoma, 'sans-serif';">Due to off season it was not in operation..</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 0.5in; text-align: justify; text-indent: -0.25in;"><span style="font-family: Tahoma, 'sans-serif';">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: Tahoma, 'sans-serif';">The industry has installed ETP and the aeration was undergoing to keep the concentration of MLSS healthy.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 0.5in; text-align: justify; text-indent: -0.25in;"><span style="font-family: Tahoma, 'sans-serif';">3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: Tahoma, 'sans-serif';">The industry has now overhauled the ETP and the representative informed that due to off season their unit is lying closed.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 0.5in; text-align: justify; text-indent: -0.25in;"><span style="font-family: Tahoma, 'sans-serif';">4.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: Tahoma, 'sans-serif';">The industry has now maintained the plantation area within its premises.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 0.5in; text-align: justify; text-indent: -0.25in;"><span style="font-family: Tahoma, 'sans-serif';">5.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: Tahoma, 'sans-serif';">The industry has now provided water meter at source of water supply and at outlet of ETP.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 0.5in; text-align: justify; text-indent: -0.25in;"><span style="font-family: Tahoma, 'sans-serif';">6.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: Tahoma, 'sans-serif';">The industry has now provided storage arrangements for hazardous waste.</span></p>
<p class="MsoListParagraphCxSpLast" style="margin-left: 0.5in; text-align: justify; text-indent: -0.25in;"><span style="font-family: Tahoma, 'sans-serif';">7.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: Tahoma, 'sans-serif';">The stack of boiler has now been provided with sampling arrangements.</span></p>
<p class="MsoNormalCxSpFirst" style="margin-left: 0.5in; text-align: justify;"><span style="font-family: Tahoma, 'sans-serif';"> </span></p>
<p class="MsoNormalCxSpMiddle" style="text-align: justify;"><span style="font-family: Tahoma, 'sans-serif';"> In view of the above, 'Consent to operate under Water Act, 1974 & Air Act, 1981 may be granted to the industry for manufacturing of Ice Kulfi @ 1000 Nos./day, Ice cubes @ 0.5 Metric Ton/day, Kulfi @ 1000 Nos./day and Ice cream @ 3.0 kl/day upto 30.12.2027 with the suitable terms and conditions and with special condition that the industry shall got its effluent and air emission analyzed from Board's lab once the unit is restarted.</span></p>
