<p class="MsoNormal" style="margin-top: .05pt; text-align: justify; text-indent: 1.0in; line-height: 150%;">It is submitted that the <span style="mso-bidi-font-weight: bold;">Project Proponent </span>was granted ‘Consent to Establish’ NOC of the unit under the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Fresh/SAS/2021/15870543 dated 27/12/2021, which was valid upto <span style="mso-spacerun: yes;"> </span>31/08/2022 for establishment of residential project in an area of 21.706 acres, having Residential Plots @ 468 Number EWS Plots @ 55 Number, Commercial Area in 0.53 acres, School Area in 0.501 acres, Public Building Area in 0.685 acres, subject to certain conditions mentioned as mentioned therein.</p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1.0in; line-height: 150%; margin: .05pt 10.9pt 10.0pt 0in;">Now, the <span style="mso-bidi-font-weight: bold;">Project Proponent </span>has applied online for extension in the validity of 'consent to establish' (NOC), requesting to extend the validity of 'consent to establish' (NOC) for one year.</p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="mso-bidi-font-family: Tahoma; mso-bidi-font-weight: bold;">The </span><span style="mso-bidi-font-weight: bold;">Project Proponent </span><span style="mso-bidi-font-family: Tahoma; mso-bidi-font-weight: bold;">has deposited Rs. 47750/- vide R no. 788689057 dated 14.12.2022 (considering late fee of Rs. 15750/-), which is adequate for one year, i.e. upto 31.08.2023, against the cost of the project of Rs<span style="color: red;">. </span></span>3088 lakhs<span style="mso-bidi-font-family: Tahoma; mso-bidi-font-weight: bold;"> (as per application form).</span></p>
<p class="MsoBodyText" style="text-align: justify; line-height: 150%; margin: 5.0pt 3.7pt .0001pt 0in;"><strong><u><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Bookman Old Style','serif';">Visit:</span></u></strong></p>
<p class="MsoBodyText" style="text-align: justify; text-indent: 70.9pt; line-height: 150%; margin: 5.0pt 3.7pt .0001pt 0in;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Bookman Old Style','serif';">Accordingly, the site of the </span><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-weight: bold;">Project </span><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Bookman Old Style','serif';">was visited on 06.01.2023 and Sh. Sumit was contacted. During visit, it was observed as under:</span></p>
<p class="MsoBodyText" style="text-align: justify; text-indent: -22.5pt; line-height: 150%; mso-list: l1 level1 lfo2; margin: 5.0pt 3.7pt .0001pt 22.5pt;"><!-- [if !supportLists]--><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Bookman Old Style','serif';">The project namely Royal Estate Affordable Housing is located adjoining to another project of the promoter company, i.e. Chandigarh Royal City project. Both the projects are inter-mingled with each other and there is no boundary between the projects separating each other. As such, it is not possible to ascertain the actual boundaries of both the projects, individually.</span></p>
<p class="MsoBodyText" style="text-align: justify; text-indent: -22.5pt; line-height: 150%; mso-list: l1 level1 lfo2; margin: 5.0pt 3.7pt .0001pt 22.5pt;"><!-- [if !supportLists]--><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Bookman Old Style','serif';">There are total of 523 plots in Royal Estate Affordable Housing, i.e. for which CTE extension has been applied by the project proponent. The representative of the project informed that around 40-45 families have started residing in this project and around 30-35 houses are under construction. </span></p>
<p class="MsoBodyText" style="text-align: justify; text-indent: -22.5pt; line-height: 150%; mso-list: l1 level1 lfo2; margin: 5.0pt 3.7pt .0001pt 22.5pt;"><!-- [if !supportLists]--><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Bookman Old Style','serif';">The project proponent has installed a common tubewell for both the projects and an overhead tank has been constructed for storage of freshwater. The representative of the project proponent was advised to start maintaining the <span style="mso-spacerun: yes;"> </span>record of the same.</span></p>
<p class="MsoBodyText" style="text-align: justify; line-height: 150%; margin: 5.0pt 3.7pt .0001pt 127.4pt;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Bookman Old Style','serif';"> </span></p>

Another STP of capacity 500 KLD is under construction in affordable housing project. All the utilities, such as freshwater, storm water, sewer lines etc. are common for both projects and wastewater is to be combinedly treated in both the STPs, as informed by representative. </span></p>

<p class="MsoNormal" style="text-align: justify; line-height: 150%;"><strong><u>Recommendations:</u></strong></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="mso-spacerun: yes;"> </span>In view of above, if approved, the validity of ‘consent to establish’ (NOC) granted to the project proponent under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be extended for one year i.e. upto 31.08.2023, subject to suitable conditions and the following additional conditions that:</p>
<p class="MsoListParagraphCxSpFirst" style="margin-left: .25in; mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Bookman Old Style','serif';">The project proponent shall be immediately apply for obtaining partial ‘consent to operate’ for both of its projects, i.e. Royal Estate Affordable Housing project and Chandigarh Royal City project, under the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, for the occupancy which has already happened at the site, within 15 days.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: .25in; mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Bookman Old Style','serif';">The project proponent shall submit proper water balance for the partial occupancy in both the projects, at the time of obtaining partial ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: .25in; mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Bookman Old Style','serif';">The adequacy/ efficacy of the pollution control arrangements as well as disposal arrangements, shall be the sole responsibility of the project proponent and the project proponent shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time.</span></p>

The Board would be at liberty to take penal action against the industry/project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time, without any opportunity of Personal Hearing. </span></p>
