<p class="MsoNormal" style="text-align: justify; text-indent: 1.0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; mso-ansi-language: EN-US; mso-bidi-language: AR-SA;">It is submitted that the rice sheller was granted consent to operate under the Water Act, 1974 vide no. CTOW/Renewal/LDHKH/2019/10392063 dated 18/07/2019 and the Air Act, 1981 vide no. CTOA/Renewal/LDHKH/2019/10392009 dated 18/07/2019 both valid upto 30/09/2025 for processing of paddy @ 50 TPD to produce Raw Rice @ 34 TPD without drier.<span style="color: red;"> </span></span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1.0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; mso-ansi-language: EN-US; mso-bidi-language: AR-SA;">It has now applied for varied consent to operate under the Water Act, 1974 and the Air Act, 1981 alongwith requisite documents through OCMMS as it has now installed fortified rice unit of capacity 75 MTD and mechanical drier of capacity 50 T/batch without obtaining 'consent to establish' (NOC) from the Board. The rice sheller has earlier deposited Rs. 27100/- UTR no. N004232274600372 dated 04/01/2023 & Rs. 21800/- vide e-R no. 628316239 dated 13/01/2023 as Water consent fee and Rs. 26200/- UTR no. N004232274602254 dated 04/01/2023 & Rs. 13400/- vide e-R no. 786032377 dated 13/01/2023 as Air consent fee against the fixed assets of Rs. 227.29<span style="color: red;"> </span>Lacs as on 31/12/2022 as per CA Certificate dated 04/01/2023. The consent fee is adequate <strong>upto 30/09/2026</strong> as per Board's Office Order dated 29/10/2018 after deducting NOC regularization charges Rs. 8400/-. There is increase in fixed assets only due to establishment of mechanical drier and fortified rice plant in the existing premises. There is addition of land value in CA certificate as the subject industry has purchased Plot no. D-112, Focal Point, Khana. However, it has not installed any machinery in the newly purchased plot.</span></p>

As per the reports, the concentration of particulate matter at sheller section having Cyclone is <strong>328 mg/Nm3</strong>, 2<sup>nd</sup> sheller section having cyclone is <strong>335 mg/Nm3 </strong>and<strong> </strong>drier section is <strong>302 mg/Nm3, </strong>which are within the permissible limits of 750 mg/Nm3</span><span style="font-size: 7.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: 'Bookman Old Style';"> </span><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: 'Bookman Old Style';">as prescribed by the Board.</span></p>

<p class="MsoNormal" style="margin-top: 12.0pt;"><strong><u><span style="font-family: 'Bookman Old Style','serif';">Suitability of Site</span></u></strong></p>
<p class="MsoNormal" style="text-align: justify;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; mso-ansi-language: EN-US; mso-bidi-language: AR-SA;">As per PPCB Head Office letter no. 18555-77 dated 17.08.2021, it was decided that fortified rice units to be established in the existing premises of rice mills will follow expansion clause as prescribed vide Govt. notification dated 15.10.2013, which is reproduced as under:</span></p>
<p class="MsoNormal" style="text-align: justify;"><em><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; mso-bidi-font-family: Raavi; mso-ansi-language: EN-US;">"</span></em><em><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; mso-ansi-language: EN-US;">All the Rice mills/ Saila Plants located outside the Municipal limits of towns and cities and in the designated areas within the cities established with NOC of Punjab Pollution Control Board will be allowed to expand / modernize within their existing premises If pollution load of existing unit has been effectively taken care of by the Industry and no specific approval of District Town Planner will be required."</span></em></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1.0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; mso-ansi-language: EN-US; mso-bidi-language: AR-SA;">Further, the industry under consideration was established in year 2002 after obtaining NOC of the Board vide no. LDH/RO-II/NOC-18 dated 29/08/2002 for the manufacture of rice @ 34 TPD in dry rice sheller (without drier furnace). It is further intimated that the site of the industry is situated outside the MC limits of Khanna. </span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1.0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; mso-ansi-language: EN-US; mso-bidi-language: AR-SA;">Therefore, the site is suitable for expansion of rice sheller. It is worth mentioning here that, the industry is located in the non- designated area (Residential Zone) as per notified Master Plan of Khanna. Therefore, the industry can operate its unit only up to year Nov, 2026 (15 years after the Master Plan is notified).</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1.0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-ansi-language: EN-US; mso-bidi-language: AR-SA;">It is further informed that this office has already obtained legal opinion from the Senior Law Officer of the Board in the similar case of the rice sheller named M/s Shiv Shanker Rice & Gen Mills, Village Kotla Dadheri, Fatehgarh Sahib, which is situated in the same residential zone. In the said case, as the rice sheller had established with prior NOC/CTE from the Board and is situated outside MC limits. Moreover, State Govt. has allowed the operation of industrial units for 15 years from the date of notification of the Master Plan in non-designated area. Therefore, it was granted NOC for expansion for installation of Paddy pre-cleaner and Paddy drier of capacity 32 MT. </span></p>
<p class="MsoListParagraph" style="margin-left: 0in; mso-add-space: auto; text-align: justify; text-indent: 1.0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; mso-ansi-language: EN-US; mso-bidi-language: AR-SA;">The industry under consideration was established in year 2002 after obtaining NOC of the Board vide no. LDH/RO-II/NOC-18 dated 29/08/2002 for the manufacture of rice @ 34 TPD in dry rice sheller (without drier furnace). And, the subject cited rice sheller is situated outside MC limits of Khanna. Further, vide PPCB Head Office letter no. 18555-77 dated 17.08.2021, it was decided that fortified rice units to be established in the existing premises of rice mills will fall in the same category i.e. 2094 (Orange).</span><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-ansi-language: EN-US; mso-bidi-language: AR-SA;"> Even, stand alone units engaged in manufacturing of fortified rice falls under Green category code 3074. From which, it is clear that there is no increase in any pollution load.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1.0in; margin: 12.0pt -.9pt 10.0pt 0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; mso-ansi-language: EN-US; mso-bidi-language: AR-SA;">It is intimated that CPCB has already issued modified directions u/s 18(1)b of the Water Act, 1974 & the Air-Act, 1981 regarding Harmonization of Classification of Industrial sectors under Red/Orange/Green/White categories vide its letter no. B 29012/ESS/CPA/2015-16/85-84 dated 7.3.2016 alongwith the "Final document on revised classification of Industrial sectors under Red, Orange, Green & White categories" which also includes the consent period for which the consents are to be granted to Red, Orange and Green category industries for 5 years, 10 years and 15 years respectively. Further, Board vide Head Office letter no. SEE (HQ-2)/2018/ 9982-10003 dated 27/08/2018 has directed to strictly follow the consent validity criteria for Red, Orange and Green category industries as mentioned in the modified directions issued by CPCB u/s 18(1)b of the Water Act, 1974 & the Air Act, 1981 i.e. consent to Red, Orange and Green category industries may be granted for 5 years, 10 years and 15 years respectively. But, in the subject cited case, the industry has deposited consent fee only <strong>upto 30/09/2026</strong>.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1.0in; mso-pagination: none; text-autospace: none;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; mso-ansi-language: EN-US; mso-bidi-language: AR-SA;">Moreover, the Board vide Head Office letter no. 768-97 dated 13/01/2021, decided as under:</span></p>

However, aforesaid clearance shall not be insisted upon by the Board at the time of grant of CTE/CTO to the industries."</span></em></strong></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1.0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; mso-ansi-language: EN-US; mso-bidi-language: AR-SA;">Keeping above in view, if approved, the consent to operate applied under the Water Act, 1974 and the Air Act, 1984 may be granted <strong>upto 30/09/2026</strong> for processing of Paddy @ 50 TPD to produce Rice @ 34 TPD <strong>(With drier)</strong> and <strong>Fortified rice @ 75 MTD </strong>with usual conditions (auto generated) alongwith the following special conditions as under: </span></p>

<p class="MsoListParagraphCxSpMiddle" style="margin-left: 67.5pt; mso-add-space: auto; text-align: justify; text-indent: -22.5pt; mso-list: l3 level1 lfo3;"><!-- [if !supportLists]--><span style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">a)<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; mso-ansi-language: EN-US; mso-bidi-language: AR-SA;">All the rice shelling units shall provide paved / brick roads / cement concrete roads/ metalled roads inside their premises for movement of vehicles, so as to prevent the generation of dust. </span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 67.5pt; mso-add-space: auto; text-align: justify; text-indent: -22.5pt; mso-list: l3 level1 lfo3;"><!-- [if !supportLists]--><span style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">b)<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; mso-ansi-language: EN-US; mso-bidi-language: AR-SA;">The industry shall provide proper rice husk storage facilities inside the factory premises and the height of brick wall in front of the discharge point of rice husk area should be at least 10’ high or 3.5’ higher than the discharge point of the rice husk pipe (whichever is more) and the length of aforesaid brick wall should be at least 35’ on each side of the rice husk discharge pipe. </span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 67.5pt; mso-add-space: auto; text-align: justify; text-indent: -22.5pt; mso-list: l3 level1 lfo3;"><!-- [if !supportLists]--><span style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">c)<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; mso-ansi-language: EN-US; mso-bidi-language: AR-SA;">The industry shall provide a layer of wind screen of mild steel or some other similar material of at least 5’ height above the brick wall. The wind screen system should have a porosity of ~30% to lower the wind velocities, thus reducing the amount of airborne particulate from storage, handling and loading / unloading areas of rice husk. </span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 67.5pt; mso-add-space: auto; text-align: justify; text-indent: -22.5pt; mso-list: l3 level1 lfo3;"><!-- [if !supportLists]--><span style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">d)<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; mso-ansi-language: EN-US; mso-bidi-language: AR-SA;">The minimum diameter at the outlet of discharge pipe of rice husk be kept as 15’’ which can be maintained by extending the existing discharge pipe with the help of a conical shaped pipe of at least 3’ length. </span></p>

The HDPE warp knitted fabric be made of 100% virgin high density polymer of at least 70 gm/m2 weight having 40-45 hole/inch2 to prevent wind blowing of stored husk. </span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 67.5pt; mso-add-space: auto; text-align: justify; text-indent: -22.5pt; mso-list: l3 level1 lfo3;"><!-- [if !supportLists]--><span style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">f)<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; mso-ansi-language: EN-US; mso-bidi-language: AR-SA;">During transportation of rice husk through vehicles, it shall be covered from all sides with tarpaulin to prevent blowing of husk by winds. </span></p>
