A)   The industry is small scale red category dyeing unit and it was granted ‘Consent to Operate’ under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/LDH3/2021/17594889 dated 22.12.2021, valid upto 21.03.2022 for dyeing of acrylic yarn @ 1 TPD & clothes @ 1 TPD for discharge of trade effluent @ 400 KLD into sewer after treatment of ETP with conditions mentioned therein. B)   Thereafter, the industry had applied for renewal of Consent to Operate under Water (Prevention & Control of Pollution) Act, 1974. However, the consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 applied by the industry was refused vide no. CTOW/Renewal/LDH3/2022/18383479 dated 26.05.2022 due to the reason that the industry was failed to submit the copy of permission from MC to allow discharge into MC sewer. C)   Now, the industry has joined the CETP 50 MLD Tajpur Road, Ludhiana. D)  The study on effluent generation has been done by the Guru Nanak Dev Engineering College (GNE) and as per report it has total effluent generation as 857.6 KLD from its total 16 chambers of soft flow machines & cabinet machines of 120 Kgs X 4, 60 Kgs X 12. However, the industry has granted 400 KLD shares on 22.07.2022 of CETP, hence the discharge of the industry is 457.6 KLD more than the share allotted to it. Therefore, as per the directions issued by the Competent Authority of the Board, 02 chambers of soft flow, 4 cabinet of 120 Kg and 8 cabinet of 60 kg of the industry was sealed on 18.10.2022. E)   Thereafter, the flow of the industry has checked through Online Monitoring system provided by the PDA, which showing more effluent from its share allotted. Accordingly, the industry was visited by AEE of this office on 11.11.2022 and it was observed that the industry was in operation. During visit only 02 cabinet machine of 120 Kg & 03 cabinet machines of 60 Kg was found seal. The remaining all the dyeing machinery was in operation. The industry has removed the seals of 02 chambers of soft flow, 02 cabinet machines of 120 kg and 05 cabinet machines of 60 Kg its own and same was in operation during visit. The report in this regard was sent through e-noting 20379742 to the Competent Authority of the Board. The directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 was issued to the PSPCL authorities to disconnect the electricity supply of the industry vide Board's letter no. 7533-36 dated 16.12.2022. The PSPCL authorities was requested vide this office letters no. 7004-05 dated 20.12.2022 & 35-36 dated 10.01.2023. The PSPCL authorities disconnect the electric supply of the industry vide TDCO no. 97/298 dated 10.01.2023. F)   Now, the industry has applied for Consent to Operate under Water (Prevention & Control of Pollution) Act, 1974 through OCMMS for Dyed Acrylic Yarn @ 1 Ton/day & Cloth @ 1 Ton/day with discharge of discharge of trade effluent @ 400 KLD & domestic effluent @ 1 KLD into conveyance system of CETP 50 MLD. The industry had already deposited Rs. 54,000/- Vide UTR. No. 532516173 dated 30.06.2020 under Water Act, 1974, which is adequate upto 31.10.2024 after deduction of Rs. 5400/- as penalty. A)   The industry was visited by AEE of this office on 16.01.2023 and it was observed as under:- 1.    The industry was not in operation, during visit and its electric connection was found disconnected by PSPCL. 2.    The industry has installed 16 chambers of soft flow machines & cabinet machines of 120 Kgs X 4, 60 Kgs X 10 in its premises. The industry has removed 02 cabinet machines of capacity 60 Kgs each from its premises. Out of the above machinery, as reported earlier only 02 cabinet machine of 120 Kg & 03 cabinet machines of 60 Kg was found sealed. 3.    The industry is connected with the conveyance system of CETP 50 MLD, Tajpur Road, Ludhiana for discharge its effluent. The industry has provided the flow meter at its final outlet leading to CETP. The industry was also advised to provide the flow meter at inlet water supply. 4.    Further, some units have made the complaint regarding in judicial allotment of the shares by the PDA, Tajpur Road, Ludhiana, which is under process at Board and at Govt. Level.                  Till the finalization of the allotment of the shares of CETP 50 MLD, it is recommended that: <ol style="margin-top: 0in;" start="1" type="1"> <li class="MsoNormal" style="text-align: justify; line-height: 150%; mso-list: l4 level1 lfo4;">Consent to operate under Water (Prevention & Control of Pollution) Act, 1974 may be granted for short period as approved by the Competent Authority in such cases for the discharge of trade effluent & domestic effluent @ 400 KLD into conveyance system of CETP 50 MLD at existing machinery subject to the condition that:-</li> </ol>                     I.        The industry will install EMF at inlet water supply also within 01 month.                   II.        The industry shall make the necessary arrangements to achieve the effluent standards as per the inlet designed parameters of the CETP.                 III.        The industry shall stop discharging its effluent in case due to any reason the CETP is not operational or dedicated conveyance system is overflowing.                  IV.        The industry shall maintain the record of flow meter installed at outlet leading to CETP.                   V.        The industry shall not generate/discharge trade & domestic effluent more than 400 KLD without obtaining prior permission of the Board. 2.    Directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 be issued to again seal the 02 chamber of soft flow machine,  02 cabinet machines of capacity 120 Kg each and 03 cabinet of 60 Kg each. 3.    Suitable amount of Environmental Compensation be imposed on the industry due to de-sealing of its dyeing machinery at its own. 4.    Directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 & u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 be issued to PSPCL authorities to restore the electric connection of the industry temporarily for six month.   (Competency:  Worthy Chairman of the Board)
