<p class="MsoListParagraphCxSpFirst" style="margin-left: 27.0pt; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -22.5pt; line-height: 150%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; color: black;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: black;">The industry is a card board manufacturing unit utilizing ETP sludge of pulp & paper mill (category 32.3 of schedule –I of HOWM Rules, 2016) as one of the raw material and falls under red category. </span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 27.0pt; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -22.5pt; line-height: 150%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; color: black;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: black;">Now the industry has applied under green category under type code-3009 i.e. carboard or corrugated box and paper product (excluding paper or pulp manufacturing and without using boilers).</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 27.0pt; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -22.5pt; line-height: 150%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; color: black;"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: black;">The industry has submitted a letter issued by Scientist-D/Joint Director, MoEF&CC, HSM Division, New Delhi on 08.08.2017 (copy attached) to M/s Gujrat paper mill association, 198, Varun Complex, Phase-II, GIDC, Vapi-396195, wherein the de-inking sludge of paper mills has been considered as non-hazardous. The relevant extact of the said letter is as under:-</span></p>
<p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><em><span style="font-size: 10.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: black;">"This relates to your communication dated 28% July 2016 requesting the Ministry for "Removal of De-inking Sludge from Hazardous Waste Category.</span></em></p>
<p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><em><span style="font-size: 10.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: black;">2. The Technical Review Committee had a detailed deliberation in the matter during its 62™ Meeting held on 25 May 2017. The Committee was informed that the process of de-inking involves mechanical action and mild chemicals involving soap, aluminium chionde etc. but no chlorine or hypochloritc. The Committee noted that the sludge has been analysed by an accredited laboratory and various constituents analysed are reported to be below the concentration limits in Schedule-II. However, the sludge contains AOX in the concentration of 263 mg/kg for which no limit has boen prescribed in Schedule-II of the HOWM Rules, 2016.</span></em></p>
<p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><em><span style="font-size: 10.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: black;">3. The Committee noted that for paper mills the limit of AOX has been provided in respect of effluent discharge (1 kg/ton of paper). On that basis the effluent for discharge may contain upto 100 mg/ of AOX whereas the leachate from the sludge will contain only 13.15 mg/I. The AOX in the sludge meets the limit for discharge from paper mills and sludge can therefore be considered as non-hazardous. </span></em></p>
<p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><em><span style="font-size: 10.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: black;">4. The matter has been reviewed in this Ministry and subsequenty the recommendations of the Committee are agreed to.</span></em></p>
<p class="MsoListParagraphCxSpLast" style="text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><em><span style="font-size: 10.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: black;">5. This issues with the approval of the Competent Authority."</span></em></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: black;">The undersigned is of the view that the Regional Office be requested to process the above matter separately through e-noting and not in the application (to avoid pendency), being a policy matter. Until the decision is pending in the matter, the industry be advised to obtain consents to operate under the provisions of the Water Act, 1974 & Air Act, 1981 under red category. </span></p>
