It is submitted that the industry was granted consent to operate under the Water Act, 1974 & the Air Act, 1981 vide nos. CTOW/Renewal/FZR/2021/16900327 and CTOA/Renewal/FZR/2021/16900111 dated 29.09.2021 for operation of hot mix plant for production of premix @ 50 TPH valid upto 07.07.2022 each, subject to the suitable conditions mentioned therein and following special conditions:- 1.    The industry will submit its operational schedule to the regional office of the Board, within a period of one month, so as to carry out its air emission sampling. 2.    The industry will install separate energy meter with the APCD and shall maintain proper record regarding its operation. 3.    The industry will comply with the code of practice as prescribed by the Board vide notification no. Admn./SA2/F.No.178/99/03 dt. 26.04.99 for hot mix plant. 4.    The consent to operate is issued from pollution angle and the industry shall obtain the permission from DTP at its own level and shall also obtain statutory clearances / permissions from the other departments, as required. 5.    The industry shall intimate the schedule regarding operation of its hot mix plant within one month so as to Board can collect stack emission samples. In case of failure on the part of the industry, action as deemed fit shall be taken against the industry without giving any notice / opportunity, in accordance with the inspection policy notified by the Board. <span style="font-size: 12pt; line-height: 150%; font-family: Tahoma, 'sans-serif'; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">.                   The air emission sample of HMP was collected on 16.05.2022 and conc. of Particulate Matter was found as 127 mg/Nm3, which is within the permissible limit of 150 mg/Nm3.                   Now the industry has applied for renewal of consent to operate under the Water Act, 1974 and the Air Act, 1981. The HMP has submitted CA certificate dated 07.06.2022 regarding value of gross fixed assets of the industry of Rs. 59.36 lakhs as on 31.05.2022. The industry has already deposited Rs. 19,000/- each vide UTR/reference no. N271222136682273 and  N271222136688289 dated 28.09.2022 under the Water Act, 1974 and the Air Act, 1981, respectively, which is adequate upto 30.09.2028 under both Acts, including penalty of 25% of one year fee.                   The industry has submitted that they have established the unit after obtaining the permission of the DTP. That they are bound to obtain clearance from DTP office at their own level and the Board is not responsible for such clearance.                   To check compliance, the hot mix Plant was again visited by AEE of this office (undersigned) on 11.01.2023 and it was observed as under: 1.     The Hot Mix Plant was not in operation as per requirement. 2.     The Hot Mix Plant has installed dust collector followed by wet scrubber with water re-circulation system as air pollution control device to contain the emissions from rotary drum, which was in line/operation-able condition. 3.     The Hot Mix Plant has provided stack of adequate height above ground level with the APCD along-with sampling facility to facilitate the emission sampling. 4.     The Hot Mix Plant has provided stacks of adequate height with 02 bitumen heaters. 5.     The HMP has provided separate energy meter with the APCD. The reading of same was 517 KWH. As per record maintained, the HMP was lastly operated on 07.07.2022. 6.     The Hot Mix Plant has stabilized the vehicular movement area within its premises with stone aggregates and has made arrangement for sprinkling of water to suppress the dust emissions generated during vehicular movement through pipeline. 7.     The Hot Mix Plant has installed D.G set of capacity 125 KVA and proper canopy has been provided with the D.G. set. 8.     The Hot Mix Plant has constructed septic tank for treatment of domestic effluent with provisions to discharge the same onto land for plantation. 9.     The Hot Mix Plant has planted tree saplings along boundary.                     In view of the above, the HMP is complying with provisions of the Water Act, 1974 and the Air Act, 1981 as well as with code of practice prescribed for such units.                     Keeping in view of above, it is recommended that consent to operate under the Water Act, 1974 and the Air Act, 1981 may be granted to the hot mix plant upto 30.09.2028, with suitable conditions as per policy of the Board and additional special condition that the hot mix plant shall obtain necessary statuary clearances from the DTP Ferozepur and other departments at its own level and the Board will not be responsible for any financial loss, in case permission is not granted by the concerned department.
