<p class="MsoNormal" style="text-align: justify;">The point-wise reply is as under:-</p>
<p class="MsoListParagraphCxSpFirst" style="text-indent: -0.25in; text-align: justify;"><!-- [if !supportLists]-->1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span><!--[endif]-->Please give kind attention to the note dated 03/01/2023. The industry in its application of Consent to Operate under the Air (Prevention & Control of Pollution) Act, 1981 vide application no. 12166366 dated 18/02/2020 has submitted the CA Certificate in which it is shown that the Gross Capital Investments of the industry as of 31/12/2019 is Rs 16953.24 lacs without depreciation. However, now the certificate submitted by the industry shows that the Gross Capital Investment of the industry as of 31/3/2019 was Rs 12471.96 lacs and as of 31/03/2020 was Rs 12693.11 lacs. The representative of the industry was called to this office to provide suitable justification for the above but no reply has been given regarding this till date. The fee was calculated not based on the previous CA Certificate but on the basis of the correct CA Certificate.</p>
<p class="MsoListParagraphCxSpMiddle" style="text-indent: -0.25in; text-align: justify;"><!-- [if !supportLists]-->2.<span style="font-family: Times New Roman; font-size: xx-small;"> </span>Clause 41(1)(g) of the Water (Prevention & Control of Pollution) Act, 1974 is reproduced as under:-</p>
<p class="MsoListParagraphCxSpMiddle" style="text-align: justify;"><em>“for the purpose of obtaining any Consent under section 25 or section 26, knowingly or willingly makes a statement which is false in any material particular, shall be punishable with imprisonment for a term which may extend to three months or with a fine which may extend to <sup>1</sup>[ten thousand rupees] or with both.”</em></p>
<p class="MsoListParagraphCxSpMiddle" style="text-align: justify;">As the applicant has submitted false information which may have caused financial loss to the Board, if not detected, the application was processed for further action. However, such applications in the future will be returned as per the directions of the Competent Authority in this application.</p>
<p class="MsoListParagraphCxSpLast" style="text-indent: -0.25in; text-align: justify;"><!-- [if !supportLists]-->3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span><!--[endif]-->The suitable clear-cut recommendations have already been made vide note dated 03/01/2023 and 13/01/2023.</p>
