The project proponent was granted one –time Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974  vide RPM/02/10/203 dated 09.07.2002 and Air (Prevention & Control of Pollution) Act, 1981 vide RPM/APC/02/187 dated 09.07.2002 for manufacturing of industrial packaging plastic bags @ 400 kg/day under green category. The industry was visited by under-signed on 20.10.2022 and contacted Sh. Sundeep, Prop. During visit, it was observed as under: 1)      The industry is engaged in manufacturing of industrial packaging plastic bags using virgin granules and has installed 4 no. blow film machines and has also printing machine for carrying printing of bags. 2)      The process of the industry is covered under orange category. 3)      The waste-clothes used for cleaning of printing machine and empty containers in which ink is bought is disposed off to unauthorized persons. No record of agreement with authorized recyclers could be produced. 4)      The industry is operating without obtaining CTO under orange category and without obtaining authorization under HWM Rules, 2016. Thereafter, the personal hearing was given to the project proponent on 03.01.2023 before the Environmental Engineer, Regional Office, Mohali. During hearing it was decided as under: 1.       The industry will ensure the compliance of the provisions of the Plastic Waste Management Second Amendment Rules, 2022 in letter and spirit. 2.       The industry will apply registration as producer under Plastic Waste Management Second Amendment Rules, 2022 on CPCB EPR Portal within 7 days along with required documents. 3.       The industry will apply ‘Consent to Operate’ under Water Act, 1974 & Air Act, 1981 of the Board within 7 days. 4.       In case of failure to comply with above, the ‘Consent to Operate’ granted to the industry under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 will be revoked, Environmental Compensation will be levied and further action will be taken as per law without giving any notice/hearing. Now, the project proponent has applied varied Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of Industrial Packing Material (Plastic) @ 975 Kgs/day under orange category along with requisite documents.  The project proponent has submitted CA Certificate with the value of fixed assets of Rs. 69.30 lakh on 31.03.2022. The project proponent has deposited Rs. 44,000/- vide UTR no. SBIN222360365968 dated 26.12.2022 under Water Act, 1974 and Rs. 43,500/- vide UTR no. SBIN222360366933 dated 26.12.2022 under Air Act, 1981. After deduction of late fees, NOC regularization fees, the consent fees under the Water Act, 1974 is adequate till 31.05.2024 and under the Air Act, 1981 is adequate till 31.05.2025. The project proponent has submitted allotment letter approved from PSIEC vide no. 4897 dated 26.05.1995 for manufacturing of plastic goods issued in the name of Sandeep Mehandru (Proprietor). The project proponent has submitted GST certificate proof of proprietorship. On scrutinizing the application of the project proponent following observations were observed on 13.01.2023 with request to submit reply within 2 days. 1.       The project proponent has not submitted manufacturing process. 2.       The project proponent has not submitted approved building plan from competent person under Factory Act, 1948. 3.       The project proponent is required to submit proof regarding purchase of printing machines so that adequacy of fees may be adjudged. The site was visited by the undersigned on 17.01.2023 and contacted Sh. Lalta Prashad, Foreman (9815501984). During visit, it was observed as under: 1)      The industry is engaged in manufacturing of industrial packaging plastic bags using virgin granules and has installed 4 no. extruder, 4 no. cutting machines and has also installed 2 no. printing machine for carrying printing of bags. 2)      The waste-clothes used for cleaning of printing machine and empty containers in which ink is bought is disposed off to unauthorized persons. No record of agreement with authorized recyclers could be produced. The representative was advised to make an agreement with authorized recycler. 3)      No trade effluent is being generated from the process. Domestic waste water is dispose off into MC sewer. 4)      No DG set has been installed in the premises. 5)      The industry is located in industrial area approved for setting up of such type of industry. 6)      The industry has yet not obtained EPR registration under PWM Rules, 2022. In view of above, further action on the proceeding may be dropped, it is recommended that ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 may be granted till 31.03.2024 with special conditions as under: 1)      The industry will make agreement with authorized recycler for disposal of category 5.2 & category 33.1 within 15 days. 2)      The industry will obtain EPR registration from CPCB EPR portal under Plastic Waste Management Rules, 2022 within 15 days. 3)       The industry will obtain authorization under Hazardous & Other Wastes (Management & Trans boundary Movement) Rules, 2016 of the Board within 15 days. 4)      In case of failure to comply with the above conditions the Consent to Operate may be deemed to consider as cancelled/ revoked. *Competency - Senior Environmental Engineer.
