<p class="ydp8b25cf8eyiv6589084485ydp48a32f10msonormal" style="margin: 0in; text-align: justify; background: white;"><span style="font-size: 11.0pt; font-family: 'Arial',sans-serif; color: black; background: white;">The industry is small scale electroplating unit and falls in industrial Area-C, Ludhiana. </span></p>
<p class="ydp8b25cf8eyiv6589084485ydp48a32f10msonormal" style="margin: 0in; text-align: justify; background: white;"><span style="font-size: 11.0pt; font-family: 'Arial',sans-serif; color: black; background: white;">Earlier, directions u/s 33-A of Water (Prevention & Control of Pollution) Act, 1974 were issued for its closure and PSPCL was also directed to disconnect the power supply available the industry/premises vide letter no. 2891-92 dated 21.10.2022.</span></p>
<p class="ydp8b25cf8eyiv6589084485ydp48a32f10msonormal" style="margin: 0in; text-align: justify; background: white;"><span style="font-size: 11.0pt; font-family: 'Arial',sans-serif; color: black; background: white;">Now, the industry has applied for consent to operate under Water (Prevention & Control of Pollution) Act, 1974 with requisite documents and MOU with CETP operator i.e. M/s JBR Technology Pvt. Ltd., Phase-VIII, Focal Point, Ludhiana made on 13.07.2021 for lifting its trade effluent generated from electroplating process. Consent fee deposited by the industry is adequate upto 31.03.2025.</span></p>
<p class="ydp8b25cf8eyiv6589084485ydp48a32f10msonormal" style="margin: 0in; text-align: justify; background: white;"><span style="font-size: 11.0pt; font-family: 'Arial',sans-serif; color: black; background: white;"> The site of the industry was visited by JEE on 12.01.2023 and observed as under:-</span></p>

During visit, approximately 1200 litre of effluent was remained in the tank.</span></p>

<p class="ydp8b25cf8eyiv6589084485ydp48a32f10msonormal" style="margin: 0in; text-align: justify; background: white;"><span style="font-size: 11.0pt; font-family: 'Arial',sans-serif; color: black;">It is pertinent to mention here that CETP Operator i.e. M/s JBR Technologies Pvt Ltd, D-260-61, Phase-8, Focal Point, Ludhiana was given personal hearing before Chairman of the Board on 11.09.2020 and proceedings of hearing were issued vide Board’s letter no. 9078 dated 19.10.2020, wherein the CETP operator was directed that no new/revised agreements will be made without Consent to Establish/Consent to Operate of the Board and Ludhiana Effluent Treatment Society (LETS) shall issue letter of intent to the new members/ existing members which seek revision in agreements clearly delineating the balance capacity available with the CETP, which will form the basis for issuance of Consent to Establish/ Consent to Operate to the electroplating/surface coating units by the Board.</span></p>
<p class="ydp8b25cf8eyiv6589084485ydp48a32f10msonormal" style="margin: 0in; text-align: justify; background: white;"><span style="font-size: 11.0pt; font-family: 'Arial',sans-serif; color: black;">As per copy of agreement attached in consent application, the industry has made agreement with M/s JBR Technologies Ltd, D-260-61, Phase-8, Focal Point, Ludhiana for lifting of trade effluent @ 4,000 Liters per month on 13.7.2021 i.e. after the issuance of directions to the CETP operator by the Board. As such, the agreement executed between industry and CETP Operator is in violation of directions issued to the CETP Operator. </span></p>
<p class="ydp8b25cf8eyiv6589084485ydp48a32f10msonormal" style="margin: 0in; text-align: justify; background: white;"><span style="font-size: 11.0pt; font-family: 'Arial',sans-serif; color: black;">In view of above, it is recommended that application applied by the industry for consent to operate under Water Act, 1974 alonwith request to restore its electric connection may be refused.</span></p>
