<p class="MsoBodyText" style="margin: 0in 10.15pt 0.0001pt 11pt; text-align: justify; line-height: 18.4px;">The Assistant Environmental Engineer, brought out that the industry is a small scale orange category cupola furnace unit. Earlier, the hearing was given to the industry before the Senior Environmental Engineer of the Board for violations of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 wherein it was decided that:-</p>
<p class="MsoBodyText" style="margin: 0in 10.15pt 0.0001pt 27pt; text-align: justify; text-indent: -0.25in; line-height: 18.4px;">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span>The industry shall not operate its copula furnace till the adequate air pollution control device (APCD) is not provided.</p>
<p class="MsoBodyText" style="margin: 0in 10.15pt 0.0001pt 27pt; text-align: justify; text-indent: -0.25in; line-height: 18.4px;">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span>The industry shall provide adequate APCD with a Copula furnace and environment data board at the main gate, within 10 days.</p>
<p class="MsoBodyText" style="margin: 0in 10.15pt 0.0001pt 27pt; text-align: justify; text-indent: -0.25in; line-height: 18.4px;">3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span>The industry shall obtain an adequacy certificate of its APCD from PSCST, Chandigarh and submit same to the Board, within 15 days.</p>
<p class="MsoBodyText" style="margin: 0in 10.15pt 0.0001pt 27pt; text-align: justify; text-indent: -0.25in; line-height: 18.4px;">4.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span>The industry shall apply for consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 and authorization under Hazardous and other Waste (Management & Transboundary Movement) Rules, 2016, within 10 days.</p>
<p class="MsoBodyText" style="margin: 0in 10.15pt 0.0001pt 27pt; text-align: justify; text-indent: -0.25in; line-height: 18.4px;">5.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span>The Environmental Engineer, Regional office-1, Ludhiana shall visit the industry after 15 days and submit report/recommendations in the matter.</p>
<p class="MsoBodyText" style="text-indent: 0in; margin: 0in 10.15pt 0.0001pt 27pt; text-align: justify; line-height: 18.4px;">The industry has now applied for varied Consent to Operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of Workshop Equipment Tool Room Machinery @ 60 Nos./year and for the operation of Cupola furnace along with requisite documents and fees.</p>
<p class="MsoBodyText" style="margin: 0in 10.15pt 0.0001pt 11pt; text-align: justify; line-height: 18.4px;">The industry has submitted that they are not having any Registered deed by their name and the case regarding land is under the consideration of Hon’ble Punjab and Haryana High Court. The industry has not shifted its Cupola furnace from premises in a non-designated area to the designated industrial area as per the previous consent conditions. The industry has not submitted a Land use classification, and adequacy certificate of its APCD from PSCST, Chandigarh and has not applied for Authorization under Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016.</p>
<p class="MsoBodyText" style="margin: 0in 10.15pt 0.0001pt 11pt; text-align: justify; line-height: 18.4px;">The industry was visited by the undersigned on 04.07.2022 and it was observed as under: -</p>
<p class="MsoBodyText" style="margin: 0in 10.15pt 0.0001pt 31.5pt; text-align: justify; text-indent: -0.25in; line-height: 18.4px;">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span>The industry was not in operation during visit and found locked from outside.</p>
<p class="MsoBodyText" style="margin: 0in 10.15pt 0.0001pt 31.5pt; text-align: justify; text-indent: -0.25in; line-height: 18.4px;">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span>The cupola furnace installed by the industry was not in operation during visit and only moulding operations was under process by labour.</p>
<p class="MsoBodyText" style="margin: 0in 10.15pt 0.0001pt 31.5pt; text-align: justify; text-indent: -0.25in; line-height: 18.4px;">3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span>The industry has not installed Wet Scrubber with Cupola furnace as APCD.</p>
<p class="MsoBodyText" style="margin: 0in 10.15pt 0.0001pt 31.5pt; text-align: justify; text-indent: -0.25in; line-height: 18.4px;">4.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span>The industry has now installed Environmental Data Board outside the industry.</p>
<p class="MsoBodyText" style="text-indent: 0in; margin: 0in 10.15pt 0.0001pt 31.5pt; text-align: justify; line-height: 18.4px;"> </p>
<p class="MsoBodyText" style="margin: 0in 10.15pt 0.0001pt 11pt; text-align: justify; line-height: 18.4px;">The industry has failed to submit requisite documents and is not complying with the decisions of personal hearing. And whereas, it has now been decided to refuse the application of Consent to Operate under Air (Prevention & Control of Pollution) Act, 1981 and Water (Prevention & Control of Pollution) Act, 1974 and to initiate further action in the matter against the industry after giving the opportunity of show-cause with personal hearing As such, you are requested to appear before Environmental Engineer, Regional Office-1, E-648B, Focal Point, Phase-5, Ludhiana on 18/01/2023 at 11:30 a.m. failing which it will be presumed that the industry has nothing to say and further action in the matter will be initiated.</p>
<p class="MsoBodyText" style="margin: 0in 10.15pt 0.0001pt 11pt; text-align: justify; line-height: 18.4px;">Miss. Karishma, Accountant attended the said hearing but has failed to give any satisfactory reply for above said descrepencies/violations.</p>
<p class="MsoBodyText" style="text-indent: 0in; margin: 0in 0in 0.0001pt; text-align: justify; line-height: 18.4px;"> After hearing the representative of the industry and considering the facts on the record, the Environmental Engineer of the Board decided that the Consent to Operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 be refused.</p>
