<ul style="margin-top: 0cm;" type="disc"> <li class="MsoNormal" style="text-align: justify; line-height: 150%; mso-list: l5 level1 lfo1;">The brick kiln is a small scale orange category unit.</li> <li class="MsoNormal" style="text-align: justify; line-height: 150%; mso-list: l5 level1 lfo1;">The BKO was granted consent to operate under Air (Prevention and Control of Pollution) Act, 1981 Vide No. CTOA/Renewal/JAL/2019/10766035 dated 01.08.2019 valid upto 30.09.2024  for manufacturing of bricks and tiles @ 20000 nos/day by using CLAY @ 60 Metric Tonnes/Day, water @ 1000 Liter/day, sand @ 250 CFT/day, Coal @ 2.5 Metric Tonnes/Day as raw material.  </li> <li class="MsoNormal" style="text-align: justify; line-height: 150%; mso-list: l5 level1 lfo1;">The brick kiln was issued notice for violation of the provisions under Water (Prevention & Control of Pollution) Act, 1974 and under Air (Prevention and Control of Pollution) Act, 1981 with an opportunity of personal hearing before Environmental Engineer, Regional Office-1, Jalandhar on 22.02.2022, but no one attended the hearing.</li> <li class="MsoNormal" style="text-align: justify; line-height: 150%; mso-list: l5 level1 lfo1;">Thereafter,  the brick kiln was again  issued notice for violation of the provisions under Water (Prevention & Control of Pollution) Act, 1974 and under Air (Prevention and Control of Pollution) Act, 1981 with an opportunity of personal hearing before Environmental Engineer, Regional Office-1, Jalandhar on 14.03.2022, but no one attended the hearing.</li> <li class="MsoNormal" style="text-align: justify; line-height: 150%; mso-list: l5 level1 lfo1;">Thereafter,   The brick kiln was again  issued notice for violation of the provisions under Water (Prevention & Control of Pollution) Act, 1974 and under Air (Prevention and Control of Pollution) Act, 1981 with an opportunity of personal hearing before Environmental Engineer, Regional Office-1, Jalandhar on 04.04.2022, but no one attended the hearing.</li> <li class="MsoNormal" style="text-align: justify; line-height: 150%; mso-list: l5 level1 lfo1;">To verify the latest status, the brick kiln was visited by officer of this office on 11.06.2022 and observed that the brick kiln was in operation during visit and is using unauthorized fuel i.e carbon powder mixed with coal in its kiln. The brick kiln has converted to high draft zig-zag technology and also observed that the brick kiln is not complying the provisions of Water (Prevention & Control of Pollution) Act, 1974 and under Air (Prevention and Control of Pollution) Act, 1981.</li> </ul> <ul style="margin-top: 0cm;" type="disc"> <li class="MsoNormal" style="text-align: justify; line-height: 150%; mso-list: l4 level1 lfo2;">Thereafter, the directions were also issued to PSPCL authorities for disconnection of electricity available to the premises vide no. 2087-88 dated 27.10.2022. </li> <li class="MsoNormal" style="text-align: justify; line-height: 150%; mso-list: l4 level1 lfo2;">Further, it is pertinent to mention here that a meeting was held by Hon’ble Chairman of the Board on 28.01.2020 with the Punjab Brick Kiln Association regarding compliance of Govt. orders dated 28.05.2019 wherein it was decided as under:</li> </ul> 1.      The Regional Offices of the Board are required to impose / charge environmental compensation from the brick kiln owners from 01.02.2019 to 30.09.2019 for the period for which the brick kilns are actually operated (without converting to the induced draught technology). 2.      In case brick kiln is not operated after 30.06.2019 due to rainy season but the same brick kiln restarted its operations later on but without converting to induced draught technology, then environmental compensation will be levied for full period till the adoption of new technology. 3.      In case, any brick kiln is still operating without adopting the induced draught technology, immediate action for closure of kiln / cancellation of license by DFSC shall be taken. 4.      Following  document shall be obtained from the BKOs to ascertain the actual period of operation of the kiln: a)    The Coal Register duly signed by the BKOs and getting an undertaking to the effect that the entries made in the Coal Register are true & correct, may be taken as a documentary evidence. b)   For the Brick Kiln, which are using other authorized fuel than coal such as agro fuels/biomass, may be asked to submit a self undertaking mentioning the period for which the BKOs had operated the Brick Kiln without conversion into Induced Draught Technology. c)    The documents as mentioned in Para a & b above are to be authenticated by the Charted Accountant.  5.      Since the Brick kilns are generating and discharging very nominal quantity of domestic effluent and are of small scale, as such, the request of the association for exemption of fee for consent under the Water (Prevention & Control of Pollution) Act, 1974 be accepted and may be made applicable w.e.f 1.11.2018 subject to the ex-post facto approval of the Board. <ul style="margin-top: 0cm;" type="disc"> <li class="MsoNormal" style="text-align: justify; line-height: 150%; mso-list: l4 level1 lfo2;">Now, the industry has applied for renewal of consent to operate under Air (Prevention and Control of Pollution) Act, 1981 and fresh consent to operate under Water (Prevention & Control of Pollution) Act, 1974 through OCMMS of the Board. The industry has also submitted TDCO no. 95/5 Dated 02.11.2022 issued by PSPCL authorities for disconnection of three phase electric connection available to the brick kiln in the name of M/s H.S Dhillon BKO, Village Behram Sarishta, Bhogpur, Jalandhar. </li> <li class="MsoNormal" style="text-align: justify; line-height: 150%; mso-list: l4 level1 lfo2;">The industry was visited by EE & AEE of this office on 19.01.2022 and observed that the BKO was not in operation.</li> <li class="MsoNormal" style="text-align: justify; line-height: 150%; mso-list: l4 level1 lfo2;">The electric connection of the brick kiln was found disconnected. </li> <li class="MsoNormal" style="text-align: justify; line-height: 150%; mso-list: l4 level1 lfo2;">No unauthorized fuel i.e carbon powder mixed with coal was seen at kiln. The brick kiln has already converted to high draft zig-zag technology. </li> </ul> ·         The BKO has uploaded the completion certificate issued by M/s Punjab State Council for Science & Technology, Chandigarh regarding the BKO has modified their existing brick kiln into induced draft brick kiln with Zig Zag firing as per design of PSCST, Chandigarh letter No. 588 dated 29.01.2018.   ·         The BKO is not required to submit any environmental compensation as it has not operated without converting to Zig zag / induced draft technology any time between 01.02.2019 to 30.09.2019 as it was converted before and has obtained completion certificate regarding conversion to zig zag / induced draft technology as mentioned above. ·         There is no source of trade effluent generation and only generation of domestic effluent and has made arrangement for the disposal of domestic effluent onto land for plantation after septic tank.           The industry falls in orange category and the competency to decide the case lies with Environmental Engineer.  Keeping in view of above, it is recommended that: 1.    Fresh consent to operate under Water (Prevention & Control of Pollution) Act, 1974 may be granted to BKO for a short period of six months with usual conditions and special condition that it will not use any illegal fuel.   2.    Renewal of consent to operate under Air (Prevention & Control of Pollution) Act 1981 may be granted to BKO for a short period of six months with usual conditions and special condition that it will not use any illegal fuel. 3.    The District Food & Civil Supplies Controllers (DFSC) be directed not to suspend the license of the Brick kiln for six months. 4.    That Punjab State Power Corporation Ltd. be directed to restore the supply of electricity to the brick kiln temporarily for six months. 5.    The BKO will obtain Environmental Clearance under EIA notification for mining of brick clay to be used as raw material for manufacturing of bricks at site immediately. 6.    The BKO will provide more plants along boundary wall.
