CTE/Fresh/LDH3/2020/13189235 dated 08.09.2020 valid upto 07.09.2021 for setting up of warehousing project for storage of warehouse for storage of goods (textile goods, consumerable goods and industrial goods) @ 600 MTD in the revenues estate of Village Kadian, Tehsil & District Ludhiana under green category along with conditions mentioned therein along with conditions mentioned therein. </span></p>
<p class="Normal1" style="text-align: justify; text-indent: 70.9pt; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;">Thereafter, the project proponent applied for ‘Consent to Operate’ under the </span><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981. </span></p>
<p class="Normal1" style="text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;">The site was visited by AEE of this office on 18.08.2022 it was observed as under:</span></p>

<p class="Normal1" style="margin-left: 21.3pt; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l1 level4 lfo1;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;">The project proponent had constructed 03 no. borewells for rain water harvesting. All three borewells were checked and it was observed that only rain water was discharged into 02 borewells. However, line of untreated domestic effluent was found connected with 3<sup>rd</sup> borewell. The water samples from this borewells were collected during visit and sent to Zonal Lab, Ludhiana for analysis and as per this report, the concentration of parameters was pH = 8.6, TSS = 64, COD=108, BOD=32 & O&G=BDL. Thus, the concentration of various parameters indicated that the project proponent had discharged untreated domestic waste water into borewell. </span></p>
<p class="Normal1" style="margin-left: 21.3pt; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l1 level4 lfo1;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">4.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;">The project proponent had not provided septic tanks for treatment of domestic waste water and same was discharged into borewell. </span></p>
<p class="Normal1" style="margin-left: 21.3pt; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l1 level4 lfo1;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">5.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;">The project proponent had not provided any plantation for disposal of waste water. </span></p>
<p class="Normal1" style="text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;">Accordingly, Consent to Operate under the Water Act, 1974 applied by the industry was refused on 29.07.2022.</span><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';"> </span></p>
<p class="Normal1" style="text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;">As such, the industry was violating the provisions of the Water Act, 1974. The report of the same was sent vide e-noting no. 19820240. Accordingly, notice u/s 33-A of the Water Act, 1974 was issued to the industry with hearing before Chief Environmental Engineer, Ludhiana on 25.01.2023.</span></p>
<p class="Normal1" style="text-align: justify; text-indent: 70.9pt; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;">Now, the project proponent has applied for ‘Consent to Operate’ under the </span><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">Water (Prevention & Control of Pollution) Act, 1974 and of the Air (Prevention & Control of Pollution) Act, 1981 through OCMMS for </span><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;">warehousing for storage of warehouse for storage of goods (textile goods, consumerable goods and industrial goods) @ 600 MTD</span><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">.</span></p>
<p class="Normal1" style="text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;">The Project proponent has already deposited Rs. 1,18,800/- vide UTR. No. 849158548 dated 29.07.2022 under the Water Act, 1974 and Rs. 1,18,800/- vide UTR. No. 311171278 dated 29.07.2022 under the Air Act, 1981, which is adequate upto 31.12.2035 under both Act. The industry has also deposited Rs. 21,600/- (Rs. 10,800/- vide UTR. No. 849158548 dated 29.07.2022 + Rs. 10,800/- vide UTR. No. 311171278 dated 29.07.2022) as NOC regularization fee for increased fixed assets. </span></p>
<p class="Normal1" style="text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;">The site was visited by AEE of this office on 20.01.2023 it was observed as under:</span></p>

<p class="Normal1" style="margin-left: 21.3pt; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l0 level4 lfo2;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;">The industry has now installed STP for treatment of its domestic effluent. The industry has submitted analysis report of its effluent samples collected from the outlet of the STP analyzed from NABL Lab. Concentration of various parameters was pH = 7.31, TSS = 32<span style="mso-tab-count: 1;"> </span> mg/l, TDS = 942 mg/l, COD=77 mg/l, BOD=23 mg/l & O&G=2 mg/l. Thus, the concentration of various parameters is within the prescribed limits of the Board. </span></p>
<p class="Normal1" style="margin-left: 21.3pt; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l0 level4 lfo2;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">4.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;">The treated effluent is discharged onto land for plantation. The industry has developed plantation area in an area of about 10 marlas, which is adequate for discharge of treated domestic effluent @0.8 KLD. Now, there is no provision to discharge treated / untreated effluent into borewell. </span></p>
<p class="Normal1" style="text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;">Keeping in view of above, it is recommended that application for obtaining ‘Consent to Operate’ under the </span><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">Water (Prevention & Control of Pollution) Act, 1974 & </span><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;">‘Consent to Operate’ under the </span><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">Air (Prevention & Control of Pollution) Act, 1981 may be decided in light of the decisions of the personal hearing dated 25.01.2023.</span></p> |
