It is submitted that the industry is a rice sheller unit, which falls under small scale orange category and has been established after obtaining consent to establish (NOC) vide no. CTE/Fresh/FZR/2022/19107908 dated 09.07.2022, valid upto 08.07.2023 for the  manufacturing of Raw rice with dryer @ 6.0 TPH alongwith sortex machine of capacity 4.0 TPH of sorted rice, under Orange category, with certain conditions mentioned therein.                        Now, the industry has applied for obtaining fresh consents to operate under the Water Act, 1974 and the Air Act, 1981 for the manufacturing of Raw rice with dryer @ 6.0 TPH alongwith sortex machine of capacity 4.0 TPH of sorted rice, under Orange category. The detail of case is as under:-                        The industry has submitted completion certificate regarding installation of cyclone separator as APCD for the Pre-cleaning section as per attached drawings/ specifications.                        The rice sheller has submitted partnership deed executed on dated 02.05.2022 between 1. Sh. Amarjit Singh Sandhu S/o Sh. Gurbax Singh Sandhu, R/o Village Mana Singh Wala, 2. Sh. Gurpreet Singh Sandhu S/o Sh. Amarjit Singh Sandhu, R/o Village Mana Singh Wala  and 3. Sh. Rakesh Kumar S/o Sh. Parshotam Lal, R/o Talwandi Bhai, Distt. Ferozepur in which it is mentioned that both the above partners have decided to run the business of rice sheller unit in the name & style of M/s Gurbax Rice Mills, Village Bazidpur, District Ferozepur under duly executed partnership deed dated w.e.f. 02.05.2022.                        The industry has deposited Rs. 54,000/- vide UTR/Ref. No. N002232271288593 dated 02.01.2023 as water consent fee under the Water Act, 1974 and Rs. 54,000/- vide UTR/Ref. No. N002232271282333 dated 02.01.2023 as air consent fee under the Air Act, 1981, against the fixed assets of Rs. 377.30 Lakhs as on 31/12/2022 as per CA certificate dated 04/01/2023 submitted by it. Thus, the consent fee is adequate upto 30/09/2027 under each Acts..                        The industry was visited by AEE of this office on 11.01.2023 and it was observed as under:- 1.    The industry was not in operation during visit. The industry has installed machinery for the production of sorted raw rice with dryer. 2.    The industry has covered all the processing sheds. 3.    The industry has not provided brick paved road from main gate of the industry to the rice room/husk area for the movements of vehicles. 4.    The industry has provided separate Cyclone Separator as APCD along with stack of adequate height to control the process emission from shelling section as well as paddy cleaner attached with 2 dryer. 5.    The industry has provided stack of adequate height with the APCD and provisions to facilitate emission sampling. 6.    The industry has not provided brick wall of 70 feet length & 15 feet height around husk discharge / storage area, in compliance to code of practice prescribed by the Govt. vide order dt. 15.10.2013. 7.    The industry has not provided septic tank for treatment of domestic effluent. 8.    The industry has not planted trees along its boundary wall.                         The industry is not complying with the code of practice notified by the Govt. of Punjab, Department of Science, Technology & Environment vide notification no 10/48/2004-STE-(4) / 932 dated. 15/10/2013. The competency for grant of consents to the rice shellers with dryer lies with the Environmental Engineer of the Regional Office.                         Keeping in view of above mentioned facts, it is, therefore, recommended that the applications of the industry submitted for obtaining fresh consents to operate under the Water Act, 1974 and the Air Act, 1981 may be refused, please.
