It is submitted that the industry was granted consent to operate under Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/PTA/2019/9215948 dated 06/02/2019 and under Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/PTA/2019/9215799 dated 06/02/2019, both are valid upto 30/09/2023 for manufacturing of Rice Bran Oil @ 11 TPD, De-Oiled Rice Bran @ 67 TPD by using Rice Bran, Phuck @ 80 MTD as raw material with conditions mentioned therein.   The industry was visited by the undersigned on 18.10.2022 during the visit in the area and observed as under: <p class="MsoListParagraph" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; text-indent: -0.25in; line-height: 24px; margin: 0in 0in 6pt 17.3pt;">1.     The industry was running in the name and style of M/s Maa Shakti Oil (Earlier M/s Satnam Oil Mills Pvt. Ltd.,) without obtaining consent to operate under the Water Act, 1974 and under the Air Act, 1981 at the new name. <p class="MsoListParagraph" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; text-indent: -0.25in; line-height: 24px; margin: 0in 0in 6pt 17.3pt;">2.     During visit, black smoke was found emitting from the stack of the boiler installed by the industry. <p class="MsoListParagraph" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; text-indent: -0.25in; line-height: 24px; margin: 0in 0in 6pt 17.3pt;">3.     Large quantity of fuel ash was found stored in open inside the premises. The industry is not having any agreement for disposal of the same nor maintaining any record regarding generation / disposal of fuel ash. The industry was found violating the provisions of the Air Act, 1981 and also not complying with the conditions of the consents granted to it under the said Act. The industry was issued show cause notice for revocation of consent granted under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981  has been served to the industry vide letter no. 7425-26 dated 05.12.2022.       Hearing fixed before the Senior Environment Engineer (ZP-I) on 15.12.2022 at 11.00 AM. However, no one from the industry attended the said hearing. The Competent Authority has decided to give the industry last opportunity of personal hearing before taking the proposed action under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 Air (Prevention & Control of Pollution) Act, 1981 of the unit has been served to the industry with an last opportunity personal hearing before the Senior Environment Engineer (ZP-I) on 26/12/2022, after hearing, officer of the Board and the representative of the industry, Senior Environmental Engineer, Zonal Office-1, Patiala of the Board decided that:   <p class="MsoListParagraph" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; text-indent: -27pt; line-height: 24px; margin: 0in 0in 6pt 27pt;">1.             The Environmental Engineer, Regional Office, Patiala shall visit the industry to verify the contentions of the industry and shall process the consent cases applied by the industry under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981 on merits.. <p class="MsoListParagraph" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; text-indent: -27pt; line-height: 24px; margin: 0in 0in 6pt 27pt;">2.             Further action, shall be taken after the receipt of report/recommendations from the Environmental Engineer, Regional Office, Patiala. The proceedings of the aforesaid personal hearing were conveyed to the industry vide letter no. 135 dated 05.01.2023 for making compliance.   Now, the industry has taken on lease from 03.10.2022 to 02.10.2025 from M/s Maa Sharda Oils (Lessee of Satnam Oils Private Limited) and has applied for obtaining consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and transfer of consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 under the name and style of M/s Maa Sharda Oils (Lessee of Satnam Oils Private Limited)  alognwith requisite documents. The industry has deposited Rs. 41480/- vide R. No. 345145141 dated 23.12.2022 under Water (Prevention & Control of Pollution) Act, 1974 and Rs. 33400/- vide R. No. 657443850 dated 23.12.2022 under Air (Prevention & Control of Pollution) Act, 1981. The consent fee deposited by the industry is adequate upto 30.09.2025 against the fixed assets of Rs. 238.09 lacs as on 30.11.2022 as per CA certificate submitted by it. The industry has deposited Rs. 3600/- Vide R.No. 657443850 dated 23.12.2022. The industry has also submitted compliance Report, CA certificate etc. The industry was visited by undersigned on 11.01.2023 and during visit, it was observed as under- 1. The industry was in operation during visit. 2. The industry has installed ETP for the treatment of process water and treated water was being re-circulated. The industry has not maintained record w.r.t re-circulation of entire treated trade effluent and industry was advised to maintain the record in the future. 3.Domestic effluent is being discharged onto land for plantation after passing through septic tank. The entire cooling water is being recirculated. 4. The industry has installed 1 no. boiler of capacity 5.5 TPH using rice husk as fuel equipped with cyclone separator as APCD alongwith adequate stack height. 5. The air emission sampling of the stack was carried out during visit and air emission sample has been sent to Head Office, lab for analysis. The anaysis result has been recieved & perticular matter was found to be 373 mb/Nm3, which is within permissible limit. 6 The representative of the industry informed that the industry will provide additional cyclone separator with the old one within two months to achieve prescribed emission standards all the time.    7. The industry has also submitted stack emissions sampling reports and analyzed by Board’s Approved Laboratory (Noida Testing Laboratories, SAS Nagar) on 17.12.2022. As per the report, the concentration of particulate matter is 387 mg/Nm3, which are within the permissible limits as prescribed by the Board From above, it was observed that the industry is complying with the conditions of the consents granted under the Water Act, 1974 and the Air Act, 1981. In view of above, it is recommendation may be sent to SEE, ZP-1 for obtaining consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and transfer of consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 may be granted to the industry upto 30.09.2025 under orange category with suitable conditions as per policy of the Board.
