It is submitted that the industry was granted Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Varied/PTA/2021/14814243 dated 15.01.2021 having validity upto 30.09.2030 for discharge of domestic effluent @ 1.5 KLD onto land for plantation after treated in septic tank and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Varied/PTA/2021/14813858 dated 15.01.2021 having validity upto 30.09.2030 for production of Rice @ 1.0 T/hour by processing of Paddy @ 1.5 T/hour as raw material (with drier) under red category subject to certain conditions as mentioned therein.   Thereafter, the industry was granted NOC for expansion for the processing of Paddy@ 4.5 TPH to manufacture Rice @ 3.0 TPH (with drier) under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Exp/PTA/2022/19195093 dated 12.07.2022 valid upto 02/07/2023 and discharge of domestic effluent @ 1.5 KLD, subject to certain conditions as mentioned therein.   Now, the industry has applied for varied consent to operate under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981 for the manufacturing of Rice @ 3.0 T/hour by processing of Paddy @ 4.5 T/hour, (with drier) and discharge of domestic effluent @ 1.5 KLD under orange category along with requisite documents. The industry has deposited Rs. 12800/- vide online receipt no.  732406845 dated 02.01.2023 as consent fee under Water (Prevention and Control of Pollution) Act, 1974 and Rs. 12800/- vide online receipt no. 491161743 dated 02.01.2023 as consent fee under Air (Prevention and Control of Pollution) Act, 1981. The industry also deposited Rs. 360/- vide online receipt no.  732406845 dated 02.01.2023 as penalty charges under Water (Prevention and Control of Pollution) Act, 1974 and Rs. 360/- vide online receipt no. 491161743 dated 02.01.2023 as penalty charges under Air (Prevention and Control of Pollution) Act, 1981. Therefore, the total consent fee deposited by the industry is adequate upto 30.09.2032 against the fixed assets of Rs. 67.32 lakh as on 30.11.2022 as per CA certificate dated 15.12.2022 submitted by the industry.  The industry has submitted NOC compliance report of consent conditions earlier granted to it.   Completion Certificate of APCD:-   The industry has submitted Completion Certificate w.r.t APCD installed with the shelling section from Terrasvn Initiatives, SCF-29, SST Nagara, Rajpura Road, Patiala     Approved building plan:- The industry has also submitted building plan approved from competent person of Director of Factories under Punjab Factory Act Rule, 1948.   Undertaking:-   The rice sheller has submitted letter dated 31.12.2022, which is reproduced as under:                      I, Ram Paul, Partner of the firm, want to state as under :- 1.     That varied consents under the Air Act, 1981 & Water Act, 1974 were granted  on dt. 15/01/2021,   which are valid up to 30/09/2030 for  processing of  Paddy @ 1.5 T/hr. to manufacture Dry Rice @ 1.0 T/hr. (with Drier). 2.     That the NOC for expansion was granted  to  us on  dated  12/07/2022, valid up to 02/07/2023 for  processing of  Paddy @ 4.5 T/hr. to manufacture Dry Rice @ 3.0 T/hr. <ol style="margin-top: 0in;" start="3" type="1"> <li class="MsoNormal" style="margin-bottom: .0001pt; line-height: normal; mso-list: l0 level1 lfo1;">That expanded capacity of our sheller came into working in the month of December, 2022. </li> <li class="MsoNormal" style="margin-bottom: .0001pt; line-height: normal; mso-list: l0 level1 lfo1;">That as on 30/11/2022, the Gross  value  of  fixed  assets  of  the firm is at  Rs. 67.32 lacs. (Land : Rs. 20.68 lacs,  Building : Rs. 14.22 lacs and Plant & Machinery : Rs. 32.42). </li> <li class="MsoNormal" style="margin-bottom: .0001pt; line-height: normal; mso-list: l0 level1 lfo1;">That Approved Building Plans from Competent Person enclosed herewith.</li> </ol>   <ol style="margin-top: 0in;" start="6" type="1"> <li class="MsoNormal" style="margin-bottom: .0001pt; line-height: normal; mso-list: l0 level1 lfo1;">That completion certificate of APCD enclosed herewith.</li> <li class="MsoNormal" style="margin-bottom: .0001pt; line-height: normal; mso-list: l0 level1 lfo1;">That we are depositing online Rs. 52,500/- towards Air Consent  fee :Rs. 12,800/-, Water Consent  fee : Rs. 12,800/-, Application Form fee : Rs. 500/-, Penalty Charges (Air Consent): Rs. 360/- and  Penalty Charges (Water Consent) : Rs. 360/-, adequate up to 30/09/2032.</li> </ol>   The industry was visited by AEE of this office on 16.1.2023 . During visit, it was observed as under: 1. The industry was not in operation due to off season. 2. The industry has installed cyclone as APCD with the pre-cleaner of the drier section and separate cyclone with the milling section to control process emissions. 3. The industry has provided paved / brick roads inside their premises for movement of vehicles, so as to prevent the generation of dust. 4. The industry has provided brick wall of about 10' height approximately and wind screen of 5 ft. height over it as per latest code of practice in the husk disposal area so as to maintain a free Board of 3.5 ft. above the discharge point of rice husk. 5. The industry has provided septic tank for the treatment of domestic effluent generated from its premises and the treated domestic effluent was being utilized onto land for plantation along the boundary of the unit. 6. The industry has submitted the analysis report stack emission and drier with pre-cleaner from private lab and the analysis results is found with the prescribed limits of the Board. 7. The industry has not installed any DG set within its premises. The industry is complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981.   Hence, the industry is  also complying with new code of practice notified by Govt. Notification no. 10/48/2004-STE (4) /932 dated 15/10/2013 and the conditions of NOC expansion granted to it.   The industry is complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981. Keeping above in view, it is recommended that varied consent to operate under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981 may be granted to the industry upto 30.09.2032 for the manufacturing of Rice @ 3.0 T/hour by processing of Paddy @ 4.5 T/hour (with drier) and discharge of domestic effluent @ 1.5 KLD under orange category as per policy of the Board.
