<p class="MsoNormal" style="text-align: justify; line-height: 24px;"><span lang="EN-IN" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif'; background: white;">It is submitted that as per the direction of the competent authority, the complaint site was visited on 21.01.2023 and Sh. Paramvir Singh, complainant (98146-03782) was contacted. During visit, Sh. Paramvir Singh informed that the problem related to fly ash in the area has now reduced by almost 90-95%, since last 10-12 days. He further, informed that the problem of fly ash in the odd hours has also been reduced significantly and their problem is now almost resolved.</span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 24px;"><span lang="EN-IN" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif'; background: white;">Further, it is submitted here that now, the industry M/s Nahar Industrial Enterprises Ltd. vide letter dated 17.01.2023 has submitted a copy of Fly Ash Management Report carried out by Thappar Institute of Engineering & Technology (TIET), wherein, it has been recommended as under by the expert team of TIET:</span></p>
<p class="MsoListParagraphCxSpFirst" style="margin-left: 63pt; text-align: justify; text-indent: -0.25in; line-height: 24px;"><span lang="EN-IN" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">a)<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-IN" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif'; background: white;">Industry needs to sign the MOU with the vendors who are collecting/utilizing the ash from NIEL industry.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 63pt; text-align: justify; text-indent: -0.25in; line-height: 24px;"><span lang="EN-IN" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">b)<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-IN" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif'; background: white;">Industry should execute the metals analysis in the ash minimum once in a month from reputed labs.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 63pt; text-align: justify; text-indent: -0.25in; line-height: 24px;"><span lang="EN-IN" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">c)<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-IN" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif'; background: white;">There should be an official record for the ash disposal to the vendors on daily basis. Handwritten records should be avoided.</span></p>
<p class="MsoListParagraphCxSpLast" style="margin-left: 63pt; text-align: justify; text-indent: -0.25in; line-height: 24px;"><span lang="EN-IN" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">d)<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-IN" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif'; background: white;">Industry and ash vendors needs to set up a Transport manifesto for the effective and corrective ash generation and disposal mechanism.</span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 24px;"><span lang="EN-IN" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif'; background: white;">A copy of the said report of TIET is attached herewith for kind perusal please.</span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 24px;"><span lang="EN-IN" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif'; background: white;">In view of the reply submitted by the industry, report of expert team of TIET and the present situation in the surrounding area as informed by the local residents of Lalru, if approved, the industry may be granted renewal of ‘consent to operate’ under the Air (Prevention & Control of Pollution) Act, 1981, upto 31.03.2024, subject to suitable conditions and following additional conditions:</span></p>
<p class="MsoListParagraph" style="margin: 0in -2.3pt 0.0001pt 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif'; letter-spacing: -0.05pt;">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-IN" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">The industry shall comply with the recommendations made by TIET in its report, within 01 month and shall thereafter submit monthly compliance of the same to the Board on 5<sup>th</sup> of every month.</span></p>
<p class="MsoListParagraph" style="margin: 0in -2.3pt 0.0001pt 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif'; letter-spacing: -0.05pt;">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-IN" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">The industry shall get the regular cleaning/maintenance of the ESP installed with the boiler of capacity 55 TPH.</span></p>
<p class="MsoListParagraph" style="margin: 0in -2.3pt 0.0001pt 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif'; letter-spacing: -0.05pt;">3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-IN" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">The industry shall ensure that there is no problem related to flyash in the area, at any point of time.</span></p>
<p class="MsoListParagraph" style="margin: 0in -2.3pt 0.0001pt 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif'; letter-spacing: -0.05pt;">4.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-IN" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">The industry shall ensure that due to operation of the project at the site, no nuisance for general public is created at any time and no public complaints are received.</span></p>
<p class="MsoListParagraph" style="margin: 0in -2.3pt 0.0001pt 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif'; letter-spacing: -0.05pt;">5.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-IN" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">The adequacy/ efficacy of the pollution control arrangements shall be the sole responsibility of the industry and the industry shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time.</span></p>
<p class="MsoListParagraph" style="margin: 0in -2.3pt 0.0001pt 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif'; letter-spacing: -0.05pt;">6.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-IN" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">The consent to operate is being issued to the project proponent based upon the documents/ information submitted by it along with the online application form. The Board would be at liberty to take penal action against the industry/project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time, without any opportunity of Personal Hearing.</span></p>
<p class="MsoListParagraph" style="margin: 0in -2.3pt 0.0001pt 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif'; letter-spacing: -0.05pt;">7.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-IN" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">In case the project proponent fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the project proponent.</span></p>
