CTOW/Renewal/PTA/2021/17353605 dated 20/12/2021 having validity upto 15/06/2022 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/PTA/2021/16782593 dated 20/12/2021 having validity upto 15/06/2022 having capacity of 600 persons per function subject to conditions as mentioned therein. </span></p>
<p class="MsoNoSpacing" style="text-align: justify; line-height: 150%;"><span lang="EN-IN" style="font-size: 12.0pt; line-height: 150%; mso-bidi-font-family: Calibri;">Now, the marriage palace has applied for varied consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for 500 persons capacity per function with requisite documents. The marriage palace has deposited <a name="_Hlk125310533"></a>Rs. 16400/- vide online receipt no. 666732996 dated 29.12.2022 on account of consent fee under the Water (Prevention & Control of Pollution) Act, 1974 and Rs. 16400/- vide online receipt no. 593034208 dated 29.12.2022 <span style="mso-spacerun: yes;"> </span>on account of consent fee under the Air (Prevention & Control of Pollution) Act, 1981 and Rs. 4200/- vide online receipt no. 666732996 dated 29.12.2022 on account of penalty charges under the Water (Prevention & Control of Pollution) Act, 1974 and Rs. 4200/- vide online receipt no. 593034208 dated 29.12.2022 <span style="mso-spacerun: yes;"> </span>on account of penalty charges under the Air (Prevention & Control of Pollution) Act, 1981. The consent fee deposited by the marriage palace is adequate upto 30.09.2027 against the total investment of Rs. 107.87 lakh as on 30.11.2022 as per C.A. certificate submitted by it.<span style="mso-spacerun: yes;"> </span></span></p>

<li class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; line-height: normal; mso-list: l12 level1 lfo13;"><span style="font-size: 12.0pt; mso-bidi-font-family: Calibri;">That we had purchased the above said marriage palace on 30/01/2020, which was earlier running in the name of Sandhu Marriage Palace.</span></li>
<li class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; line-height: normal; mso-list: l12 level1 lfo13;"><span style="font-size: 12.0pt; mso-bidi-font-family: Calibri;">That the actual gathering capacity of our palace is around 450-500 persons/per function. However, at the time of obtaining consents in our name, we applied on the same capacity as previously granted to the old firm i.e. 600 persons/per function.</span></li>
<li class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; line-height: normal; mso-list: l12 level1 lfo13;"><span style="font-size: 12.0pt; mso-bidi-font-family: Calibri;">That now we want to reduce the capacity our marriage palace at maximum up to 500 persons/per function and in this regard, we are applying for obtaining varied consents to operate for the maximum capacity of 500 persons/per function.</span></li>

(Land : Rs. 75.29 lacs, Building : Rs. 32.18 lacs, M.F.A. : Rs. 0.40 lacs).</span></li>

(Land : Rs. 75.29 lacs, Building : Rs. 32.18 lacs, M.F.A. : Rs. 0.40 lacs).</span></li>

The Worthy Chairman of the Board has decided as under: </span></p>

However, in case of continuous violations or in case of no visible progress towards compliance of guidelines, concerned offices of the Board are at liberty to initiate action against the violator units as per the provision of law. </span></p>

Regional Office shall not insist upon for submitting CGWA/PWRDA clearances before grant of consents but shall impose the condition for obtaining such permission in the NOC/Consent letter. </span></p>

<p class="MsoNormal" style="text-align: justify;"><span style="background-color: white; font-size: 12pt;">From the above discussion, it is evident that the marriage palace is complying with some of conditions of the office order dated 02.02.2021. However, it is yet to comply with all the conditions in true letter and spirit.</span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-size: 12.0pt; line-height: 115%; mso-bidi-font-family: Calibri; background: white;">In view of the above, it is recommended that the varied consent to operate under the Water Act, 1974 and the Air Act, 1981 may be granted to the marriage palace upto 30.09.2027 subject to conditions and the special condition that the marriage / resort owner shall ensure the compliance of the mechanism / guidelines prescribed by the Board on 02.02.2021 in true letter and spirit. </span></p> |
