<p class="MsoListParagraphCxSpLast" style="margin-left: 0.25in; text-align: justify; text-indent: -0.25in;"><strong><span style="font-family: Tahoma, 'sans-serif';">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-weight: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span></strong><strong><u><span style="font-family: Tahoma, 'sans-serif';">The Court case related to the industry filed in the Hon'ble NGT vide O.A. no. 125/2020 titled as Kulwant Singh & Ors v/s Union of India & Ors</span></u></strong></p>
<p class="MsoNormal" style="margin-bottom: 6pt; text-align: justify;"><span style="font-family: Tahoma, 'sans-serif';">The Hon’ble NGT vide its order dt. 07.04.2021 in O.A. no. 125/2020 titled as Kulwant Singh & Ors v/s Union of India & Ors relating to M/s Talwandi Sabo Power Plant, Mansa gave certain recommendations wherein one of the recommendations was as under:-</span></p>
<p class="MsoNormal" style="margin-bottom: 6pt; text-align: justify;"><span style="font-family: Tahoma, 'sans-serif';">“Punjab Pollution Control Board shall get conduct study on air quality model which may be based on Gaussian Model or any other suitable and appropriate model to assess the impact of operation of thermal plant in the area and concentration of pollutants responsible for damage to the human being and agriculture crops from reputed institute on the cost of the industry within 03 months. Based on the findings and recommendations of the institute, the industry shall submit its Action Plan to Punjab Pollution Control Board within next 01 month and the compliance of the same may be made by the industry within 06 months.”</span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-family: Tahoma, 'sans-serif';">The matter was considered by the Competent Authority and it was decided to engage M/s Central University of Punjab located at village Ghudda, Distt. Bathinda to conduct the requisite study on the air qualtity model to assess the impact of operation of the Thermal Power Plant in accordance with the order dated 07.04.2021 passed by the Hon'ble NGT.</span></p>
<p class="MsoNormal" style="margin-bottom: 6pt; text-align: justify;"><span style="font-family: Tahoma, 'sans-serif';">The report in the matter is yet to be submitted by the said University.</span></p>
<p class="MsoListParagraph" style="margin-bottom: 6pt; text-align: justify; text-indent: -0.25in;"><strong><span style="font-family: Tahoma, 'sans-serif';"> 2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-weight: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span></strong><strong><u><span style="font-family: Tahoma, 'sans-serif';">Status of complaints against the industry</span></u></strong></p>
<p class="MsoNormal" style="margin-bottom: 6pt; text-align: justify;"><span style="font-family: Tahoma, 'sans-serif';">The complaints were received regarding the pollution, health issue & other issues caused in the farms of Village Perron & Raipur by the ash generated from M/s Talwandi Sabo Power Ltd., Village Banawali, Distt. Mansa. The Regional Office has intimated vide e-noting no. 19939530 that discussion was held with the farmers & the Sarpanch of the said village and contents of the complaint were found not to be genuine. Moreover, the Regional Office has submitted that the industry has installed continuous emission monitoring system on its stack and also air emission sampling was carried out by the Board on 01.09.2022 to 02.09.2022 and as per the analysis report, the conc. of particulate matter was found within the permissible limit.</span></p>
<p class="MsoNormal" style="margin-bottom: 6pt; text-align: justify;"><span style="font-family: Tahoma, 'sans-serif';">Another complaint was also received from the fly ash brick manufacturing association, wherein it has been alleged that the industry is not providing the fly ash to the brick manufacturing units. The Regional Office has reported that on pursuing the record of the fly ash generation and utilization in the year 2021-22, it was found that the industry has utilized 90.62% of its ash generated in the said year. </span></p>

Now, MoEf in supersession to its previous notification dated 14.09.1999, issued notification dated 31.12.2021 on ash utilisation from coal/lignite based thermal power plants, wherein every coal/lignite based thermal power plant has been directed as under:-</span></p>
<p class="MsoListParagraphCxSpLast" style="text-align: justify; text-indent: -0.25in;"><span style="font-family: Tahoma, 'sans-serif';"> a.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: Tahoma, 'sans-serif'; background: white;">Every coal or lignite based thermal power plant shall be responsible to utilize 100 per cent ash (fly ash and bottom ash) generated during that year, however, in no case shall utilisation fall below 80 per cent in any year, and the thermal power plant shall achieve average ash utilisation of 100 per cent in a three years cycle. Provided that the three years cycle applicable for the first time is extendable by one year for the thermal power plants where ash utilisation is in the range of 60-80 per cent, and two years where ash utilisation is below 60 per cent and for the purpose of calculation of percentage of ash utilisation, the percentage quantity of utilisation in the year 2021 - 2022 shall be taken into account as per the table below-</span></p>

<p class="MsoListParagraphCxSpLast" style="margin-bottom: 0.0001pt; text-align: justify; text-indent: -0.25in; line-height: 24px; background: white;"><span style="font-family: Tahoma, 'sans-serif';"> d)<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: Tahoma, 'sans-serif';">The industry is required to develop plantation in an area of 33% of its total land area as per the condition of environmental clearance, the industry has submitted a study conducted by the Central University of Punjab for the certification of green belt, wherein it has been reveals that for which the industry has developed 824.25 acres of land under green belt, which is 39% of the total land area. The visiting officer has repored that the industry has developed three rows of plants of broad leaves around its periphery for development of green buffer between coal handling plant and boundary wall towards the prominent wind direction.</span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 14.85pt; background: white;"><strong><span style="font-family: Tahoma, 'sans-serif';">6. <u>ASH DYKES</u></span></strong></p>
<p class="MsoNormal" style="text-align: justify; line-height: 14.85pt; background: white;"><span style="font-family: Tahoma, 'sans-serif';">The industry has provided 1 separate ash dykes within the industrial premises in total area of around 234 acres. The industry has stored 4014786 MT of the pond ash in the ash dykes as on 31.12.2022 as per the detail available on its website: tsplindia. co.in</span></p>
<p class="MsoNormal" style="margin-bottom: 6pt; text-align: justify; line-height: 14.85pt; background: white;"><strong><u><span style="font-family: Tahoma, 'sans-serif';">RECOMMENDATIONS:</span></u></strong></p>
<p class="MsoNormal" style="margin-bottom: 6pt; text-align: justify; line-height: 14.85pt; background: white;"><span style="font-family: Tahoma, 'sans-serif';">In view of the note dated 10.01.2023 & 16.01.2023 of the Regional Office and in view of the above, it is recommended that Consent to operate under the Water Act, 1974 and Air Act, 1981 may be granted to the industry for a period up to 31.03.2028 for operation of thermal power plant to produce Electricity @ 1980 MW (3X660 MW), subject to the following conditions:-</span></p>
<p class="MsoListParagraphCxSpFirst" style="margin: 0in 0in 6pt 22.5pt; text-align: justify; text-indent: -0.25in; line-height: 14.85pt; background: white;"><span style="font-family: Tahoma, 'sans-serif';">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: Tahoma, 'sans-serif';">The industry will ensure to comply with the notification of MoEF&CC issued vide no. S.O.5481(E) dated 31.12.2021 on ash utilisation from coal/lignite based thermal power plants.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin: 0in 0in 6pt 22.5pt; text-align: justify; text-indent: -0.25in; line-height: 14.85pt; background: white;"><span style="font-family: Tahoma, 'sans-serif';">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: Tahoma, 'sans-serif';">The industry will ensure to comply with the timelines as specified in the MoEF & CC notification no. GSR 682 (E) dated 05.09.2022 to achieve the revised emission norms.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin: 0in 0in 6pt 22.5pt; text-align: justify; text-indent: -0.25in; line-height: 14.85pt; background: white;"><span style="font-family: Tahoma, 'sans-serif';">3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: Tahoma, 'sans-serif';">The industry shall ensure that the sulphur content in the coal to be used in the boiler furnace shall not exceed 0.5% and shall submit the complete compositional analysis of the fuel once in six months every year.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin: 0in 0in 6pt 22.5pt; text-align: justify; text-indent: -0.25in; line-height: 14.85pt; background: white;"><span style="font-family: Tahoma, 'sans-serif';">4.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: Tahoma, 'sans-serif';">The industry will maintain / operate the online continuous effluent/emission monitoring system installed with the stack of the boilers and will further ensure the connectivity of the same with the server of CPCB / PPCB at all times.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin: 0in 0in 6pt 22.5pt; text-align: justify; text-indent: -0.25in; line-height: 14.85pt; background: white;"><span style="font-family: Tahoma, 'sans-serif';">5.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: Tahoma, 'sans-serif';">The industry shall operate / maintain the ambient air stations and shall maintain the record of the same.</span></p>

The bio-degradable waste shall be processed, treated and disposed of through composting or bio-methanation within the premises as far as possible. The residual waste shall be given to the waste collectors or agency as directed by the local body.</span></p>
