It is submitted that the industry is a rice sheller unit and was granted consent to operate under the Water Act, 1974 vide no. CTOW/Varied/SGR/2021/15235316 dated 25/03/2021, valid upto 30.09.2023 and under the Air Act, 1981 vide no. CTOA/Varied/SGR/2021/15235314 dated 25/03/2021, valid upto 30/09/2022, for manufacturing of  Sorted Raw Rice With Dryer @ 3.0 TPH by processing Paddy @ 4.0 TPH, as raw material under orange category.   <span lang="EN-US" style="font-size: 12.0pt; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Tahoma; color: black; background: white; mso-fareast-language: EN-IN; mso-bidi-language: PA;">Now, the industry has applied for renewal of consent to operate under the Water (Prevention and Control of Pollution) Act, 1974 and the Air Act, 1981, for production of Sorted Raw Rice with Dryer @ 3.0 TPH by processing Paddy @ 4.5 TPH<span lang="EN-US" style="font-size: 12.0pt; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Tahoma; color: black; background: white; mso-fareast-language: EN-IN; mso-bidi-language: PA;">, as raw material under orange category. <span lang="EN-US" style="font-size: 12.0pt; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Tahoma; color: black; background: white; mso-fareast-language: EN-IN; mso-bidi-language: PA;">                   The industry has also submitted stack emission sampling reports carried out by M/s Environment Pollution Analysis Lab, (NABL approved) on 08/01/2023 and as per the analysis report the concentration of SPMs was found to be 258.4 mg/Nm3 for shelling section and 246.2 mg/Nm3 for dryer section, which are within permissible limits as laid down by the Board.                            The consent fee already deposited in previous granted applications is adequate upto 30.09.2023, under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981. The industry has now deposited consent fee of Rs. 50,400/- through online vide R No. 583769742 dated 24/01/2023 on account of Water Act, 1974 and 50,400/- through online vide R No. 542129990 dated 24/01/2023 on account of Air Act, 1981, against the fixed assets of value i.e. Rs. 97.09 Lacs as on 31.03.2022 as per CA certificate date 23.01.2023. The aggregate fee is adequate upto 30.09.2032 under the both the Acts. The industry has submitted an undertaking regarding the increase in value of fixed assets from Rs. 96.84 Lacs to 97.09 Lacs, wherein, it is mentioned that it is due to repair of machinery already installed in its premises. Accordingly, the industry has deposited Rs. 700/- through online vide R. No. 542129990 dated 24/01/2023 as NOC regularization fee.                    The industry has deposited Rs. 1,400/- through online vide R No. 542129990 dated 24/01/2023 as penalty fee (25% of fee slab i.e. 5,600/-).                    The industry has also submitted compliance report of consent conditions earlier granted to it under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981. The industry has further submitted an undertaking that the consent to operate to my rice sheller unit be granted based on the undertaking submitted by me, therefore, in case during the visit to the industry in future, the entire contents of the undertaking or any part of this undertaking is found false, the Board shall be free to take action against the unit under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. The industry has also submitted undertaking regarding updation of APCD from time to time, in future when and required by PPCB or Punjab Govt. As per modified directions issued by CPCB u/s 18(1) (b) of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 regarding harmonization of classification of industrial sectors under red, orange, green, white categories vide its letter dated 07.03.2016 along with the "Final documents on revised classification of industrial sectors under red, orange, green & white categories" which also includes the consent period for which the consents are to be granted to red, orange & green category industries for five years, ten years & 15 years respectively. The Board vide its letter no. 9982-1003 dated 27.03.2018 has requested this office to strictly follow consent validity criteria as mentioned in the modified directions issued by CPCB u/s 18(1) (b) of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981. It is pertinent to mention here that the Board vide Office Order No. 59 dated 02.02.2016 decided to grant auto renewal of Consent to Operate/ Establish to Orange & Green Category of Industries within 7 days of its application submission without the need of visiting the site/ premises of the industry, in order to facilitate the industry. Further, it is intimated that there is no change in the underappreciated value of the fixed assets.  No complaint is pending against the industry. The industry was found complying with consent conditions during last visit and consents were granted thereafter.                   Keeping above in view, it is recommended that consent to operate granted under the Water Act, 1974 & under the Air Act, 1981 may both be renewed up to 30/09/2032 for manufacturing of Sorted Raw Rice with Dryer @ 3.0 TPH by processing Paddy @ 4.5 TPH, as raw material under orange category under orange category, subject to certain conditions to be mentioned therein.
