Sub:              Proceedings of the personal hearing given to the brick kiln before the Environmental Engineer, Regional Office, Bathinda on 16.01.2023 under the provisions of the Water Act, 1974 & Air Act, 1981 with notice for refusal of consents to operate under the said acts.   Following were present:   On behalf of the Board   Er. Ravi Pal, Assistant Environmental Engineer   On behalf of the brick kiln   Sh. Ramandeep, Proprietor   Assistant Environmental Engineer brought out that the brick kiln was granted consent to operate under the Air Act, 1981 vide nos. R14MKSCTOA917342 dt. 18.03.2014, with validity upto 30.06.2018, for operation of brick kiln with natural draft technology to manufacture bricks & tiles @ 25,000 nos./day, subject to the conditions mentioned therein. The brick kiln has applied for varied consent to operate under the Air Act, 1981 and fresh consent to operate under Water Act, 1974 after converting the brick kiln on zig-zag technology and has submitted all the requisite documents. The brick kiln was visited by the AEE of this office on 01.12.2022 and it was observed as under: <ol style="margin-top: 0in;" start="1" type="1"> <li class="MsoNormal" style="margin-bottom: 0.0001pt; text-align: justify; line-height: 24px;">The kiln was in operation during visit.</li> <li class="MsoNormal" style="margin-bottom: 0.0001pt; text-align: justify; line-height: 24px;">The kiln has converted its kiln to zig-zag technology as per design of CSIR- Central Building Research Institute, Roorkee. The CBRI, Roorkee has issued completion certificate dated 16.03.2020.</li> <li class="MsoNormal" style="margin-bottom: 0.0001pt; text-align: justify; line-height: 24px;">The brick kiln is using agro waste fuel i.e. Gauwra Crop in loose form for the firing purpose, which is unauthorized fuel as per Board’s office memorandum no. 397 dt. 22.1.2022.</li> </ol> The Board has not permitted the use of fuels other than crushed coal for burning purpose. Hence, the brick kiln is found violating of the provisions of the Air Act, 1981 by using unauthorized fuel and has failed to comply with the conditions of consent granted to it under the Air Act, 1981, thereby given personal hearing. During hearing, Sh. Ramandeep, proprietor of the brick kiln submitted a written reply in which it has been stated that they have closed the operation of brick kiln after the visit of AEE and have shifted the bio-mass fuel from the kiln site. He further assured in the written statement that they will not use the unauthorized fuel in their brick kiln in future. It has also been mentioned in the reply that they have planted more trees around the boundary of the brick kiln. The representative of the brick kiln further requested to grant Consent to operate of the Board under the provisions of the Water Act, 1974 and Air Act, 1981 to their brick kiln. After hearing the representative of the brick kiln and officer of the Board, the Environmental Engineer decided as under: 1.    Assistant Environmental Engineer, R.O Bathinda will revisit the brick kiln to verify the reply given by the representative during hearing and submit report/recommendations to decide the CTO applications lying pending with the Board. 2.    It has been made clear to the representative of the brick kiln that if  the BKO will found using any unauthorized fuel, CTO applications under the Water Act, 1974 and Air Act, 1981 will be refused without any further notice.   Draft of proceedings to be issued to the brick kiln is submitted for confirmation, please
