CTOW/Fresh/LDH3/2020/13773184 & CTOA/Fresh/LDH3/2020/13773142 dated 19.10.2020, both are valid upto 30.09.2021.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-indent: 85.05pt; line-height: 115%; background: white;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; background: white; mso-bidi-language: PA;">Thereafter, the rice sheller had applied for renewal of ‘Consents to Operate’ under the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-indent: 85.05pt; line-height: 115%; background: white;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; background: white; mso-bidi-language: PA;">The rice sheller was visited by AEE of this office 27.09.2022 and it was observed as that the rice sheller had installed dryer section and had not provided any APCD with paddy cleaner of dryer section. The </span><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;">rice sheller<span style="background: white;"> had provided Cyclone separator as APCD with shelling section, however, the same was not connected with dust emitting points. The </span>rice sheller<span style="background: white;"> had not paved its vehicular movement area. Brick on edge provided earlier had been removed and now present only in small area near dryer section. Entire movement area is unleveled and loose soil was lying in movement area. Plantation area around boundary wall had been occupied by wild grass growth.</span></span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-indent: 85.05pt; line-height: 115%; background: white;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; background: white; mso-bidi-language: PA;">Accordingly, </span><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman';">‘Consents to Operate’ under the Water Act, 1974 and the Air Act, 1981 applied by the rice sheller were refused on 29.09.2022. </span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-indent: 85.05pt; line-height: 115%; background: white;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman';">Thereafter, s</span><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;">how cause notice for violations the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 was issued to the rice sheller with an opportunity of personal hearing before Environmental Engineer, Regional Office-III, Ludhiana on 13.10.2022. <span style="background: white;">Meanwhile, the rice sheller had again applied for renewal of ‘Consents to Operate’ under the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981. </span>However, no one from the rice sheller attended hearing and not submitted any reply to the show cause notice issued to it. After hearing, officers of the Board, the Environmental Engineer, Regional Office-3, Ludhiana decided as under:-</span></p>

<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-indent: 85.05pt; line-height: 115%; background: white;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; background: white; mso-bidi-language: PA;">The report of the same was sent to Zonal Office-2, Ludhiana vide e-noting no. 20258375 and Notice u/s 31-A of the Air Act, 1981 has been issued to the industry with hearing before Chief Environmental Engineer, Ludhiana on 31.01.2023. </span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-indent: 85.05pt; line-height: 115%; background: white;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; background: white; mso-bidi-language: PA;">Now, the rice sheller has again applied for renewal of ‘Consents to Operate’ under the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981 for operation of rice sheller unit with dryer to manufacture Raw Rice with dryer & Sorted Rice @ 03 TPH.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-indent: 85.05pt; line-height: 115%; background: white;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; background: white; mso-bidi-language: PA;">The rice sheller has submitted C.A. certificate dated 25.08.2022 showing gross fixed assets value of Rs. 132.05 lacs, compliance of consent conditions & partnership deed. The rice sheller has already deposited Rs. 54,600/- each under the Water Act, 1974 & the Air Act, 1981 vide UTR. No. 221740081 & 737820518, both dated 31.08.2022, which is adequate up to 31.12.2028 under both acts. The rice sheller has uploaded photographs of cyclone separators provided as APCD with dryer section. The industry has not submitted any compliance of remaining observations. </span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 115%; background: white;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; background: white; mso-bidi-language: PA;">Keeping in view of the above, it is recommended that </span><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;">applications for obtaining renewal of Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981 may be decided in light of the decisions of the personal hearing dated 31.01.2023.</span></p> |
