<p>It is submitted that the agency was issued notice before refusal of consent to operate under the provisions of Water Act, 1974 and authorization under the Hazardous & Other Wastes (Management & Transboundary Movement) Rules 2016 alongwith an opportunity of personal hearing on 22.12.2022.</p>
<p>During hearing, it was decided that:-</p>
<p>1. The agency shall maintain on daily basis the record of readings of water meter installed on fresh water supply line, flow meters installed at the inlet & outlet of ETP, energy meter installed with ETP & chemicals being used for treatment of effluent.</p>
<p>2. Regional Office shall immediately visit the industry to verify the submissions made by the representative of the agency and thereafter submit report/recommendation in the matter to conclude the consent applications applied under the Water Act, 1974 & Air Act, 1981 alongwith authorization application under HOWM Rules, 2016, within 07 days.</p>
<p>3. During hearing, it has been made clear to the representative of the agency that in case of any violation(s) in future, further action as deemed fit shall be initiated under the provisions of the Water Act, 1974; the Air Act, 1981 and HOWM Rules, 2016 without any further notice/opportunity.</p>

<p>Further, the compliance w.r.t. hearing decisions was verified by Regional Office on 17.01.2023.</p>
<p>The industry is a small scale orange category unit engaged in servicing & washing of commercial vehicles. The agency is listed at code 2018 under - Automobile servicing, repairing and painting (excluding only fuel dispensing) having waste water generation less than 100 KLD. The agency has installed ETP based on batch treatment process for treatment of washing effluent generated with disposal onto land for plantation developed in an area of one kanal. The agency has maintained its ETP in operatable condition and also developed plantation area properly. The agency has provided flow meters at ETP and is maintaining record. The agency has provided proper hazardous waste storage room and has also applied obtaining authorization under HOWM Rules, 2016, which is being dealt separately. Hence, as per report submitted by RO, FDK the agency is complying with the provisions of the Water Act, 1974, the Air Act, 1981.</p>

<p>If approved, consents to operate under the Water Act, 1974 & the Air Act, 1981 may be granted to the agency upto 30.09.2025 with special conditions that:</p>
<p>1. The agency will get its effluent sample analyzed from Board's lab, within a month.</p>
<p>2. The agency shall comply with all the Environmental Rules as amended from time to time.</p>
<p>3. This consent to operate is issued from pollution angle and the agency shall obtain all the statutory clearances / permissions from other departments, as required.</p>

<p>Competency : CEE- as hearing was given to the industry before CEE.</p> |
