Ø  It is intimated that the industry was granted consent to operate under Water Act, 1974 and Air Act, 1981 vide no. CTOW/Fresh/MNS/2019/10911317 & CTOA/Fresh/MNS/2019/10911240 dated 06.09.2019 valid upto 30.09.2020 for the manufacture of Mill Board @ 2.5 MTD with the conditions that: 1.       The industry shall not procure and process any waste as prescribed in Schedule-IV appended to the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 till it gets the certificate of registration / passbook as recycler /re-processor from the Board. 2.       This consent to operate is valid only to facilitate the industry to obtain registration/passbook as recycler /re-processor from the Board as required under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016, which shall be obtained during the validity period of this consent. 3.       The consent to operate is not valid for procurement and processing of the hazardous waste of category 32.3 as specified in schedule-I of the Hazardous & Other Wastes (Management and Transboundary Movement), Rules, 2016. 4.       The industry shall apply for consent to operate as required under the provisions of Water Act, 1974 afresh after obtaining certificate of registration / passbook as recycler /re-processor from the Board. 5.       This consent to operate is issued from pollution angle only and the industry shall obtain the statutory clearances / permissions from the other Govt. departments, as required. 6.       The industry shall comply with all the conditions of the standard operating procedure formed by the Central Pollution Control Board for utilization of process sludge and primary sludge of ETP :- i. Collection Storage & Handling of Process and primary sludge of ETP of Pulp & Paper industry– •The dewatered primary ETP Sludge & Process Sludge shall be procured in trucks/ trolleys. ·      The unit shall store the primary ETP Sludge & Process Sludge in covered storage shed(s) within premises, so as to eliminate rain water intrusion. Further, the sheds shall have proper slope and spillage collection pit so as collect spillages/floor washings. The collected spillages/floor washings shall be channelized to Effluent Treatment Plant for their treatment/recycling. ·      Transportation of primary ETP Sludge & Process Sludge shall be carried out by sender or receiver (utilizer) after obtaining authorisation from the concerned SPCB under the Hazardous and Other Wastes (Management & Transboundary Movement) Rules, 2016 ·      It shall be ensured that primary ETP Sludge & Process Sludge is procured from the industries who have valid authorization for the same from the concerned SPCB as required under Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016. ii.    Use of secondary ETP sludge generated from Pulp & Paper Industry is not permitted. iii.  Handling/transfer of primary ETP Sludge & Process Sludge is required to be done using mechanized system (such as trolley, loader, etc.). iv.  The entire process area shall have boundary wall or fencing with proper slope, periphery drainage and collection pit followed by channelization to Effluent Treatment Plant for treatment. Sun drying of board shall be done within the premises. v.    The unit shall ensure that all personnel involved in the plant operation shall wear proper personal protective equipment such as masks, safety gloves, goggles, safety shoes etc. vi.  The effluent generated during the utilization process shall be recycled back to beater/pulper ensuring zero liquid discharge, else the treated wastewater generated shall meet wastewater discharge standards stipulated in the consent issued by concerned SPCB. vii. The monitoring of the effluent for the parameters specified in the Consent issued by the concerned SPCB shall be carried out quarterly through NABL/EPA accredited laboratory and report shall be submitted quarterly to the concerned the SPCB. viii.              The unit shall submit quarterly and annual information on quantity of ETP Sludge & Process sludge procured & utilized and its source, quantity of waste water generated, treated & recycled or resources conserved (specifying the details like type and quantity of resources conserved) to the concerned SPCB. ix.   The unit shall maintain a passbook issued by concerned SPCB wherein the following details of each procurement of Process sludge & Primary Sludge (of pulp & paper industry) shall be entered: Address of the sender • Date of dispatch • Quantity procured • Seal and signature of the sender • Date of receipt in the premises x.    The unit shall maintain record of Process sludge & Primary Sludge utilised, residues generated and disposed as per Form 3 & shall file annual returns in Form 4 as per Rule 20 (1) and (2) of the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016, to SPCB. xi.   A log book with information on source of procurement, quantity, date wise utilization of the same, quantity of products manufactured, hazardous waste generation and its disposal etc. shall be maintained including analysis report of emission monitoring & effluent discharged, as applicable. xii. In case of environmental damages arising due to improper handling of hazardous wastes including accidental spillage during generation, storage, processing, transportation and disposal, the unit shall be liable to implement immediate response measures, environmental site assessment and remediation of contaminated soil/groundwater/sediment etc. as per the “Guidelines on Implementing Liabilities for Environmental Damages due to Handling & Disposal of Hazardous Wastes and Penalty” published by CPCB. xiii.              During the process of utilization and handling of hazardous waste, the unit shall comply with the requirements in accordance with the Public Liability Insurance Act, 1991 as amended, wherever applicable.  Ø  The industry had again applied for renewal of CTO under the provisions of Water Act, 1974 and Air Act, 1981 for manufacturing of Card Board @ 2.5 TPD and was raised clarification on the online application to deposit additional fees as the fees of the industry was inadequate to process the application, which was refused vide no. CTOW/Renewal/MNS/2022/19993942 & CTOA/Renewal/MNS/2022/19993078 dated 31.10.2022 after affording an opportunity of personal hearing before CEE on 17.10.2022. Ø  Now, the industry has again applied for renewal of CTO under the provisions of Water Act, 1974 and Air Act, 1981 for manufacturing of Card Board @ 2.5 TPD. Ø  The site of the industry was visited on 21.01.2023 during visit to the area and it was observed that: 1.       The industry was not in operation during visit. 2.       The industry has installed ETP cum re-circulation system consisting of collection cum reaction tank, clarification tank, treated water holding tank and sludge handling beds etc. 3.       The industry has stored paper mill sludge as it has already obtained passbook for reprocessing of Hazardous Waste as per HoWM Rules, 2016, issued vide dated 26.02.2020 with validity upto 25.02.2025 (Copy Attached) 4.       The industry has provided pucca platform for the storage of paper mill sludge i.e. Hazardous Waste under the shed, which is leakage fee and well levelled. 5.       The industry has maintained the previous record regarding procurement and utilization of Hazardous Waste i.e. Paper mill sludge. (Copy of red book attached. 6.       The industry has provided fencing all around the premises of the industry. 7.       The industry has developed plantation area as per Karnal technology which is used for disposal of purge water being generated after few days from the ETP cum Re-circulation system provided by the industry. 8.       The industry has yet to apply for obtaining authorization for collection, storage or utilization of Hazardous Waste under HoWM Rules, 2016, which has been expired on 12.03.2020   From above, it is clear that the industry is complying with the conditions of consent to operate granted to it earlier as well as SoP framed by CPCB for utilization of Hazardous Waste.   Keeping in view of above, consents to operate under Water Act, 1974 & Air Act, 1981 may be granted to the industry for a period of six months with special condition that the industry will obtain authorization for collection, storage or utilization of Hazardous Waste under HoWM Rules, 2016.
