Earlier, the industry was granted 'consent to operate' under Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Varied/LDHKH/2020/13023255 dated 28/07/2020 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Varied/LDHKH/2020/13022661 dated 28/07/2020 both valid upto 30/09/2023 for manufacturing of Steel Ingot/Runner Riser @ 91 MTD under small scale category. </span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">Thereafter, the industry was granted 'consent to establish' (NOC expansion) under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Exp/LDHKH/2021/16150950 dated 12/08/2021 valid upto 11/08/2022 for the manufacturing of Steel Ingot @ 140 MTD.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">Now, the industry has applied for obtaining varied consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and under the Air (Prevention & Control of Pollution) Act, 1981 <span style="color: black;">with requisite documents through OCMMS under orange category. The industry has deposited consent fee</span> of Rs. 68,400/- vide e-R no. 181911396 dated 13/09/2021 as Water consent fee and Rs. 54000/- vide UTR no. N005232277001547 dated 05/01/2023 as Air consent fee against the un-depreciated fixed assets of Rs. 774.73 Lacs CA certificate as on 30/11/2022 & dated 21/12/2022, which is adequate<span style="color: red;"> </span><strong>upto</strong> <strong>30/09/2025</strong> as per Board's Office Order dated 29/10/2018 <span style="mso-bidi-font-weight: bold;">after deducting NOC extension charges of Rs. 5400/-.</span><span style="mso-spacerun: yes;"> </span></span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Arial;">The industry was visited by AEE alongwith ASO, Air Lab, Head Office, Patiala of this office on<strong> 19/01</strong><strong style="mso-bidi-font-weight: normal;">/2023</strong>. During the visit, it was observed as under:</span></p>

<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">The industry has already obtained EC under EIA notification 14.9.2006 vide no. SEIAA/MS/2021/3762 dated 07/04/2021 for expansion in the existing steal manufacturing unit by replacing 1 no. induction furnace (6TPH) having existing production capacity of 27300 TPA with 1 no. induction furnace (10 TPH) enhancing total production to 50,400 TPA at Vill. Alour, Bhada Road, Tehsil Khanna, Distt. Ludhiana.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma; mso-bidi-font-weight: bold;">It is pertinent to mention here that the Hon'ble National Green Tribunal while disposing of OA No.837 of 2018 titled as Sandeep Mittal Versus Ministry of Environment, Forests and Climate Change and others vide order dated 01.02.2021 has observed that Environment Impact Assessment is an essential component of the "Precautionary as well as the 'Sustainable Development' principles. Laying down conditions for EC based on appraisal is not enough unless compliance thereof is duly monitored and ensured with a view to achieve the said object. The Hon'ble NGT vide the said order dated 01.02.2021 had issued certain directions to Ministry of Environment, Forest & Climate Change and also directed that the Central Pollution Control Board and the State Pollution Control Boards may take measures to conduct monitoring of EC conditions.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma; mso-bidi-font-weight: bold;">Accordingly, Point wise compliance of Environmental Clearance condition alongwith comments of this office has been attached herewith. However, the industry is yet to comply with following conditions.</span></p>

For this, a pond at village Bullepur, Tehsil Khanna, Distt. Ludhiana, Punjab having recharge potential of volume @ 12,296 m3 shall be adopted to recharge the water @ 24,444 m3/annum. As an additional safety measure, the stream carrying waste water of the village shall be diverted in one corner of Phytorid plants trench (designed based on the technology developed by CSIR-NEERI's) divided into different parts, the overflow of each chamber shall be allowed to enter into another chamber which will ultimately lead to the purification of water and collected into the pond to avoid any contamination of ground water aquifer. Pond water will percolate through natural strata (without injection) to augment the ground water and remaining water shall be used for irrigation purposes by pumping method in the nearby fields. </span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 27.0pt; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -27.0pt;"><strong style="mso-bidi-font-weight: normal;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;"><span style="mso-tab-count: 1;"> </span>Reply- Not complying, the industry has submitted that the gram panchayat of Vill. Bulepur refused to get the recharged water in their pond. Now, they have taken NOC from Gram Panchayat of Vill. Ucha Bhadla. They undertake that they will practice Rain Water Harvesting to the maximum possible extent for pond at Village Ucha Bhadla.</span></strong></p>

Total 418 trees to be planted without accounting the shrubs. Out of 418, 150 trees have already been planted like Amaltas, Arjun, Jamun, Mulberry, Mango, Amla, Poplar and the balance 268 more trees species of Jamun, Arjun, Ashoka, Sagwan will be planted in coming monsoon season.</span></p>
<p class="MsoListParagraphCxSpLast" style="margin-left: 27.0pt; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -27.0pt;"><strong style="mso-bidi-font-weight: normal;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma; color: red;"><span style="mso-tab-count: 1;"> </span></span></strong><strong style="mso-bidi-font-weight: normal;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">Reply- The industry has only developed green area in an area 235.23 sqm. out of required<span style="color: red;"> </span>2788.10 Sqm. Due to non availability of vacant land, it has purchased new land having area 6 Kanal 11.66 Marla in year 2021 for developing green area. The industry has yet to obtain amended Environmental Clearance by making addition of newly purchased land.</span></strong></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma; mso-bidi-font-weight: bold;">Moreover, the Board vide Head Office letter no. 768-97 dated 13/01/2021, decided as under:</span></p>
<p class="MsoBodyText" style="text-align: justify; text-justify: inter-ideograph; line-height: 115%; margin: .15pt 4.5pt 12.0pt 9.0pt;"><strong><span lang="EN-US">"The Board shall continue to grant consent to establish/consent to operate to the industries with the advisory to obtain necessary clearance for abstraction of ground water from the Punjab Water Regulation and Development Authority (PWRDA). However, aforesaid clearance shall not be insisted upon by the Board at the time of grant of CTE/CTO to the industries."</span></strong></p>
<p class="MsoBodyTextIndent" style="margin-left: -.85pt; text-align: justify; text-justify: inter-ideograph; text-indent: 72.85pt;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma; mso-bidi-font-weight: bold;">In view of the above, it is recommended that the industry may be granted </span><strong style="mso-bidi-font-weight: normal;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">short term </span></strong><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma; mso-bidi-font-weight: bold;">'consent to operate' under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for six months with suitable conditions and additional conditions that:</span></p>

<p class="MsoListParagraphCxSpMiddle" style="margin-left: 27.0pt; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -27.0pt; mso-list: l1 level1 lfo3;"><!-- [if !supportLists]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">5.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma; color: #222222; mso-fareast-language: EN-IN;">The industry shall promote use of alternatives of single use plastics (SUP) and awareness to discourage use of plastic, through their Corporate Environment Responsibility (CER) activities.</span></p>
