Subject: - Proceedings of the personal hearing given to M/s Shree Balaji Cement Industries, Village Jai Singh Wala, Baghapurana, Distt. Moga before refusal of 'consents to operate' under the provisions of Water Act, 1974 & Air Act, 1981 by the Senior Environmental Engineer on 30.01.2023. The following were present: From Board's side: Er. Ruby Sidhu, EE, ZO, Bathinda Er. Ravideep Singla, AEE, ZO, Bathinda From industry side: Sh. Pardeep Kumar, Partner Sh. Ram Gupta, Representative It was brought out that the industry is cement grinding unit and was granted consents to operate under the Water Act, 1974 & Air Act, 1981 on 21.09.2015 (valid upto 30.06.2018) further extended upto 30.06.2023 for manufacturing of cement @ 150 TPD with operation of single ball mill.                         The industry was granted consent to establish (NOC) for expansion under the provisions of Water Act, 1974 & Air Act, 1981 on 06.12.2021 (valid upto 05.11.2022) for installation of two ball mills of capacity 75 TPD each (by dismantling existing one ball mill of capacity 150 TPD).                The industry has now applied for obtaining varied consents to operate under the Water Act, 1974 and the Air Act, 1981 for manufacturing of Cement @ 150 TPD by operating two ball mills of capacity 75 TPD each.            From the perusal of the documents submitted by the industry, it has been observed as under:- 1. At the time of obtaining 'consent to establish'(NOC) for expansion, total cost of project was mentioned below Rs. 2.50 crore, whereas now it has been shown as Rs. 4.95 crore. 2.  Building plan after construction of additional building and installation of machinery is not submitted. 3.    The industry has failed to attach the machinery bills from where the individual capacity of the ball mill(s) can be ascertained. Also, the completion certificate attached with the application does not specify the capacity of the ball mill(s) installed by the industry. 4.    The industry has not submitted compliance of 'consent to establish' (NOC) conditions and has also not submitted analysis report of the air emission sample, if any.            The industry was issued show cause notice before refusal of renewal of consents to operate granted under the provision of Water Act, 1974 & Air Act, 1981 with an opportunity of personal hearing before the Senior Environmental Engineer on 16.01.2023, which was postponed due to administrative reasons.                 In view of above, the industry has been afforded another opportunity of personal hearing on 30.01.2023.            Further, the industry has submitted written reply through online regarding show cause notice issued to the industry. The submissions made by the industry were verified by the Regional Office during visit to the industry on 20.01.2023 and submitted that:- 1.     The industry has installed classifier separately with each of the ball mill. Each classifier is now separately provided with twin cyclone followed by bag filter house containing 54 bags. Each ball mill is now separately provided with bag filter house containing 96 bags.  Moreover, final product filling area is also attached with this bag filter. 2.   The industry has now installed separate bag filter house containing 36 bags each to contain fine emission generated from raw material handling area and conveyor system. The final product filling area of each ball mill has been attached with bag filter house having 96 bags as mentioned in point no. 1. 3.     <span style="font-size: 10pt; line-height: 20px; font-family: Tahoma, 'sans-serif'; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">The industry has developed approx. 11,000 sq feet under green belt and around 3500 sq feet has been reserved for plantation, which is not being utilized for industrial purpose. 4.     <span style="font-size: 10pt; line-height: 20px; font-family: Tahoma, 'sans-serif'; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">Presently, no complaint is pending in this office against the industry.  It is pertinent to mention here that a complaint was received from the Govt. in year 2021. The reply to which mentioning rectifications done by the industry against contentions of the complaint, was submitted to the Govt. vide Board's letter no. 25862 dated 02.12.2021.                         During hearing, the representative of the industry submitted a written reply of the show cause notice issued to it, which has been taken on record. The representative of the industry submitted copy of demand draft submitted to Regional Office for air sampling, amended bills mentioning capacity of ball mills dated 25.04.2022 & 06.05.2022, building plan approved from competent person authorized by Director of Factories, compliance report w.r.t. NOC conditions imposed, amended C.A. certificate dated 14.01.2023 mentioning the value of machinery as 3.59 Cr and the industry has submitted invoice no. ST/TI/2022-23/09 dated 26.04.2022 & ST/TI/2022-23/10 dated 06.05.2022 mentioning the capacity of cement ball mills procured by the industry as 75 TPD each. The industry further stated that green belt in an area of 11138 sq.ft. has already been developed and that 3267 sq.ft. of additional green belt will be developed during upcoming monsoon season. After hearing the representatives of the industry as well as officer of the Board, it has been decided that :- 1.  The industry shall ensure the operation of the APCD effectively to achieve the standards as per norms. 2.  The industry be granted the consents to operate under the Water Act, 1974 & Air Act, 1981 with validity upto 30.06.2027. 3.     Environmental Engineer, Regional Office, Faridkot to visit the industry, carry out air emission sampling / check the compliance of CTOs conditions and submit report in the matter as per the protocol of the Board to visit such industries.   4.   It was made clear to the representative of the industry that in case of non-compliance of decision of the hearing, further action as deemed fit will be initiated under the provisions of the Water Act, 1974 & the Air Act, 1981.      Submitted for confirmation of proceedings of the hearing dated 30.01.2023 please.
