It is submitted that the subject cited unit was earlier granted consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/RPN/2020/13895593 dated 22/10/2020 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/RPN/2020/13895479 dated 22/10/2020, both were valid upto 30/09/2024 for operation of Stone crusher of capacity @ 70 MTD subject to the suitable conditions mentioned therein.   Thereafter, the Consent to Operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act 1981 was revoked/cancelled vide no. 1010 dated 26.04.2022 due to the non-submission of the mining certificate as per the decision no. 02 of the personal hearing held on 31.08.2021 in light of the instructions issued by the Board vide letter no. 16536 dated 23.07.2021 for processing the CTE/CTO applications for stone crushers/screening/washing plants. Now, the unit has applied for obtaining fresh 'consent to operate' under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 alongwith compliance of previous consent, undertaking regarding code of practice & legal mining, mining slips and consent fee. Further, the unit has submitted the slips of obtaining raw material from HP, verified by O/o Executive Engineer-cum-District Mining, Drainage cum Mining Division, Sri Anandpur Sahib dated 04.01.2023 regarding obtaining raw material from Himachal Pradesh through check post Lohand. The industry has submitted CA certificate dated 02.12.2022, wherein, the value of fixed assets of the industry as on 31.03.2022 is of Rs. 67.18 lakhs with value of plant & machinery is Rs. 63.44 lakhs. As per the record file earlier, the fee deposited by the unit was adequate upto 30.07.2025 under the both Acts. Now, the unit has deposited additional fee amounting to Rs. 18,000/- vide UTR. No. N339222234097345 dated 05.12.2022 under the Water Act, 1974 and Rs. 18,000/- vide R. No. N339222234092779 dated 05.12.2022 under the Air Act, 1981. As such, the fee deposited by the unit is adequate upto 30.09.2029 under the both Acts after adjusting penalty @ 50% as per circular dated 29.10.2018. It is added here the unit has not submitted ambient air analysis report from NABL/Board's approved laboratory. <p class="MsoListParagraphCxSpFirst" style="margin: 0cm; margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: 72.0pt; line-height: 150%; mso-pagination: none; mso-layout-grid-align: none; punctuation-wrap: simple; text-autospace: none;">Further, the unit was visited by the AEE of this office 30.01.2023 and Sh. Labh Singh, Site Incharge was contacted. From above, it is clear that the unit is not complying with the code of practice prescribed for such kind of unit and is also operating screening and washing plant without obtaining requisite NOC/CTE and thereby violating the provisions of the Water Act, 1974 and the Air Act, 1981. In view of above, it is recommended that action u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 and u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 shall be initiated for closure/disconnection of electric connection of the unit after affording an opportunity of personal hearing.
