It is intimated that the industry is a small scale green category unit.           Earlier, a complaint against the industry was received from local residents regarding pollution caused by the industry. To verify the contents of complaint, the industry was visited by officer of this office on 31.08.2021 and it was observed that:-   <ol style="margin-top: 0in;" start="1" type="1"> <li class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; mso-list: l4 level1 lfo2;">The industry was in operation and engaged in washing, Drying & Pressing of Garments/Fabrics.</li> <li class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; mso-list: l4 level1 lfo2;">The industry has installed 02 no. washing machines of capacity 50 Kg each, 01 no. washing machine of capacity 25 KG, 03 nos. hydro extractors, 03 nos. tumblers, 01 no. wood fired baby boiler and 01 no. D.G set of capacity 35 KVA. </li> <li class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; mso-list: l4 level1 lfo2;">The industry has not installed Effluent Treatment Plant for treatment of waste water generated from various processes. The untreated effluent was being discharge into open drain, which further leads to pond.</li> <li class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; mso-list: l4 level1 lfo2;">The industry has not obtained Consent to establish/Consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981.</li> </ol>                         Due to above violations, vide this office letter no. 2425 dated 08.09.2021, show cause notice for violation of the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act 1981 was issued to the industry with  request to submit reply in writing within 15 days, as to why the proposed action should not be taken against the industry. But the industry has neither applied for consents of the Board nor submitted any reply to show cause notice issued to it.   In reply, the industry had submitted as under:- 1.            That the industry engaged in washing, drying & pressing of garments/cloths. 2.    That the industry installed 02 nos. washing machines of 50 kg each, 1 no. of 25 kg, 3 nos. hydro extractors, 3 nos. tumblers, 1 no. of wood fired baby boiler and 01 D.G set equipped with canopy with adequate stack. The industry is not doing any kind of dyeing. 3.    That the industry will install ETP to treat the effluent which will be installed with in 40-50 days. The industry has given order to install the ETP. 4.            That the industry will apply for consent to operate after installation of ETP. 5.            That the industry has not received Regional office letter no. 2425 dated 8.9.2021.      The industry requested some time to apply for CTO and installation of ETP to treat the effluent. <p style="text-align: justify; background: white; font-variant-ligatures: normal; font-variant-caps: normal; orphans: 2; widows: 2; -webkit-text-stroke-width: 0px; text-decoration-thickness: initial; text-decoration-style: initial; text-decoration-color: initial; word-spacing: 0px; margin: 0in 0in 8.0pt 0in;">          In order to verify the contentions made by the industry, the industry was again visited by officer of the Board on 31.3.2022 and it was observed that the status of the industry is same as observed during the last visit dated 31.8.2021. Further, the industry has neither installed ETP to treat the effluent generated from process nor applied for consents to operate under the Water Act, 1974 and the Air Act, 1981. Accordingly, the industry was issued show cause notice for violation of the provisions of Water Act, 1974 & Air Act, 1981 with hearing before Senior Environmental Engineer, Zonal office-1, Ludhiana on 09.05.2022. <p style="text-align: justify; background: white; font-variant-ligatures: normal; font-variant-caps: normal; orphans: 2; widows: 2; -webkit-text-stroke-width: 0px; text-decoration-thickness: initial; text-decoration-style: initial; text-decoration-color: initial; word-spacing: 0px; margin: 0in 0in 8.0pt 0in;">            Sh. Rakesh Khullar, Partner of the industry attended the hearing and submitted the written reply which was taken on record. He stated that they are operating a tiny unit under name & style of M/s New way Dyers & Dry Cleaners, Samrala instead of Sunlight Dry Cleaning & Laundry and engaged in washing, drying &pressing of garments/cloths. They have installed 2 no. washing machines of 50 kg each, 1 no. of 25 kg, 3 no. hydro extractors, 3 no. tumblers, 1 no. of wood fired baby boiler & 1 no. D. G. Set equipped with canopy with adequate stack. The industry is not doing any kind of dyeing. They will install ETP to treat the effluent within 10-15 days and has given order to company to install the ETP. He further requested some time to apply for consent to operate & for installation of ETP to treat the effluent. <p style="text-align: justify; background: white; font-variant-ligatures: normal; font-variant-caps: normal; orphans: 2; widows: 2; -webkit-text-stroke-width: 0px; text-decoration-thickness: initial; text-decoration-style: initial; text-decoration-color: initial; word-spacing: 0px; margin: 0in 0in 8.0pt 0in;">After hearing the industry, officer of the Board and considering material facts on record, the Senior Environmental Engineer of the Board decided that:- 1.    The industry shall install effluent treatment plant for treatment of effluent generated from washing process, within 15 days. 2.    The industry shall not operate the water polluting process without prior permission of the Board till it installs effluent treatment plant for treatment of effluent. 3.    The industry shall apply for obtaining Consent to operate under the Water Act, 1974 and Air Act, 1981 alongwith requisite documents and fee within 15 days. 4.    Environmental Engineer, Regional Office-2, Ludhiana shall verify the contentions of the industry after 15 days and submit the report alongwith recommendations in the matter. Meanwhile, the complainant vide letter dated 29.08.2022 had submitted that the complaint was filed by him against the industry due to misunderstanding and now the misunderstanding has been solved and the applicant does not want to peruse the said complaint and want to withdraw the same. <p style="text-align: justify; background: white; font-variant-ligatures: normal; font-variant-caps: normal; orphans: 2; widows: 2; -webkit-text-stroke-width: 0px; text-decoration-thickness: initial; text-decoration-style: initial; text-decoration-color: initial; word-spacing: 0px; margin: 0in 0in 8.0pt 0in;">Though the complainant wanted to withdraw its complaint, but the industry was in operation in violation of the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, intentionally and deliberately. Further, the industry had failed to submit the compliance report of the decisions of personal hearing dated 09.05.2022 and has failed to apply for ‘consent to operate’ of the Board. <p style="text-align: justify; background: white; font-variant-ligatures: normal; font-variant-caps: normal; orphans: 2; widows: 2; -webkit-text-stroke-width: 0px; text-decoration-thickness: initial; text-decoration-style: initial; text-decoration-color: initial; word-spacing: 0px; margin: 0in 0in 8.0pt 0in;">Accordinlgy, directions u/s 33-A of Water (Prevention & Control of Pollution) Act, 1974 and 31-A of Air (Prevention & Control of Pollution) Act, 1981 were issued against the industry for its closure and PSPCL authorities may be directed to disconnect electric supply of the industry vide letter no. 4845-46 dated 21.10.2022.           Now, the industry has applied for fresh consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 through OCMMS.           The industry has deposited Rs. 12145/- vide UTR No. AXIC223252506306 dated 21.11.2022 (Rs. 11420/- water & Rs. 700/- as NOC regularization fees) Rs. 11420/- vide UTR No. AXIC223252505839 dated 21.11.2022 (Air), which is adequate upto 31.12.2027 against the fixed assets of Rs. 3.62/- Lacs under VDS scheme.           The industry has also submitted the DTP certificate issued by the DTP, Ludhiana vide letter no. 2653 dated 29.11.2022 which stating that the site falls in residential zone as Master Plan, Samrala (2012-31) and the industry “dyers and dry cleaners” is permitted to operate at the site. The industry has submitted approved building plan from architect approved by Director of Factories, Punjab. The industry has applied for consent to operate under green category as the effluent from the industry shall be less than 2 KLD (1.8 KLD).           The site of the industry was visited by AEE of this office on 30.01.2023 and it was observed that :- <ol style="margin-top: 0in;" start="1" type="1"> <li class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; mso-list: l1 level1 lfo1;">The industry was not in operation during the visit. The industry has been disconnected by PSPCL vide TDCO no. 337044 dated 01.12.2022          </li> <li class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; mso-list: l1 level1 lfo1;">The industry is basically engaged in washing, drying & pressing of garments/cloths.</li> <li class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; mso-list: l1 level1 lfo1;">That the industry installed 02 nos. washing machines of 50 kg each, 1 no. of 25 kg, 3 nos. hydro extractors, 3 nos. tumblers, 1 no. of wood fired baby boiler and 01 D.G set equipped with canopy with adequate stack. The industry is not doing any kind of dyeing.</li> <li class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; mso-list: l1 level1 lfo1;">That the industry has installed a new ETP to treat the effluent generated from the process. The ETP consists of collection tank, clarifier, tube settler, pre filtration tank, dual media filter, treated water, water line, sludge line. The industry has submitted detailed feasibility report as well as completion report of the ETP. The industry has also provided water meter on the outlet of ETP.</li> <li class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; mso-list: l1 level1 lfo1;">The industry has submitted it will re-circulate the treated effluent after treatment through ETP in the washing process as the process is crude in nature and the treated water can be reused in the process.</li> <li class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; mso-list: l1 level1 lfo1;">The industry has installed one no. Wood fired baby boiler with stack of adequate height.</li> <li class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; mso-list: l1 level1 lfo1;">The industry has installed one D.G set of capacity 15 KVA with canopy and adequate stack height.</li> </ol> In view of above, it is recommended that :-                      I.        Consent to operate under Water Act, 1974 & air Act, 1981 may be granted to the industry for six months with special condition that :- a.    The industry shall re-circulate the entire treated effluent after ETP. b.    The industry shall maintain proper records regarding operation of ETP and shall submit copies of the same to Regional Office every month.                    II.        Directions u/s 33-A of the Water Act, 1974 and u/s 31-A of the Air Act, 1981 issued for restoration of electric supply to the industry temporarily for six months.
