<p class="MsoNormal" style="text-align: justify; text-indent: .5in; line-height: 115%;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style',serif;">It is submitted that the industry is a small scale red category industry and has been granted Consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Fresh/LDH4/2021/16217543 dated 29.07.2021 is valid upto 30.09.2025 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Fresh/LDH4/2021/16216363 dated 29.07.2021 is valid upto 30.09.2025.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: .5in; line-height: 115%;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style',serif;">Now, the industry has applied varied consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and under the Air (Prevention & Control of Pollution) Act, 1981 through OCMMS. The industry has deposited Rs. 28470/- vide UTR no. AXIC230061398602 dated 06.01.2023 under Water Act 1974 including NOC regularization Fees, which is adequate upto 01.12.2029 and Rs. 22570/- vide UTR no. <span style="color: black; mso-themecolor: text1;">AXIC230061397330 dated 06.01.2023 under the Air Act, 1981 which is adequate upto </span>01.11.2027 against gross value of fixed assets Rs. 73,89,081/- and plant & machinery Rs. 12,52,558/- as on 31.12.2022.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: .5in; line-height: 115%;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style',serif;">Earlier the industry was visited by the officer of this office on 14.11.2022 regarding identification of the chemicals used by the industry in its process of acid pickling as the industry has made an agreement with JBR Technologies Ltd. Unit-II, vill. Mangarh, Machhiwara Road, Kohara, Ludhiana for lifting of its trade effluent @ 5000 ltr/month. Accordingly, the effluent sample was collected from the acid pickling process of the industry and sent to Zonal Laboratory for qualitative analysis. As per the results of analysis report received in this office, the industry has been using both HCL and H2SO4 in the acid pickling tank. The industry was found violating the provisions of Water (Prevention & Control of Pollution) Act, 1974 as it is lifting HCL to the re-processor facility and e-noting of the industry was processed vide e-note no. 20546036 dated 01.12.2022 and action on e-noting is lying pending with the Board. </span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: .5in; line-height: 115%;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style',serif;">Meanwhile the industry has applied for varied consent by using both HCL and H2So4 and industry has done agreement with M/s Charanjeet and Company Technology LLP, VPO Paddi, Ludhiana dated 01.06.2021 for the lifting of H2So4 and with M/s JBR Technologies Pvt. Ltd, Ludhiana dated 22.11.2022 for lifting of HCL. </span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: .5in; line-height: 115%;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style',serif;">To verify the facts, the industry was visited by the undersigned on 23<span style="color: black; mso-themecolor: text1;">.01.2023 </span>and it was observed as under:-</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: .5in; line-height: 115%;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style',serif;">1. The industry was in operation during the visit and is engaged in wire drawing. </span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: .5in; line-height: 115%;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style',serif;">2. The industry has provided 2 no. tanks one for H2So4 and other for HCL and has provided two no. separate water meter for both the processes. The industry was earlier having agreement with M/s JBR Technologies Ltd. Unit-II, vill. Mangarh, Machhiwara Road, Kohara, Ludhiana @ 5000 Ltr/month and with M/s Charanjeet & Co. Technology LLP, VPO Paddi, Ludhiana @ 10,000 Ltr/month. </span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: .5in; line-height: 115%;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style',serif;">Now, the industry has cancelled its agreement with M/s JBR Technologies Ltd. Unit-II, Vill. Mangarh, Machhiwara Road, Kohara, Ludhiana and has entered into agreement with M/s JBR Technologies Pvt. Ltd, CETP, 260-61, Phase-8, Focal Point, Ludhiana @ 10,000Ltr/month dated 22.11.2022 for lifting of HCL. Further, the industry has made agreement with M/s Charanjeet & Co. Technology LLP, VPO Paddi, Ludhiana @ 10,000 Ltr/month dated 01.06.2021 for lifting of H2So4. </span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: .5in; line-height: 115%;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style',serif;">3. The industry is maintaining the record of total water consumption viz-a-viz effluent lifted in the process for both HCL and H2So4. The industry has continued its old water meter for HCL purpose and the reading for water meter installed for HCL was noted as 219.64 KL. Further, the industry has installed new water meter for H2So4 and reading noted was 4.54 KL and for this the industry has started maintaining its separate record. <span style="mso-spacerun: yes;"> </span><span style="mso-spacerun: yes;"> </span></span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: .5in; line-height: 115%;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style',serif;">4. The industry is discharging only domestic effluent into sewer. </span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: .5in; line-height: 115%;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style',serif;">Further, it was decided in the hearing before Hon'ble Chairman of the Board on 16.07.2021 that:-</span></p>
<p class="MsoListParagraphCxSpFirst" style="margin-left: .75in; mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 115%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style',serif; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">1)<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style',serif;">CETP Operator shall ensure that no new/revised agreements are made without CTE/CTO of the Board. Ludhiana Effluent Treatment Society (LETS) shall issue letter of intent to the new members/existing members which seek revision in agreements clearly delineating the balance capacity available with the CETP which will form the basis for issuance of CTE/CTO to the electroplating/surface coating units by the Board.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: .75in; mso-add-space: auto; text-align: justify; line-height: 115%;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style',serif;"> </span></p>
<p class="MsoListParagraphCxSpLast" style="margin-left: 0in; mso-add-space: auto; text-align: justify; text-indent: .5in; line-height: 115%;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style',serif;">Hence, it is not clear that whether new agreements with CETP, Phase-8, will be allowed or not. </span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: .5in; line-height: 115%;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style',serif;">In view of above, it is recommended that the application of the industry may be correlated with the earlier e-noting no. 20546036 dated 01.12.2022 as action on e-noting is pending and now the industry is using both HCL and H2So4 in its process. <span style="mso-spacerun: yes;"> </span></span></p>
