CTOW/Renewal/RPN/2020/12673949 dated 08/08/2020 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/RPN/2020/12673935 dated 08/08/2020, both were valid upto 30/09/2025 for operation of screening & washing of aggregates only @ 11,000 CFT/Day subject to the suitable conditions mentioned therein in the name of Sh. Chajju Khan, Partner.</span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: 72.0pt; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">Thereafter, the Consent to Operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act 1981 was revoked/cancelled vide no. 1114 dated 27.04.2022 due to the non-submission of the mining certificate as per the decision no. 02 of the personal hearing held on 31.08.2021 in light of the instructions issued by the Board vide letter no. 16536 dated 23.07.2021 for processing the CTE/CTO applications for stone crushers/screening/washing plants.</span></p>
<p class="MsoListParagraph" style="mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: 72.0pt; line-height: 150%; mso-pagination: none; mso-layout-grid-align: none; punctuation-wrap: simple; text-autospace: none; margin: 12.0pt 6.0pt 10.0pt 4.5pt;"><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma; mso-bidi-font-weight: bold;">Now, the unit has applied for fresh consent to operate due to change of ownership under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 </span><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">for operation of screening & washing aggregates only @ 11,000 CFT/Day in the name of Sh. Surinder Kumar, Partner </span><span style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: Georgia; mso-bidi-font-family: Georgia; mso-font-width: 110%;">(with change of proprietor ship documents i.e. Ikrarnama, Authority letter and Partnership Deed) </span><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma; mso-bidi-font-weight: bold;">along with compliance of previous consent, undertaking regarding code of practice and legal mining</span><span style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: Georgia; mso-bidi-font-family: Georgia; mso-font-width: 110%; mso-bidi-language: AR-SA;">. </span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: 72.0pt; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">The unit has attached ownership documents such as Sale Deed (Ikrarnama) executed on 06.01.2023 between Sh. Chajju Khan and Sh. Gurtej Singh, wherein, it has mentioned that the plant has sold to Sh. Gurtej Singh. Further, the unit has attached another Sale Deed (Ikrarnama) executed on 07.01.2023 between Sh. Gurtej Singh and Sh. Surinder Kumar, according to which Sh. Surinder Kumar is the new owner of the unit. The unit has attached Ikrarnama-cum-Partnership Deed executed on 09.01.2023 between Sh. Harjot Singh and Sh. Surinder Kumar, from which it is clear that Sh. Harjot Singh and Sh. Surinder Kumar are the current partners of the unit.</span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: 72.0pt; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">The industry has submitted the CA certificate dated 11.01.2023, wherein, the value of fixed assets of the unit as on 31.12.2022 is of Rs. 31.02 Lakhs with the value of plant and machinery of Rs. 18.92 lakhs. As per the record file, the fee was adequate upto 30.09.2025 under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981. After deducting 50% penalty as late application fee, the fee is now adequate upto 31.03.2025 under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 as per circular dated 29.10.2018.</span></p>
<p class="MsoNormal" style="margin-bottom: 12.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: 76.5pt; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-weight: bold;"> It is pertinent to mention here that the unit has not submitted the slips of obtaining raw material from the O/o Executive Engineer-cum-District Mining, Drainage cum Mining Division, Rupnagar regarding obtaining raw material due to the non-operation of the unit from a long period and as per the undertaking attached, the unit shall get itself registered with the Deptt. of Mining after obtaining consent to operate under the Water Act, 1974 and the Air Act, 1981.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 78.0pt; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-weight: bold;">Further, the unit was visited by the AEE on 31.01.2023 and Sh. Bhim Sain, representative was contacted. During visit, it was observed as under:</span></p>

<p class="MsoListParagraphCxSpLast" style="margin-left: 0cm; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: 72.0pt; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-weight: bold;">As such, it is clear that the unit is partially complying with the code of practice stipulated for such units and the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981.</span></p>
<p class="MsoNormal" style="margin-bottom: 12.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: 70.9pt; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">In view of the above facts, if approved, it is recommended that consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 may be granted for a short period</span><span style="font-family: 'Bookman Old Style','serif'; mso-font-width: 110%;"> </span><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">upto 30.09.2023, subject to the suitable conditions and additional conditions as under:</span></p>
