It is submitted that the Asstt. Environmental Engineer of the Board brought that the industry had obtained ‘Consent to Establish’ (NOC) of the Board under Water Act, 1974 and Air Act, 1981 for establishment of unit vide no. Patiala/NOC/97-98/205 dated 29.07.1997. The industry applied for obtaining Consents to Operate for operation of cold store on 05.12.2022, which was returned due to incomplete documents/details. Now, the industry has again applied for obtaining Consents to Operate under Water Act, 1974 and Air Act, 1981 for operation of cold store @ 4500 MT/year under green category. The industry was visited by the officers of the Board on 09.01.2023 and it was observed as under: <span lang="EN-US" style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma',sans-serif; mso-fareast-font-family: Tahoma; color: black; mso-themecolor: text1; mso-fareast-language: EN-IN; mso-bidi-font-weight: bold;">1.    The cold storage unit has 2 sheds for cold storage purpose & no items were stored in these sheds. <span lang="EN-US" style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma',sans-serif; mso-fareast-font-family: Tahoma; color: black; mso-themecolor: text1; mso-fareast-language: EN-IN; mso-bidi-font-weight: bold;">2.    The civil work was under progress for construction of another shed within premises of the cold storage unit. 3.    The representative informed that the industry intends to expand its capacity i.e. the cold storage is carrying out expansion activities without obtaining ‘Consent to Establish’ (NOC) from the Board. As such, the cold storage unit was issued show cause for refusal of Consent to Operate under the Water Act, 1974 and Air Act, 1981 made Boards letter no. 67 dated 20.01.2023 with an opportunity of personal hearing on 31.01.2023.                    Sh. Bhushan Singla, Partner of the industry attended the hearing and submitted as under: 1.    The cold storage unit is operating since January, 1998. Copies of electricity bill & release of connection is attached in the application. He further informed that no record regarding obtaining of Consent to Operate under Water Act, 1974 and Air Act, 1981 is available with him. 2.    The cold storage unit is presently operating within same land, with same building & production capacity/machinery for which it was granted ‘Consent to Establish’ by the Board & has not carried/completed expansion of its activities. 3.    There is no source of trade effluent generation and process/boiler emission by the cold storage unit. 4.    The cold storage unit will stop the expansion activities & will recommence the same after obtaining ‘Consent to Establish’ from the Board. 5.    He further requested for grant of CTO for present capacity. After hearing the representative of the industry and officer of the Board, it was decided as under: 1.    The industry shall submit an undertaking regarding it submissions as above, within 3 days to this office so as to decide the application. 2.    The industry shall not carry out expansion activities without obtaining CTE from the Board. 3.    It was made clear to the representative of the industry that in case, it fails to comply with the above decisions, action as deemed fit under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 shall be taken against the industry without affording any further opportunity of hearing/notice.   Submitted for confirmation of proceedings
