CTOW/Varied/LDH3/2016/4465769 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Varied/LDH3/2016/4456697 dated 27.09.2016 for manufacturing of Plywood, Ply Board, Ply, Board, Laminated Board, Door, Panel, Furniture, Saw Mill, Veneer, Flush Door Etc. @ 4000 m<sup>2</sup>/day by operating thermopacs of capacity 15 Lac Kcal & 20 Lac Kcal along with discharge of trade effluent @ 1.0 KLD onto land for plantation after treatment through ETP and domestic effluent @ 1.5 KLD onto land for plantation after treatment through septic tank,valid upto 30.06.2021 each.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 85.05pt; line-height: 150%;"><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">Thereafter, the industry had applied for ‘Consent to Establish’/ NOC expansion through OCMMS for manufacturing of Plywood, Ply Board, Ply, Board, Laminated Board, Door, Panel, Furniture, Saw Mill, Veneer, Flush Door Etc. @ 5000 m2/day. The industry had installed one new thermopac of capacity 30 Lac Kcal in place of thermopac of capacity 15 Lac Kcal. <strong>However, the industry had not submitted any certificate/permission from the Department of Forests regarding increase in production machinery. </strong>Accordingly, ‘Consent to Establish’ /NOC was granted vide no. </span><span style="font-family: 'Tahoma','sans-serif';">CTE/Exp/LDH3/2021/15782220 dated 19.10.2021 valid upto 30.06.2022 for plywood, ply board, ply, board, laminated board, door, panel, furniture, saw mill, veneer, flush door etc. @ 5000 m<sup>2</sup>/day <strong>with special condition that the industry shall submit the license from Department of Forest, within one month positively.<span style="mso-spacerun: yes;"> </span></strong>The industry had also applied for Varied ‘Consents to Operate’ under the Water Act, 1974 and Air Act, 1981 for increased production capacity as it had already installed thermopac of capacity 30 Lac Kcal, however the same were<span style="mso-spacerun: yes;"> </span>granted for production capacity of 4000 m<sup>2</sup>/day<strong> </strong></span><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">vide no. </span><span style="font-family: 'Tahoma','sans-serif';">CTOW/Varied/LDH3/2021/16183256 </span><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">and </span><span style="font-family: 'Tahoma','sans-serif';">CTOA/Varied/LDH3/2021/16183252 </span><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">dated 19.10.2021, valid upto 18.04.2022 each </span><span style="font-family: 'Tahoma','sans-serif';">with <strong>special condition that the industry shall submit the license from department of forest, within one month positively.</strong></span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 85.05pt; line-height: 150%;"><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">Thereafter, the industry applied for varied ‘Consent to Operate’ under the Water Act, 1974 & the Air Act, 1981</span><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif';"> </span><span style="font-family: 'Tahoma','sans-serif';">for plywood, ply board, ply, board, laminated board, door, panel, furniture, saw mill, veneer, flush door etc. @ 5000 m<sup>2</sup>/day with discharge of trade effluent @ 1.0 KLD onto land for plantation after treatment in ETP and domestic effluent @ 1.5 KLD onto land for plantation after passing through septic tank along with 01 thermopac of capacity 20 Lac KCal with Cyclone separator as APCD and 01 thermopac of capacity 30 Lac KCal with cyclone separator as APCD.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 85.05pt; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">A clarification was raised to the industry that to submit the license issued by Department of Forests under the name of M/s Ramneek International Pvt. Ltd (Location - I). However, the reply submitted by the industry is not satisfactory. </span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 85.5pt; line-height: 150%;"><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">Accordingly, the consent applications applied by the industry under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 were refused vide no. CTOW/Varied/LDH3/2022/19368371 and CTOA/Varied/LDH3/2022/1936836 dated 29.08.2022, respectively.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 85.5pt; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif'; mso-bidi-font-weight: bold;">Thereafter, a meeting was taken by a Vidhan Sabha Committee regarding Buddha Nallah and River Ghaggar on 29.08.2022 at Vidhan Bhawan, Punjab Vidhan Sabha. Members of the committee raised an issue related to discharge of domestic waste water into borewells by the industries located in Humbran area. Accordingly, Humbran area was visited on 02.09.2022 and it was observed that 40 quarters of above said industries are located in the agricultural fields of village Humbran connected through a kacha rasta of length about 4 acres. During visit, it was observed that all labour quarters have been occupied and about 150 persons including children are residing in these quarters. Domestic waste water from these labour quarters was found discharged into 02 borewells. 01 borewell was well type old borewell and entire well was filled with untreated domestic waste water generated from open bathing area. Waste water from toilet section was discharged into borewell after treatment through septic tanks. General housekeeping at labour quarters was extremely poor and municipal solid waste was also found scattered at labour quarters. </span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 85.5pt; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif'; mso-bidi-font-weight: bold;">Thereafter, a telephonic complaint was also received from Dr. K.S. Aulakh, Former Vice Chancellor, PAU, Ludhiana regarding damage of his guava orchid and popular trees due to air pollution. </span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 85.5pt; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif'; mso-bidi-font-weight: bold;">To verify the same, the Humbran area was visited by AEE of this office on 07.09.2022. During visit, the subject cited industry was found emitting thick black smoke. The industry had also failed to submit the forest certificate and the industry had also provided 02 borewells for the disposal of entire domestic effluent generated from labour quarters (reported vide e-noting no. 19860408 dated 07.09.2022) & the industry was running without obtaining Consents of the Board. The report of the same was sent vide e-noting no. 19876904 dated 09.09.2022.</span><strong style="mso-bidi-font-weight: normal;"><span style="font-family: 'Tahoma','sans-serif';"> </span></strong></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 85.05pt; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif'; mso-bidi-font-weight: bold;">Notice u/s 33-A of Water (Prevention & Control of Pollution) Act, 1974 and u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 was also issued to the industry with an opportunity of personal hearing before Chief Environmental Engineer, Ludhiana on 30.09.2022 and it was decided that:</span></p>
<p class="MsoNormal" style="margin-left: 35.45pt; text-align: justify; text-indent: -24.6pt; line-height: 150%; mso-list: l3 level1 lfo2;"><!-- [if !supportLists]--><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-ansi-language: EN-IN; mso-bidi-font-weight: bold;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN; mso-bidi-font-weight: bold;">The industry be only allowed to operate on machinery for which the Department of Forest has earlier issued license.</span></p>
<p class="MsoNormal" style="margin-left: 35.45pt; text-align: justify; text-indent: -24.6pt; line-height: 150%; mso-list: l3 level1 lfo2;"><!-- [if !supportLists]--><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-ansi-language: EN-IN; mso-bidi-font-weight: bold;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN; mso-bidi-font-weight: bold;">Environmental Engineer, Regional Office-3, Ludhiana shall seal the excess machinery immediately for which the industry has not obtained license from Department of Forest and send the report / recommendations, within 07 days.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 85.05pt; line-height: 150%;"><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">Meanwhile, industry has again applied for varied ‘Consent to Operate’ under the Water Act, 1974 & the Air Act, 1981. As the industry had failed to submit the forest certificate and the industry had also provided 02 borewells for the disposal of entire domestic effluent generated from labour quarters, the varied ‘Consent to Operate’ under the Water Act, 1974 & the Air Act, 1981 were refused on 24.11.2022.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 85.05pt; line-height: 150%;"><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">Further, </span><span style="font-family: 'Tahoma','sans-serif';">directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 and u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 were issued to the industry for its closure and directions issued to PSPCL Authorities to disconnect the power supply available with the industry. This office has taken up the matter with PSPCL Authorities vide letter no. 7142 dated 30.12.2022 regarding disconnection of the power supply. Meanwhile, the industry was visited by officer of this office on 17.01.2023 and observed that the industry has started repairing its ETP and has closed well type borewell in its labour quarters. The industry was in process of removing second borewell and was levelling vacant land for plantation of eucalyptus trees. However the PSPCL Authorities failed to disconnect the power supply of the industry. </span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 85.05pt; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">Accordingly, this office taken up the matter with AEE, PSPCL, Humbran vide letter no. 257 dated 20.01.2023 and 335 dated 25.01.2023. Now, the PSPCL Authorities have disconnected the electricity supply of the industry vide TDCO No. 322403/038 dated 30.01.2023.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 85.05pt; line-height: 150%;"><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">Now, the industry has again applied for varied ‘Consent to Operate’ under the Water Act, 1974 & the Air Act, 1981</span><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif';"> </span><span style="font-family: 'Tahoma','sans-serif';">for plywood, ply board, ply, board, laminated board, door, panel, furniture, saw mill, veneer, flush door etc. @ 5000 m<sup>2</sup>/day with discharge of trade effluent @ 1.0 KLD onto land for plantation after treatment in ETP and domestic effluent @ 1.5 KLD onto land for plantation after passing through septic tank along with 01 thermopac of capacity 20 Lac KCal with Cyclone separator as APCD and 01 thermopac of capacity 30 Lac KCal with cyclone separator as APCD. The industry has already deposited Rs. 1,800/- vide UTR. No. AXSK221940022848 dated 13.07.2022 under Water Act, 1974 & Rs. 1,800/- vide UTR. No. AXSK221940022990 dated 13.07.2022 under Air Act, 1981, which is adequate upto 30.09.2026 under both Acts. The industry has also deposited Rs. 10,800/- vide UTR. No. AXSK221940022848 dated 13.07.2022 as NOC regularization fee for increase in fixed assets. The industry was visited by undersigned on 01.02.2023 and it was observed as under:</span></p>
<ol style="margin-top: 0in;" start="1" type="1">
<li class="MsoNormal" style="text-align: justify; line-height: 150%; mso-list: l4 level1 lfo3;"><span style="font-family: 'Tahoma','sans-serif';">The industry was not in operation due to disconnection of power supply. </span></li>
<li class="MsoNormal" style="text-align: justify; line-height: 150%; mso-list: l4 level1 lfo3;"><span style="font-family: 'Tahoma','sans-serif';">The industry has provided one thermopac of capacity 30 Lac Kcal and has provided dust collector followed by cyclone as APCD. The industry has also started work related to installation of wet scrubber as APCD. </span></li>
<li class="MsoNormal" style="text-align: justify; line-height: 150%; mso-list: l4 level1 lfo3;"><span style="font-family: 'Tahoma','sans-serif';">2<sup>nd</sup> thermopac of capacity 20 Lac Kcal is not in operationable condition and is not connected with production line.</span></li>
<li class="MsoNormal" style="text-align: justify; line-height: 150%; mso-list: l4 level1 lfo3;"><span style="font-family: 'Tahoma','sans-serif';">The industry has closed its well type borewell located in its labour quarters and filled it completely with soil. The industry has also removed 2<sup>nd</sup> borewell and has provided proper septic tanks and treated water from septic tanks is discharged onto land for plantation. The industry has provided new tree saplings in an area of 1.5 kanal. There are about 40 labour quarters and plantation area provided by the industry is adequate to handle treated water from these labour quarters. </span></li>
<li class="MsoNormal" style="text-align: justify; line-height: 150%; mso-list: l4 level1 lfo3;"><span style="font-family: 'Tahoma','sans-serif';">The industry has provided septic tanks for treatment of domestic effluent generated from office section. There is only one washroom in office section. Treated water after septic tank is discharged onto land for plantation. </span></li>
<li class="MsoNormal" style="text-align: justify; line-height: 150%; mso-list: l4 level1 lfo3;"><span style="font-family: 'Tahoma','sans-serif';">The industry has installed 03 glue kettles for manufacturing of glue and trade effluent generated from glue kettles is treated in ETP provided by the industry. The industry has made ETP in operanable condition. ETP provided by the industry consists of collection tank, chemical dosing tank, clarifier, dual stage filter. All mechanical fittings of ETP are in line. However, the project proponent is required to provide pipeline for discharge of treated effluent into plantation area. </span></li>
<li class="MsoNormal" style="text-align: justify; line-height: 150%; mso-list: l4 level1 lfo3;"><span style="font-family: 'Tahoma','sans-serif';"><span style="mso-spacerun: yes;"> </span>The machinery installed by the industry is Vertical band saw = 0, peeler = 0, Core drying process = 2, seasoning chamber = 03, hot press =02. The representative of the industry informed that it is using saw and peeler from its sister concern unit i.e. Ramneek International (Unit-II) as due to very low market demand, both units are operating at less than 50% capacity. Machinery installed by the project proponent in its sister concern unit i.e. Ramneek International (Unit-II) is vertical band saw=05 (42”), peeler=03(56”), hot press=01, seasoning chamber=06 and core drying process =02.</span></li>
<li class="MsoNormal" style="text-align: justify; line-height: 150%; mso-list: l4 level1 lfo3;"><span style="font-family: 'Tahoma','sans-serif';">The project proponent has two licenses under the name of M/s Ramneek Packing & General Mills (P) Ltd (Sh. Randhir Singh as license holder in both cases). License -1 dated 04.11.2021 was valid for 10 years and as per this license, permitted machinery is vertical band saw (42”) = 02, peeler (56”) = 01, Hot Press = 01, Core drying process = 01. The Divisional Forest Officer, Ludhiana has forwarded the letter to the conservator of forests, South Circle, Patiala vide their letter no. 6082 dated 04.10.2022 regarding change of name in license from Sh. Randhir Singh to Sh. Kanwalpreet Singh. License -2 dated 08.07.2019 was valid for period upto 07.07.2024 and as per this license, permitted machinery is vertical band saw (42”) = 07, peeler (56”) = 02, Hot Press = 02. The Divisional Forest Officer, Ludhiana has forwarded the letter to the conservator of forests, South Circle, Patiala vide their letter no. 6073 dated 04.10.2022 regarding change of name in license from Sh. Randhir Singh to Sh. Kanwalpreet Singh. Copy of both licenses and letters is attached. </span></li>
<li class="MsoNormal" style="text-align: justify; line-height: 150%; mso-list: l4 level1 lfo3;"><span style="font-family: 'Tahoma','sans-serif';">The total machinery installed by the project proponent in both units (combined) is less than the licensed machinery except for core drying process. </span></li>
<li class="MsoNormal" style="text-align: justify; line-height: 150%; mso-list: l4 level1 lfo3;"><span style="font-family: 'Tahoma','sans-serif';">As per record file, the District Town Planner, Ludhiana vide letter no. 3656- DTP(L)/M2A dated 30.09.2009 has clarified that as per Approved Master Plan, Ludhiana, the industry is located in Medium & Heavy Industrial Zone. Thus, the site of the industry is suitable for establishment / expansion of such type of unit. </span></li>
</ol>
<p class="MsoNormal" style="text-align: justify; text-indent: 85.5pt; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">Thus, the industry has removed borewells, provided plantation for discharge of treated water from labour quarters and is upgrading its APCD. The industry is mainly complying with the provisions of the Water Act, 1974 and the Air Act, 1981. However, clarification regarding production capacity of both units as per forest license and distribution of machinery in both units as per licenses is required to be get clarified from the Department of Forests. </span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 85.05pt; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">It is pertinent to mention here that that a bank guarantee amounting to Rs. 2.00 lacs was imposed upon the industry during hearing dated 06.01.2016 as an assurance to comply with pollution control laws. The industry failed to submit above said bank guarantee and the industry was again given personal hearing before the Member Secretary of the Board on 18.01.2019, wherein it was again decided that the bank guarantee of Rs. 2.00 lac already imposed in the personal hearing dated 06.01.2016 be submitted to the Board. However, the industry has not submitted the above said bank guarantee. The industry was again asked by the Board on 18.10.2019 to submit the above said bank guarantee. The industry has not submitted bank guarantee till date. </span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 85.05pt; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">Keeping the above in view, it is recommended that :</span></p>
<p class="MsoListParagraphCxSpFirst" style="text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span lang="X-NONE" style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-US;">Varied </span><span lang="X-NONE" style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">‘Consent to Operate’ under the Water Act, 1974 may be </span><span lang="EN-IN" style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">granted to the industry for shorter period i.e. for six months </span><span lang="X-NONE" style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">for </span><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-US;">manufacturing of </span><span lang="X-NONE" style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">plywood, ply board, ply, board, laminated board, door, panel, furniture, saw mill, veneer, flush door etc. @ 5000 </span><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-US;">m<sup>2</sup></span><span lang="X-NONE" style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">/day with discharge of trade effluent @ 1.0 KLD onto land for plantation after treatment in ETP and domestic effluent @ </span><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-US;">6.0</span><span lang="X-NONE" style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';"> KLD onto land for plantation after passing through septic tank </span><span lang="EN-IN" style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">subject to suitable conditions along with followings special conditions:</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: .75in; mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l2 level1 lfo4;"><!-- [if !supportLists]--><span lang="X-NONE" style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">A)<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-IN" style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">This Consent is granted subject to the report of Divisional Forest Officer, Ludhiana regarding distribution of machinery between M/s Ramneek International (Unit-I) & Unit-II and permitted machinery for both units.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: .75in; mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l2 level1 lfo4;"><!-- [if !supportLists]--><span lang="X-NONE" style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">B)<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-IN" style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">The industry shall get its effluent samples analysed from Board’s lab within 02 months. </span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: .75in; mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l2 level1 lfo4;"><!-- [if !supportLists]--><span lang="X-NONE" style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">C)<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-IN" style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">The industry shall submit the bank guarantee of Rs. 2.00 as assurance to comply with pollution control laws, within 01 month. </span></p>
