Ø  The industry was earlier granted consents to operate under the Water Act, 1974 vide no. CTOW/Fresh/FDK/2016/4853083 and the Air Act, 1981 vide no. CTOA/Fresh/FDK/2016/4852929 dated 16.06.2021 for manufacturing of Fruits & Vegetable crates @ 360 no. per day by using Virgin plastic & recycled plastic waste HDPE/LDPE scrap @ 540 Kg/day, for a period upto 30.09.2021.   Ø  The industry has now applied for varied consent to operate under the Water Act, 1974 & Air Act, 1981 for operation of unit to manufacture Plastic Products (Fruit / Vegetables Crates, Toys Etc.)@ 1 MTD by using virgin plastic & waste plastic (HDPE / LDPE Scrap). Details of the case are as under:-   1.       The industry has submitted certificate from Chartered Accountant issued dated 21.12.2022 showing gross fixed assets of Rs. 35.86 lakhs as on 31.11.2022.  The industry has deposited Rs. 25,200/- (Rs. 18000/- vide UTR No. IDIBH21239272972 dated 27.08.2021 & Rs. 7200/- vide UTR No. IDIBH23011119852 dated 11.01.2023) under the Water Act, 1974.  Rs. 25,200/- (Rs. 18000/- vide UTR No. IDIBH21239272512 dated 27.08.2021 & Rs. 7200/- vide UTR No. IDIBH23011113189 dated 11.01.2023) under the Air Act, 1981. The consent to operate fee is adequate for a period upto 31.12.2027 under both the Acts. 2.       The industry has submitted registered sale deed dated 18.12.2014 for  land area of 14.5 marlas to the name of its proprietor. The industry has also submitted lease land deed of land area 4 kanals, executed between firm through its proprietor and Mrs. Shikha Goyal W/o Satish Goyal for Rs. 1,00,000/- per annum. The industry has also submitted a lease deed for land area 200 sq yrds. 3.       The industry has submitted classification report issued by DTP Faridkot to its sister concerned unit M/s Goyal Industries, as per which the industry falls in industrial zone.   Ø  The industry was visited by undersigned (AEE) on 14.01.2023 and it was observed as under:-   i)                    The industry was not in operation during the visit. ii)                   The industry has installed one no. cutter, one no. extruder and one no. moulding machine. iii)                 The industry has installed packed wet scrubber along with proper hood with the extruder to contain the emissions generated during the operation of the same. iv)                 The industry has no source of trade effluent generation and domestic effluent is being discharged onto land for plantation.   The industry is complying with the provisions of the Water Act, 1974 & the Air Act, 1981.   In view of above, it is recommended that consent to operate under Water Act, 1974 and Air Act, 1981 may be granted to the industry for a period upto 31.03.2023 with suitable conditions alongwith specific conditions as under: 1.       The industry shall register under Plastic waste processor in centralized EPR Portal and fulfillment of Extended Producer Responsibility as per provisions of Plastic Waste Management Rules, 2016. 2.       The industry shall not manufacture, stock, distribute, recycle and sell the plastic carry bags. 3.       The industry shall comply with the provisions of notification no. 5/18/2016-4Ig4/692717/1 dated 18.02.2016 issued by the Department of Local Government, Govt. of Punjab and notification no. SO. 438/P.A9/1994/S30/2016 dated 29.03.2016 issued by the Department of Rural Development & Panchayat, Govt. of Punjab in letter & spirit. 4.       The industry will not manufactured any single use plastic in compliance to MoEFCC and CPCB's order regarding ban on single use plastic items w.e.f 01.07.2022
