<span lang="EN-US" style="font-size: 12.0pt; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Tahoma; color: black; mso-ansi-language: EN-US; mso-fareast-language: EN-IN; mso-bidi-language: HI;">Kindly peruse the report/ recommendations sent by RO-III, Ludhiana. <span lang="EN-US" style="font-size: 12.0pt; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Tahoma; color: black; mso-ansi-language: EN-US; mso-fareast-language: EN-IN; mso-bidi-language: HI;">  <span lang="EN-US" style="font-size: 12.0pt; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Tahoma; color: black; mso-ansi-language: EN-US; mso-fareast-language: EN-IN; mso-bidi-language: HI;">It is imperative to point out here that: 1.      <span lang="EN-US" style="font-size: 12.0pt; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Tahoma; color: black; mso-ansi-language: EN-US; mso-fareast-language: EN-IN; mso-bidi-language: HI;">The industry was earlier granted renewal of ‘Consent to Operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOW/Renewal/LDH3/2021/14789257 & CTOA/Renewal/LDH3/2021/14789226 both dated 23.02.2021 valid upto 31.03.2024 each, for manufacturing of Soap Noodles @ 60 Metric Tonnes/Day, Stearic Flakes @ 20 Metric Tonnes/Day, Glycerin @ 5 Metric Tonnes/Day & Acid Oil @ 2 Metric Tonnes/Day alongwith generation & discharge of trade effluent @ 45 KLD and domestic effluent @ 8 KLD after treatment onto plantation area alongwith recirculation of cooling water @ 360 KLD (as per its application form), subject to certain conditions as mentioned therein. 2.      <span lang="EN-US" style="font-size: 12.0pt; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Tahoma; color: black; mso-ansi-language: EN-US; mso-fareast-language: EN-IN; mso-bidi-language: HI;">Thereafter, the industry had obtained ‘Consent to Establish’ (NOC expansion) vide no. CTE/Exp/LDH3/2021/17338539dated 13.12.2021 for installation of additional machinery to produce Refined rice bran oil @ 90 MTPD, Soap Noodles @ 60 MTPD, Stearic Flakes @ 40 MTPD, Glycerin @ 5 MTPD, Acid Oil @ 2 MTPD, Rice Fatty @ 18 MTPD, Rice Sterine @ 10 MTPD, Wax @ 6.05 MTPD and Gums @ 2.5 MTPD alongwith generation & discharge of trade effluent @ 60 KLD and domestic effluent @ 8 KLD after treatment onto plantation area alongwith recirculation of cooling water @ 200 KLD (as per its application form), subject to certain conditions as mentioned therein. 3.      <span lang="EN-US" style="font-size: 12.0pt; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Tahoma; color: black; mso-ansi-language: EN-US; mso-fareast-language: EN-IN; mso-bidi-language: HI;">Subsequently, the industry was granted varied ‘Consent to Operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOW/Varied/LDH3/2022/18762442 & CTOA/Varied/LDH3/2022/18763349 both dated 02.08.2022 valid upto 31.12.2022 each, for manufacturing of Refined rice bran oil @ 90 MTPD, Soap Noodles @ 60 MTPD, Stearic Flakes @ 40 MTPD, Glycerin @ 5 MTPD, Acid Oil @ 2 MTPD, Rice Fatty @ 18 MTPD, Rice Sterine @ 10 MTPD, Wax @ 6.05 MTPD and Gums @ 2.5 MTPD alongwith generation & discharge of trade effluent @ 60 KLD and domestic effluent @ 8 KLD after treatment onto plantation area alongwith recirculation of cooling water @ 200 KLD (as per its application form), subject to certain conditions as mentioned therein. 4.      <span lang="EN-US" style="font-size: 12.0pt; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Tahoma; color: black; mso-ansi-language: EN-US; mso-fareast-language: EN-IN; mso-bidi-language: HI;">Now, the industry has applied for obtaining Varied ‘Consent to Operate’ under the Water (Prevention & Control of Pollution) Act 1974 and the Air (Prevention & Control of Pollution) Act, 1981 through OCMMS for manufacturing of Soap Noodles @ 60 Metric Tonnes/Day, Stearic Flakes @ 20 Metric Tonnes/Day, Glycerin @ 5 Metric Tonnes/Day & Acid Oil @ 2 Metric Tonnes/Day i.e. the same products for which it was granted CTO as mentioned at point no. 1 above,  however it has mentioned  generation & discharge of trade effluent @ 15 KLD and domestic effluent @ 8 KLD after treatment onto plantation area alongwith recirculation of cooling water @ 360 KLD (as per its application form). The same needs clarification w.r.t. water balance adopted by the industry while filing its application and the reason for abrupt decrease in trade effluent generation against the same production capacity for which it was earlier granted CTO as mentioned at point no. 1 above. 5.      <span lang="EN-US" style="font-size: 12.0pt; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Tahoma; color: black; mso-ansi-language: EN-US; mso-fareast-language: EN-IN; mso-bidi-language: HI;">The RO has not accounted for penalty fees to the industry as the earlier granted CTO had expired on 31.12.2022 and the industry has applied for varied CTO on 04.01.2023 under both the Water Act, 1974 and the Air Act, 1981. The RO is required to recalculate the adequacy of the fees deposited by the industry. 6.      <span lang="EN-US" style="font-size: 12.0pt; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Tahoma; color: black; mso-ansi-language: EN-US; mso-fareast-language: EN-IN; mso-bidi-language: HI;">The RO has reported that the industry has provided ETP of capacity 100 m3/day (new ETP after expansion) to treat trade effluent generated from the process as per record maintained by the industry, average discharge per day is about 11 KL. Since, the industry has revised its proposal and not willing to operate the refinery plant which was indeed the major source of effluent generation; it shall not be feasible to operate the ETP based on biological treatment at merely 10% of its capacity as the microbial culture shall not sustain in such conditions rendering ineffective treatment in time to come. 7.      <span lang="EN-US" style="font-size: 12.0pt; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Tahoma; color: black; mso-ansi-language: EN-US; mso-fareast-language: EN-IN; mso-bidi-language: HI;">Earlier, the industry had obtained Consent to Establish (NOC) expansion and thereafter varied CONSENT TO OPERATE under the Air Act, 1981 for installation & operation of additional boiler of capacity 14 TPH, with one additional condition that ‘The industry shall submit completion certificate of the APCD installed with newly installed boiler of capacity 14 TPH, within 15 days to the Board<span lang="EN-US" style="font-size: 12.0pt; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Tahoma; color: black; mso-ansi-language: EN-US; mso-fareast-language: EN-IN; mso-bidi-language: HI;">’. Also, the RO was asked vide the consent issued to ensure collection of emission sample collected from the stack attached with APCD installed with newly installed boiler of capacity 14 TPH, for which varied consent to operate under Air Act, 1981 was issued and to submit report to concerned Zonal Office within one month, along with compliance of conditions of consent mentioned herein. <span lang="EN-US" style="font-size: 12.0pt; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Tahoma; color: black; mso-ansi-language: EN-US; mso-fareast-language: EN-IN; mso-bidi-language: HI;">Now, the RO has reported that the industry has installed the rice husk based Boiler of capacity @ 14 TPH and has provided dust collector followed by cyclone separator as APCD with new boiler of capacity 14 TPH but the same was not in operation. It is required to be clarified whether the industry intends to operate the said boiler in lieu to its revised proposal to not operate the refinery plant; if so, it is required to submit completion cum adequacy certificate of the APCD and the RO is required to carry out stack emission sampling of the new boiler. <span lang="EN-US" style="font-size: 12.0pt; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Tahoma; color: black; mso-ansi-language: EN-US; mso-fareast-language: EN-IN; mso-bidi-language: HI;">  Keeping above in consideration, if approved, the application be sent back to RO-III, Ludhiana for clarifying/ submitting comments on the aforesaid observations and submit fresh recommendations in lieu to the clarification/ comments to be submitted by it.
