<p><span style="font-family: arial, helvetica, sans-serif; font-size: 12pt;"> Kindly peruse the note and recommendation given by RO .</span></p>
<p><span style="font-family: arial, helvetica, sans-serif; font-size: 12pt;">It is intimated that PP has applied for CTO under the Water Act, of 1974.</span></p>
<p><span style="font-family: arial, helvetica, sans-serif; font-size: 12pt;"> RO has reported that PP is not complying with the terms and conditions of the earlier consent to establish (NOC) granted by the Board as well as the terms and conditions of Environment Clearance granted to it </span></p>
<p><span style="font-family: arial, helvetica, sans-serif; font-size: 12pt;"> Therefore SCN for refusal of CTO applied under the Water Act, 1974 and the Air Act, 1981 along with an opportunity to submit a reply within 7 days was issued to the project proponent vide Board's letter no. 408-09 dated 19/1/2023. </span></p>
<p><span style="font-family: arial, helvetica, sans-serif; font-size: 12pt;">The industry has submitted the reply w.r.t SCN, same is not satisfactory as it has not made disposal arrangements and The labour/worker of the project proponent are residing. The untreated domestic effluent was being discharged into the nearby drain without any treatment. </span></p>
<p><span style="font-family: arial, helvetica, sans-serif; font-size: 12pt;">If approved following action may be approved, please.</span></p>
<p><span style="font-family: arial, helvetica, sans-serif; font-size: 12pt;"><!-- [if !supportLists]-->1) <!--[endif]-->The CTO under the Water Act,1974 applied by PP may be refused.</span></p>
<p><span style="font-family: arial, helvetica, sans-serif; font-size: 12pt;"><!-- [if !supportLists]-->2) <!--[endif]-->notice under u/s 33-A of the Water Act, 1974 may be issued to the industry with an opportunity for a personal hearing before Chairman Sir . the following direction may be proposed in this notice.</span></p>
<p><span style="font-family: arial, helvetica, sans-serif; font-size: 12pt;">A) EC shall be imposed on the PP as damage to the Environment.</span></p>
<p><span style="font-family: arial, helvetica, sans-serif; font-size: 12pt;"> B) The project proponent shall stop all construction activities at the site with immediate effect and stop forthwith discharging any effluent/ wastewater into sewer/ inland surface water/ onto land or through any other mode.</span></p>
<p><span style="font-family: arial, helvetica, sans-serif; font-size: 12pt;">C) The project proponent shall not allow any new occupancy and shall not allow any new possession in the premises of the project, with immediate effect.</span><span style="font-family: arial, helvetica, sans-serif; font-size: 12pt;"> </span></p>
<p><span style="font-family: arial, helvetica, sans-serif; font-size: 12pt;"> <!--[endif]-->D) The Revenue Authorities shall not register any sale deed related to any plot/ flat/ house/ shop/ showroom/ any other component of this project, with immediate effect.</span></p>
