The industry was granted ‘Consent to Operate’ under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOW/Renew/LDH3/2022/18750754 dated 22.07.2022 and vide no. CTOA/Renew/LDH3/2022/18750758 dated 06.07.2022 respectively, both valid upto 31.12.2022 and Directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 were issued to the PSPCL Authorities vide no. 4876-79 dated 18.07.2022 for temporarily restore the electricity connection of the industry for period upto 31.12.2022. Now, the industry had applied for renewal of ‘Consent to Operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 under green category, for manufacturing of Knitted Hosiery Goods @ 3000 Numbers/day. The industry has deposited Rs. 9240 each vide UTR no. N115221930336984 & N115221930396223 dated 25.04.2022 under the Water Act, 1974 & the Air Act, 1981 respectively against the CA certificate of Rs 318.95 lacs, which is adequate upto 31.12.2023                              The industry was earlier visited by officer of the Board on  09.01.2023 and found violating the provisions of Water Act, 1974 and Air Act, 1981. Accordingly, a show cause notice was issued to the industry vide zonal office letter no. 377 dated 23.01.2023 to explain its position within 03 days.                           Now, the industry was again visited by the officer of the Board on 24.01.2023 and observed as under:-   <p class="MsoListParagraphCxSpFirst" style="mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1; margin: 0in 0in .0001pt 21.75pt;">1.     The industry was in operation for production of hosiery goods. During visit, the industry was not in operation due to power cut. <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1; margin: 0in 0in .0001pt 21.75pt;">2.    The industry has installed 20 Knitting machines, 07 Linking machines, 03 Stitching machines, 02 Overlock machines, 02 Washing machines, 02 Tumbler & 02 Hydro machines. The representative of the industry informed that the washing is only being done, when it requires. <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1; margin: 0in 0in .0001pt 21.75pt;">3.    The industry has installed ETP for treatment of effluent generated from washing process which further discharged onto land for plantation. The effluent samples of the industry were collected on 20.06.2022 and found within prescribed limit as per analysis report received from Zonal Lab, Ludhiana vide no. 668 dated 29.06.2022. <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1; margin: 0in 0in .0001pt 21.75pt;">4.    The industry has provided wood fired boiler of capacity 500 kg with adequate stack height. <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1; margin: 0in 0in .0001pt 21.75pt;">5.    The industry has now made an arrangement for disposal of domestic effluent onto land for plantation after passing through septic tank. <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1; margin: 0in 0in .0001pt 21.75pt;">6.    The industry has provided adequate land for plantation + lawn of approx. 650-700 sq yards in its premises for disposal of trade effluent and domestic effluent. <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1; margin: 0in 0in .0001pt 21.75pt;">7.    The representative of the industry informed that the industry is in the process for purchasing new D.G set, which will equipped with canopy. The old D.G set, which was without canopy was placed in the separate room. The representative of the industry informed that they will not use the old D.G set. The industry was not using the said D.G set during the visit despite of power cut.  <p class="MsoListParagraphCxSpLast" style="mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1; margin: 0in 0in .0001pt 21.75pt;">8.    The industry has submitted a letter issued by DTP, Ludhiana vide no. 1875 dated 01.07.2019 mentioning that the industry is operating at the  site before Master Plan of Ludhiana and the site of the industry falls under residential zone as per Master Plan of Ludhiana and the industry can continue its operation for further 15 years from the date of notification of Master Plan of Ludhiana. Further, as per Board's order no. 21 dated 08.06.2018, it has been decided that the existing industrial units/ other establishments which were established before the notification of the master plan of the respective cities shall be allowed “consents/extension under the provisions of Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981 and authorization under the provisions of Hazardous Waste Management Rules, 2016 for a period of 15 years from the date of the notification of master plan alter taking the concrete documentary proof regarding the date of commissioning of such units. No separate approval from local bodies/other authorities is required to be obtained.              As such, the industry is now complying with the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.   Keeping the above in view, it recommended as under:   A)     1. Consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and may be renewed upto 30.06.2023 subjected to the suitable conditions and special conditions that the industry shall shift its unit in designated industrial area as per provisions of Notified Master Plan, Ludhiana please.   B)     2. Directions u/s 33-A of Water Act, 1974 may be issued to the industry for temporarily restoration of electric connection upto 30.06.2023, please C)       3. Direction u/s 31-A of Air (Prevention & Control of Pollution) Act, 1981 may be issued to seal the D.G set, which is without canopy, please.
