File Note: <p style="text-align: justify;"><span style="font-family: Arial, 'sans-serif';">It is intimated that &nbsp;Board has received regular complaints regarding the problem of fly ash in the adjoining areas.</span></p> <p style="text-align: justify;"><span><span style="font-family: Arial, 'sans-serif';">&nbsp; Therefore show cause notice for refusal of renewal of consent to operate applied under the Air Act, 1981 along with an opportunity to submit a reply within 7 days was issued to the industry vide Board's letter no. 141-42 dated 5/1/2023.</span></span></p> <p style="text-align: justify;"><span><span style="font-family: Arial, 'sans-serif';">Thereafter the industry has claimed that there is no problem with fly ash in the area now. RO has reported that as per directions issued by the Board u/s 31-A of the Air (Prevention &amp; Control of Pollution) Act, 1981, the industry has now stopped the operation of the boiler of capacity 40 TPH installed in process house-1 and the same was found in the non-operational condition.</span></span></p> <p style="text-align: justify;"><span><span style="font-family: Arial, 'sans-serif';">Thereafter RO sent the recommendation without verifying the facts of the complaint as well as verifying the statement given in the reply submitted&nbsp;by the industry.</span></span></p> <p style="text-align: justify;"><span><span style="font-family: Arial, 'sans-serif';">At this stage my opinion was, the site revisit can be required&nbsp;&nbsp;so as&nbsp;&nbsp;conclude the complaint&nbsp;&nbsp;matter as well as decide on CTO on merit</span></span></p> <p style="text-align: justify;"><span><span lang="EN-IN" style="font-family: Arial, 'sans-serif';">the industry M/s Nahar Industrial Enterprises Ltd. vide letter dated 17.01.2023 has submitted a copy of the Fly Ash Management Report carried out by Thapar Institute of Engineering &amp; Technology (TIET), wherein, it has been recommended by the expert team of TIET as under&nbsp;</span></span></p> <p style="text-align: justify;"><span><span lang="EN-IN" style="font-family: Arial, 'sans-serif';">a)&nbsp;&nbsp;&nbsp;&nbsp;Industry needs to sign the MOU with the vendors who are collecting/utilizing the ash from the NIEL industry.</span></span></p> <p style="text-align: justify;"><span><span lang="EN-IN" style="font-family: Arial, 'sans-serif';">b)&nbsp;&nbsp;&nbsp;&nbsp;Industry should execute the metals analysis in the ash minimum once a month from reputed labs.</span></span></p> <p style="text-align: justify;"><span><span lang="EN-IN" style="font-family: Arial, 'sans-serif';">c)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;There should be an official record for the ash disposal to the vendors on daily basis. Handwritten records should be avoided.</span></span></p> <p style="text-align: justify;"><span><span lang="EN-IN" style="font-family: Arial, 'sans-serif';">d)&nbsp;&nbsp;&nbsp;&nbsp;Industry and ash vendors needs to set up a Transport manifesto for the effective and corrective ash generation and disposal mechanism.</span></span></p> <p style="text-align: justify;"><span><span style="font-family: Arial, 'sans-serif';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &nbsp;In view of the above the industry has made compliance with a direction under 31-A as 40 TPH installed in process unit (1) not non-operational, the reply submitted by the industry, the report of the expert team of TIET and the present situation in the surrounding area fly ash in the area has now reduced by almost 90-95% since last 10-12 days informed by the local residents of Lalru.</span></span></p> <p style="text-align: justify;"><span><span style="font-family: Arial, 'sans-serif';">If may approve renewal CTO under Air Act,1981 applied by the industry be granted for six-month&nbsp;subject to suitable conditions and additional conditions as proposed by EE, RO. An additional condition may be imposed that&nbsp;</span><span lang="EN-IN" style="font-family: Arial, 'sans-serif';">1)The industry shall ensure compliance with provisions of the Air (Prevention &amp; Control of Pollution) Act, 1981, the Environment (Protection) Act, 1986, and or any other environment law applicable to him and rules, circulars issued by the Board from time to time.</span></span></p> <p style="text-align: justify;"><span><span lang="EN-IN" style="font-family: Arial, 'sans-serif';">2)In case of any violation action u/s 31-A of the Air (Prevention &amp; Control of Pollution) Act, 1981 will be initiated for closure of the project proponent without further notice.</span></span></p> <p style="text-align: justify;"><span><span lang="EN-IN" style="font-family: Arial, 'sans-serif';">EE, RO may also be requested to monitor the industry as per protocol framed by the Board and verify compliance with environmental law and send the report along with recommendations.</span></span></p> <p>&nbsp;</p> <p style="text-align: justify;"><span lang="EN-IN" style="font-family: Arial, 'sans-serif';">( Competency: Chairman Sir )</span></p>
