<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; line-height: normal;"><span style="font-family: 'Verdana','sans-serif';">It is submitted that the industry small scale green category. The industry was granted Consent to Establish (NOC) for setting up an industrial unit u/s 25 of Water (Prevention & Control of Pollution) Act, 1974 and u/s 21 of Air (Prevention & Control of Pollution) Act,1981 vide no. CTE/Fresh/LDH4/2020/14432235 dated 05/03/2021, upto 05/03/2022 for production Natural Gas (Odorized) @ 13000 m3/h by using natural gas @ 13000 m3/h as raw material and for discharge of only domestic effluent @ 0.3 onto land for plantation after septic tank and one DG set of capacity 25 KVA with canopy with certain conditions and with special conditions that:-</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; line-height: normal;"><span style="text-indent: -0.25in; font-family: Verdana, 'sans-serif';">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="text-indent: -0.25in; font-family: Verdana, 'sans-serif';">This auto generated consent is based on the information / data submitted by the Industry. In case of any change of data or in case of any information submitted is found incorrect, this consent shall stand cancelled.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; line-height: normal;"><span style="text-indent: -0.25in; font-family: Verdana, 'sans-serif';">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="text-indent: -0.25in; font-family: Verdana, 'sans-serif';">The inspection of industry shall be governed by the inspection policy framed by CPCB/PPCB/Govt. from time to time. In case of complaint, the industry can be visited by the Regional Office or any other officer authorized by the Competent Authority.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-bottom: .0001pt; mso-add-space: auto;"><span style="text-align: justify; text-indent: -0.25in; font-family: Verdana, 'sans-serif';">3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="text-align: justify; text-indent: -0.25in; font-family: Verdana, 'sans-serif';">In case of industry is found to create conditions that generate any type of pollution and / or if there is any objection from the surrounding community and if on verification, it is found that such objection has some substance, the Board shall be at the liberty to take action against the Industry under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 and / or Environment (Protection) Act, 1986 as deemed fit.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-bottom: .0001pt; mso-add-space: auto;"><span style="text-align: justify; text-indent: -0.25in; font-family: Verdana, 'sans-serif';">4.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="text-align: justify; text-indent: -0.25in; font-family: Verdana, 'sans-serif';">This consent is issued on the basis of self calculation of consent fee made by the industry. In case, any difference in the consent fee deposited by the industry is found, the industry shall have to deposit the balance consent fee.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-bottom: .0001pt; mso-add-space: auto;"><span style="text-align: justify; text-indent: -0.25in; font-family: Verdana, 'sans-serif';">5.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="text-align: justify; text-indent: -0.25in; font-family: Verdana, 'sans-serif';">In case of change of data provided in this simplified form, the Industry shall inform the Board and shall get revised Consent. The Industry shall apply for obtaining Consent to Establish / Operate from the PPCB, in event of its graduation from Green to Orange/Red category Industry.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; line-height: normal;"><span style="font-family: Verdana, 'sans-serif';">And with other conditions:-</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; line-height: normal;"><span style="text-indent: -0.25in; font-family: Verdana, 'sans-serif';">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="text-indent: -0.25in; font-family: Verdana, 'sans-serif';">This consent to establish is issued from pollution angle and the industry shall obtain the statutory clearances / permissions from the other departments, as required.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; line-height: normal;"><span style="text-indent: -0.25in; font-family: Verdana, 'sans-serif';">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="text-indent: -0.25in; font-family: Verdana, 'sans-serif';">The agency will dispose off domestic effluent onto land for plantation after passing through septic tank.</span></p>
<p class="MsoListParagraphCxSpMiddle"><span style="font-family: 'Verdana','sans-serif';"> </span><span style="text-align: justify; text-indent: -0.25in; font-family: Verdana, 'sans-serif';">3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="text-align: justify; text-indent: -0.25in; font-family: Verdana, 'sans-serif';"> The agency will not change any process/expand without prior permission from the Board.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; line-height: normal;"><span style="font-family: Verdana, 'sans-serif';">Now the industry was applied for fresh consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and under the Air (Prevention & Control of Pollution) Act, 1981 through OCMMS on 01.12.2022 for production Natural Gas (Odorized) @ 13000 m3/h by using natural gas @ 13000 m3/h as raw material.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; line-height: normal;"><span style="font-family: Verdana, 'sans-serif';">The industry has deposited consent fee Rs. 42,000/- vide R.No. 52789549 dated 01/12/2022 under the Water Act, 1974 and Rs. 42,000/- vide R.No. 323961867 dated 01/12/2022 under the Air Act, 1981, which is adequate upto 05.03.2027 against gross value of fixed assets of Rs. 4,19,71,024/- as on 21.11.2022.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; line-height: normal;"><span style="font-family: Verdana, 'sans-serif';">The industry has also submitted CLU from STP, Ludhiana issued vide memo no. 1962 STP(L)/TW12-A dated 01.09.2020 stating that the site of the industry falls in industrial Land use Zone as per approved Master Plan, Ludhiana (2007-2031), As such the site is suitable for establishment of such industries.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; line-height: normal;"><span style="font-family: Verdana, 'sans-serif';">As per the NOC granted by the Board, the project proponent has already obtained permission from the petroleum & natural gas regulatory Board (PNGRB) vide letter dated 26.10.2018.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; line-height: normal;"><span style="font-family: Verdana, 'sans-serif';">It is submitted that the industry was visited by the undersigned on 24.04.2023 and it was observed are asunder:-</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; line-height: normal;"><span style="font-family: 'Verdana','sans-serif';">1. The industry is engaged in supply of gas to nearby area.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; line-height: normal;"><span style="font-family: 'Verdana','sans-serif';">2. The industry has source the gas supply from M/s GAIL.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; line-height: normal;"><span style="font-family: 'Verdana','sans-serif';">3. The industry has installed odourizer to add smell to the gas in order to detect the leakage of the gas.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; line-height: normal;"><span style="font-family: 'Verdana','sans-serif';">4. The industry has installed DG set of capacity 25 KVA with canopy and in-adequate stack height. The DG set is fueled by PNG.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; line-height: normal;"><span style="font-family: 'Verdana','sans-serif';">5. The industry has provided storage tank for collection of domestic waste water and claims it to be a septic tank however, was failed to show the outlet of the said storage tank.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; line-height: normal;"><span style="font-family: Verdana, 'sans-serif';">Accordingly, the industry was issued show cause notice </span><span style="font-family: Tahoma, 'sans-serif';">for refusal of consent to operate under the provisions of the Air (Prevention & Control of Pollution) Act, 1981 and under the Water (Prevention & Control of Pollution) Act, 1974 alongwith the opportunity of personal hearing before your goodself on 01.02.2023.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; line-height: normal;"><span style="font-family: Tahoma, 'sans-serif'; text-indent: 1in;">Sh. Bharat Bhushan, representative of the industry attended the hearing and submitted that the industry has made compliance and now has provided outlet to the septic tank for the disposal of the treated wastewater into plantation area and has also attached stack height of 03 meters to the DG set fired by PNG. The representative also submitted photographic evidence of the above said claim.</span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: normal;"><span style="font-family: 'Tahoma','sans-serif';">After hearing the officer of the Board and representative of the industry, the Environmental Engineer decided as under:-</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: -22.5pt; line-height: normal; mso-list: l1 level1 lfo3; margin: 0in 0in 6.0pt 1.0in;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The consent to operate may be granted to the unit as per the photographic evidence.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: -22.5pt; line-height: normal; mso-list: l1 level1 lfo3; margin: 0in 0in 6.0pt 1.0in;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The Asst. Environmental Engineer shall visit the site to verify the reply within one month. </span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; line-height: normal;"><span style="font-family: Tahoma, 'sans-serif';">Proceedings of the personal hearing held on 01.02.2023 before Environmental Engineer, Regional Office-4, Ludhiana </span><span style="font-family: Tahoma, 'sans-serif';"> </span><span style="font-family: Tahoma, 'sans-serif';">has been issued vide no. 214 dated 01.02.2023.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; line-height: normal;"><span style="font-family: Verdana, 'sans-serif';">Keeping in view of above, it is recommended that the consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and under the Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 31.12.2026 in consonance with the curtailment date of green category units with suitable conditions.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; line-height: normal;"><strong><span style="font-family: 'Verdana','sans-serif';">The competency to decide the application lies with Environmental Engineer, Regional Office, Ludhiana.</span></strong></p> |
