<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-indent: 70.9pt;"><span style="font-family: 'Verdana',sans-serif; mso-bidi-font-family: Tahoma; background: white;">It is submitted that the industry was given personal hearing before the Chief Environmental Engineer, PBIP on 10.01.2023 wherein representative of the industry submitted reply to the Show Cause Notice vide its letter dated 10.01.2023 and the relevant part of the same is reproduced as under:</span></p>
<p class="MsoNormal" style="text-align: justify; margin: 0cm 0cm 6.0pt 1.0cm;"><span style="font-family: 'Verdana',sans-serif; mso-bidi-font-family: Tahoma; background: white;">“1. The issue of CTO (Varied) needs to be assessed in light of the MoEF&CC notification [vide no. SO 3250(E), dated 20.07.2022, endorsed by the PPCB (vide letter no. 20242-57, dated 23.09.2022].</span></p>
<p class="MsoNormal" style="text-align: justify; margin: 0cm 0cm 6.0pt 1.0cm;"><span style="font-family: 'Verdana',sans-serif; mso-bidi-font-family: Tahoma; background: white;">2. It is humble submission that a considered opinion of the SEIAA, Punjab, may provide a correct direction to the issue viz-a-viz the ground facts.</span></p>
<p class="MsoNormal" style="text-align: justify; margin: 0cm 0cm 6.0pt 1.0cm;"><span style="font-family: 'Verdana',sans-serif; mso-bidi-font-family: Tahoma; background: white;">3. It is requested that the processing of our CTO applications may be put on hold (may be for about 15 days) so that a plausible deliberation may be obtained from the SEIAA, Punjab.”</span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-indent: 70.9pt;"><span style="font-family: 'Verdana',sans-serif; mso-bidi-font-family: Tahoma; background: white;">After hearing the officer of the Board and representative of the industry, as well as considering all the facts of the application, the Chief Environmental Engineer, PBIP decided as under:</span></p>
<p class="MsoListParagraphCxSpFirst" style="mso-add-space: auto; text-align: justify; text-indent: -1.0cm; line-height: 150%; mso-list: l0 level1 lfo1; margin: 0cm 0cm 6.0pt 2.0cm;"><!-- [if !supportLists]--><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Verdana',sans-serif; mso-fareast-font-family: Verdana; mso-bidi-font-family: Verdana;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Verdana',sans-serif; mso-bidi-font-family: Tahoma;">The application of the industry be kept in abeyance for 15 days, as requested by the industry vide its request letter dated 10.01.2023.</span></p>
<p class="MsoListParagraphCxSpLast" style="mso-add-space: auto; text-align: justify; text-indent: -1.0cm; line-height: 150%; mso-list: l0 level1 lfo1; margin: 0cm 0cm 6.0pt 2.0cm;"><!-- [if !supportLists]--><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Verdana',sans-serif; mso-fareast-font-family: Verdana; mso-bidi-font-family: Verdana;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Verdana',sans-serif; mso-bidi-font-family: Tahoma;">Thereafter, the application of the industry shall be considered on merits accordingly.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 54.0pt;"><span style="font-size: 14.0pt; line-height: 107%;">Meanwhile, the industry v</span><span style="font-size: 12.0pt; line-height: 107%;">ide PUC received through e-mail dated 17.01.2023, had requested as under :-</span></p>
<p class="MsoNormal" style="text-align: justify; line-height: normal; margin: 0cm 36.0pt .0001pt 54.0pt;"><em><span style="font-size: 12.0pt;">“1. The industry is having CTOs, which are valid till 31.03.2023. The CTOs are for manufacturing of "tin coated plates" with installed manufacturing capacity of -310 MT/day. The basic raw material includes HR coil (which is cold rolled in-house to produce CR coil @-200 MT/day) and CR coil @-110 MT/day purchased from the market. The CR coil is subjected to electro-chemical tin coating process to produce the end product.</span></em></p>
<p class="MsoNormal" style="text-align: justify; line-height: normal; margin: 0cm 36.0pt .0001pt 54.0pt;"><em><span style="font-size: 12.0pt;">2. The industry was granted CTE (Modernisation) dated 11.08.2020, valid up to 18.06.2021. The modernisation involved replacement of existing CR mill (*4ir) with new CR mill ("6i") and upgradation of supporting auxiliaries and utilities. At that time, no increase in in-house CR production capacity was envisaged due to the proposed modernisation.</span></em></p>
<p class="MsoNormal" style="text-align: justify; line-height: normal; margin: 0cm 36.0pt .0001pt 54.0pt;"><em><span style="font-size: 12.0pt;">3. The '06i"CR mill was got installed, including the supporting infrastructure. It may be worthwhile to mention that the proposed modernisation was achieved much before July 2022. Also, the newly added ETP (which is meant to recirculate 100% of the quench rinse wastewater, which was also commissioned before July 2022. Relevant documents in support of the fact are attached for ready reference.</span></em></p>
<p class="MsoNormal" style="text-align: justify; line-height: normal; margin: 0cm 36.0pt .0001pt 54.0pt;"><em><span style="font-size: 12.0pt;">4. Subsequently, it was observed by the production team that the new CR mill ("6i") can increase in-house CR capacity from -200 MT/day to -310 MT/day. As a consequence, our industrial unit can achieve maximum production capacity of -420 MT/day if upto 110 MT/day of CR coil is externally purchased (the industrial unit already has CTO for external purchase of CR coil @-ll0 MT/day).</span></em></p>
<p class="MsoNormal" style="text-align: justify; line-height: normal; margin: 0cm 36.0pt .0001pt 54.0pt;"><em><span style="font-size: 12.0pt;">5. Summarily, following facts need special attention;</span></em></p>
<p class="MsoNormal" style="text-align: justify; line-height: normal; margin: 0cm 36.0pt .0001pt 54.0pt;"><em><span style="font-size: 12.0pt;">a) There is no deviation/change in plant/machinery from that for which the CTE (Modernisation) was obtained on 11.08.2020</span></em></p>
<p class="MsoNormal" style="text-align: justify; line-height: normal; margin: 0cm 36.0pt .0001pt 54.0pt;"><em><span style="font-size: 12.0pt;">b)<span style="mso-tab-count: 1;"> </span>The CTO is being sought for the existing plant and machinery only, for which the CTE was obtained. The plant/machinery was installed and commissioned much hefore Jaly 2022.</span></em></p>
<p class="MsoNormal" style="text-align: justify; line-height: normal; margin: 0cm 36.0pt .0001pt 54.0pt;"><em><span style="font-size: 12.0pt;">c)<span style="mso-tab-count: 1;"> </span>Because, the new CR mill (6i) can be operated at an increased speed, the cold rolling capacity of the mill increases (resulting in increased overall production). The fact was not anticipated while obtaining the CTE (Modernisation).</span></em></p>
<p class="MsoNormal" style="text-align: justify; line-height: normal; margin: 0cm 36.0pt .0001pt 54.0pt;"><em><span style="font-size: 12.0pt;">d)<span style="mso-tab-count: 1;"> </span>At no point of time, the production has exceeded the capacity stipulated in the existing CTO.</span></em></p>
<p class="MsoNormal" style="text-align: justify; line-height: normal; margin: 0cm 36.0pt .0001pt 54.0pt;"><em><span style="font-size: 12.0pt;">6.<span style="mso-tab-count: 1;"> </span>It is imminent that the present CTO applications are for the manufacturing capacity for which plant and machinery was already in place before Jvly 2022.</span></em></p>
<p class="MsoNormal" style="text-align: justify; line-height: normal; margin: 0cm 36.0pt .0001pt 54.0pt;"><em><span style="font-size: 12.0pt;">7.<span style="mso-tab-count: 1;"> </span>The MoEFCC notification [vide no. SO 3250(E), dated 20.07.2022, endorsed by the PPCB (vide letter no. 20242-57, dated 23.09.20221, has mandated the requirement of "Environmental Clearance" for "cold rolling" based activities, from the MoEFCC/SEIAA.</span></em></p>
<p class="MsoNormal" style="text-align: justify; line-height: normal; margin: 0cm 36.0pt .0001pt 54.0pt;"><em><span style="font-size: 12.0pt;">8.<span style="mso-tab-count: 1;"> </span>Granting us CTOs for the installed production capacity which is achievable due to the existing setup, which was in place prior to July 2022, shall be of great help in furthering the objective of obtaining the 'Environmental Clearance" for the existing setup.</span></em></p>
<p class="MsoNormal" style="text-align: justify; line-height: normal; margin: 0cm 36.0pt .0001pt 54.0pt;"><em><span style="font-size: 12.0pt;">9.<span style="mso-tab-count: 1;"> </span>We shall proceed to obtain the "Environmental Clearance" after obtaining the CTO and shall ensure that the timelines and other conditions regarding obtaining the EC (as stipulated in the above mentioned Notification) are diligently complied.”</span></em></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-indent: 72.0pt;"><span style="font-size: 14.0pt; line-height: 107%;">Since, the issue regarding varied CTO under the Water & Air Act in lieu to the carried out expansion for enhancing the production capacity without obtaining Environment Clearance from the competent authority for the enhanced capacity needs to be clarified/ opined from SEIAA, Punjab; as Environment Clearance is prerequisite for grant of CTO in accordance with PSSTE notification dated 02.03.2022 & policy of the Board dated 30.04.2013 and the matter regarding grant of Environment Clearance falls under the purview of SEIAA, Punjab. After due approval of the competent authority, the request of the industry was forwarded to the SEIAA, Punjab (authority for issuing EC) for obtaining clarification as to whether the said industry can be granted varied consent to operate under the Water Act, 1974 & the Air Act, 1981 for manufacturing of "tin coated plates" with installed manufacturing capacity of 420 MTD considering the same as its existing manufacturing capacity before issuance of MoEF&CC notification dated 20.07.2022.</span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-indent: 72.0pt;"><span style="font-size: 14.0pt; line-height: 107%;">A copy of the said letter as well as the request of the industry is attached for perusal.</span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-indent: 72.0pt;"><span style="font-size: 14.0pt; line-height: 107%;">However, no reply has been received from SEIAA, Punjab till date.</span></p>
