CTOW/Renewal/LDHKH/2019/10417174 dated 09/07/2019 and the Air Act, 1981 vide no. CTOA/Renewal/LDHKH/2019/10417146 dated 09/07/2019, both valid upto 30/09/2023 for Processing of Paddy @ 65 TPD to produce Rice @ 45 TPD <strong>(without drier).</strong> </span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1.0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; mso-ansi-language: EN-US; mso-bidi-language: AR-SA;">Further, the rice sheller has obtained 'consent to establish' (NOC expansion) vide no. CTE/Exp/LDHKH/2022/19890842 dated 21/09/2022, valid upto 10/09/2023 for installation of <strong>mechanical paddy drier of capacity 32 T/batch</strong></span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1.0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; mso-ansi-language: EN-US; mso-bidi-language: AR-SA;">Now, the industry has applied for varied consent to operate under the Water Act, 1974 and the Air Act, 1981 alongwith requisite documents through OCMMS. The rice sheller has deposit Rs. 18500/- vide UTR no. 000131755198 dated 30/01/2023 as Water consent fee and Rs. 19800/- vide UTR no. 000131754498 dated 30/01/2023 as Air consent fee against the fixed assets of Rs. 70.38 Lac as on 20/01/2023 as per CA Certificate dated 20/01/2023. The consent fee is adequate <strong>upto 30/09/2026<span style="color: red;"> </span></strong>as per Board's Office Order dated 29/10/2018. </span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1.0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; mso-ansi-language: EN-US; mso-bidi-language: AR-SA;">Accordingly, the industry was visited by the undersigned alongwith ASO, Air Lab, Head Office, Patiala on <strong>03.02.2023</strong> to collect stack emission sample and found that the industry is in operation. During visit it was observed that: </span></p>
<p class="MsoListParagraphCxSpFirst" style="margin-left: 22.5pt; mso-add-space: auto; text-align: justify; text-indent: -22.5pt; mso-list: l2 level1 lfo5;"><!-- [if !supportLists]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style'; mso-ansi-language: EN-US; mso-bidi-language: AR-SA;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; mso-ansi-language: EN-US; mso-bidi-language: AR-SA;">The rice sheller has installed APCD i.e. cyclone separator with shelling section by connecting all the dust emissions points. Accordingly, stack sample was collected from the stack after APCD and submitted to Head Office, Air lab for analysis.</span></p>

It has installed cyclone separator as APCD with paddy pre cleaner. During visit, drier was not found in operation. </span></p>

<p class="MsoNormal" style="text-align: justify;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; mso-ansi-language: EN-US; mso-bidi-language: AR-SA;"><span style="mso-tab-count: 2;"> </span><span style="mso-spacerun: yes;"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; mso-ansi-language: EN-US; mso-bidi-language: AR-SA;">It is intimated that CPCB has already issued modified directions u/s 18(1)b of the Water Act, 1974 & the Air-Act, 1981 regarding Harmonization of Classification of Industrial sectors under Red/Orange/Green/White categories vide its letter no. B 29012/ESS/CPA/2015-16/85-84 dated 7.3.2016 alongwith the "Final document on revised classification of Industrial sectors under Red, Orange, Green & White categories" which also includes the consent period for which the consents are to be granted to Red, Orange and Green category industries for 5 years, 10 years and 15 years respectively. Further, Board vide Head Office letter no. SEE(HQ-2)/2018/ 9982-10003 dated 27/08/2018 has directed to strictly follow the consent validity criteria for Red, Orange and Green category industries as mentioned in the modified directions issued by CPCB u/s 18(1)b of the Water Act, 1974 & the Air Act, 1981 i.e. consent to Red, Orange and Green category industries may be granted for 5 years, 10 years and 15 years respectively. But, in the subject cited case, the industry has deposited consent fee only <strong>upto 30/09/2026</strong>.</span></p>
<p class="MsoNormal" style="margin-bottom: 12.0pt; text-align: justify; text-indent: 1.0in; line-height: normal; mso-pagination: none; text-autospace: none;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; mso-ansi-language: EN-US; mso-bidi-language: AR-SA;">As per notified master plan of Khanna, the industry is located in non-conforming zone. Also, as per Board’s Office Order no. 21 dated 8/6/2018 (especially for District Ludhiana), wherein, the operated of the said Office Order is as under: “The matter has been considered and it has been decided that the existing industrial units/ establishments, which were established before the notification of the Master Plan of the respective cities shall be allowed consents/ extensions under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 and authorization under the provisions of HWM Rules, 2016 for a period of 15-year from the date of notification of Master Plan after taking concrete documents proof regarding the date of commissioning of such units. No separate approval from local bodies/ other authorities is required to be obtained”. Therefore, the industry can operate its unit only up to year November, 2026 (15 years after the Master Plan is notified).</span></p>
<p class="MsoNormal" style="margin-bottom: 12.0pt; text-align: justify; text-indent: 1.0in; line-height: normal; mso-pagination: none; text-autospace: none;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; mso-ansi-language: EN-US; mso-bidi-language: AR-SA;">Moreover, the Board vide Head Office letter no. 768-97 dated 13/01/2021, decided as under:</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1.0in; mso-pagination: none; tab-stops: 481.5pt; text-autospace: none; margin: .15pt 0in 12.0pt 0in;"><strong><em><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; mso-ansi-language: EN-US; mso-bidi-language: AR-SA;">"The Board shall continue to grant consent to establish/consent to operate to the industries with the advisory to obtain necessary clearance for abstraction of ground water from the Punjab Water Regulation and Development Authority (PWRDA). However, aforesaid clearance shall not be insisted upon by the Board at the time of grant of CTE/CTO to the industries."</span></em></strong></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1.0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; mso-ansi-language: EN-US; mso-bidi-language: AR-SA;">Keeping above in view, if approved, the consent to operate applied under the Water Act, 1974 and the Air Act, 1984 may be granted <strong>upto 30/09/2026</strong> for Processing of Paddy @ 65 Ton/day to produce Rice @ 45 Ton/day <strong>(With drier)</strong> with usual conditions (auto generated) alongwith the following special conditions as under: </span></p>
