Ø  The industry was granted consents to operate under the Water Act, 1974 and under the Air Act,1981 vide nos. CTOW/Renewal/BTI/2022/17965641 & CTOA/Renewal/BTI/2022/17965559 dated 10.02.2022, valid upto 09.02.2023 for operation of brick kiln with Induced draft brick kiln with Zig-Zag firing and manufacturing of BRICKS/TILES @ 30000 Numbers/Day, subject to the conditions mentioned therein and special conditions that: - a)       The brick kiln will make necessary technological modifications suggested by the technical provider in a time bound manner as decided by the PPCB. b)      This consent is granted subject to the orders passed by the Hon'ble High Court for the States of Punjab & Haryana/ Hon'ble National Green Tribunal or Other Judicial Authority in the cases pending or being filed with regard to the operation of brick kilns in the State. c)       This consent is granted subject to the performance evaluation of new technology adopted by the brick kilns. d)      The BKO will obtain Environmental Clearance under EIA notification for mining of brick clay to be used as raw material for the manufacture of bricks and submit the same, within two months. e)      The industry shall comply with code of practice for brick kiln and shall achieve the prescribed standard notified by MOEF & CC. f)        The industry shall not generate/ discharge any trade effluent and shall discharge only Domestic Effluent onto land for plantation after passing through septic tank. Ø  Now, the industry has applied for renewal of consent to operate under the Water Act, 1974 and Air Act, 1981 through OCMMS for operation brick kiln with Induced draft brick kiln with Zig-Zag firing and manufacturing of BRICKS/TILES @ 30000 Numbers/Day under orange category. Ø  The details of the case are as under: - Ø  The kiln has already deposited consent fees of Rs. 14400/- vide online UTR. No. SBIN22028963383 dated 15.10.2020 under Water Act, 1974 and Rs. 12600/- through online UTR. No. SBIN220289623706 dt. 15.10.2020 under the Air Act, 1981 against the fixed asset of Rs. 37.79 lac as per the C.A. certificate dated 29.12.2021, which was adequate up to 30.09.2026 as per the Board's office order dated 29.10.2018 Ø  It is submitted that the Board vide Office Order No. 59 dated 02.02.2016 decided to grant auto renewal of Consent to Operate/ Establish to Orange & Green Category of Industries within 7 days of its application submission without the need of visiting the site/ premises of the industry, in order to facilitate the industry. Ø  As per the record file, the central island length of the brick kiln is more than 245 ft. and as per the existing policy of the Board the brick kiln having central island greater than prescribed length can be granted consent to operate for further one year. Ø  Keeping in view of above, it is recommended that: 1.    Renewal of Consent to operate under the Water Act, 1974 & Air Act, 1981 may be granted to the brick kiln for production of bricks & tiles @ 30,000 no./day under orange category for a period of one year, subject to the suitable conditions along with the following specific conditions: - a)        This consent is granted subject to the orders passed by the Hon'ble High Court for the States of Punjab & Haryana/ Hon'ble National Green Tribunal or Other Judicial Authority in the cases pending or being filed with regard to the operation of brick kilns in the State. b)        This consent is granted subject to the performance evaluation of new technology adopted by the brick kilns. c)         The BKO will obtain Environmental Clearance under EIA notification for mining of brick clay to be used as raw material for the manufacture of bricks and submit the same, within two months. d)        The industry shall comply with code of practice for brick kiln and shall achieve the prescribed standard notified by MOEF & CC. e)        The industry shall not generate/ discharge any trade effluent and shall discharge only Domestic Effluent onto land for plantation after passing through septic tank.
