<p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-bidi-font-style: italic;"><span style="mso-tab-count: 2;"> </span>It was brought out that<strong> </strong>t</span><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">he industry<strong> </strong>was granted 'consent to establish' under the provisions of the Water Act, 1974 & Air Act, 1981 on 14.05.2018 (valid upto 13.05.2019) for incineration of hazardous waste / expired pesticides (liquid) @ 4000 lt/day and hazardous waste / expired pesticides (solid) @ 1 TPD and the validity of NOC was extended upto 13.05.2021.</span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';"><span style="mso-tab-count: 2;"> </span>The industry has obtained environmental clearance for setting up of hazardous waste management plant (incinerator) vide MoEF&CC letter dated 20.09.2019.</span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';"><span style="mso-tab-count: 2;"> </span>The industry was granted consents to operate under Water Act, 1974 & Air Act, 1981 on 14.12.2020 (valid upto 31.03.2022) for incineration through combo waste incinerator for solid & liquid hazardous waste.</span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';"><span style="mso-tab-count: 2;"> </span>The industry has also obtained authorization under the Hazardous and Other Waste (Management & Transboundary Movement) Rules, 2016 on<span style="mso-spacerun: yes;"> </span>24.08.2021 (valid upto 31.03.2022) for hazardous waste Category 29.3 (Date expired and off-specification pesticides)[Solid] @ 365 T/Annum, Category 29.3 (Date expired and off-specification pesticides) [liquid] @ 1460 Kl/Annum, category 33.1 (Empty barrels / containers / liners contaminated with hazardous chemicals / wastes) @ 7200 Number /Annum and category 37.2 (ash from incineration and flue gas cleaning residue) @ 20 T/Annum.</span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';"><span style="mso-tab-count: 2;"> </span>The industry </span><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; color: black; mso-bidi-language: PA;">has applied for obtaining extension in the validity of consents to operate under the Water Act, 1974 & Air Act, 1981.</span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';"><span style="mso-tab-count: 2;"> </span>From the perusal of the documents submitted by the industry, the industry has failed to submit following documents / details:-</span></p>

<p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span lang="EN-IN" style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;"><span style="mso-tab-count: 2;"> </span></span><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">In view of above, the industry has been issued show cause notice before refusal of renewal of consents to operate under the provisions of Water Act, 1974 & Air Act, 1981 alongwith an opportunity of personal hearing before the Chairman on 19.01.2023.</span></p>
<p class="MsoPlainText" style="text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; font-style: normal;">During hearing, Sh. Abhimanyu Goyal, Partner of the industry submitted written reply to the notice issued, which has been taken on record. He further stated that the industry has procured the hazardous waste to be incinerated from M/s Markfed Agro Chemical, Mohali and submitted the details w.r.t. the quantity of hazardous waste procured, record regarding consumption of fuel, six monthly compliance reports of the conditions imposed in the environmental clearance and the record regarding the Online Real-time Continuous Monitoring facility installed at site. He further submitted that since the industry is not in regular operation as such the air emission sampling of the industry could not be carried out. He further assured that the industry is committed to ensure the compliance of the environmental norms at all times. </span></p>
<p class="MsoPlainText" style="text-align: justify; line-height: 150%;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; font-style: normal;"><span style="mso-tab-count: 2;"> </span>After hearing the Partner of the industry and the officers of the Board, the Chairman of the Board decided that the Environmental Engineer, Regional Office, Bathinda shall immediately examine the documents submitted by the industry and process the consent applications applied under Water Act, 1974 & Air Act, 1981 with clear-cut recommendations, within one week. </span></p>
