Thereafter, the project proponent was issued violation notice with the request to apply for consent to establish (NOC) under the provisions of Water (Prevention &amp; Control of Pollution) Act, 1974 and Air (Prevention &amp; Control of Pollution) Act, 1981 within a period of 03 days, failing which, further action will be initiated against the without any further intimation. During the visit, it was observed </span><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">as</span><span style="font-family: 'Tahoma','sans-serif';"> under: </span></p> <p class="MsoListParagraphCxSpFirst" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l3 level1 lfo2;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The project proponent is constructing Highrise buildings having flats of different configuration. </span></p> <p class="MsoListParagraphCxSpLast" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l3 level1 lfo2;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The project proponent has not provided any treatment plant for the treatment of effluent to be generated by the project.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The above violation </span><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">was</span><span style="font-family: 'Tahoma','sans-serif';"> recommended the competent authority through E-noting no. 17774198.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">Thereafter, the project </span><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">proponent</span><span style="font-family: 'Tahoma','sans-serif';"> was issued show cause notice for violation of the provisions of the Water (Prevention &amp; Control of Pollution) Act, 1974 and the Air (Prevention &amp; Control of Pollution) Act, 1981 vide Board's letter no. 1139-40 dated 10/2/2022&nbsp;alongwith an opportunity of personal hearing before the SEE (ZP-1) of the Board on 23/2/2022. But no representative of the project proponent was attending the hearing. </span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">The project proponent was issued notice to issue directions u/s 33-A of the Water Act, 1974 alongwith an opportunity of personal hearing before the Chief Environmental Engineer (P) of the Board on 2/6/2022 vide Board's letter no. 2945-46 dated 16/5/2022. The above personal hearing was postponed due to administrative reason on 13.07.2022 before the Chief Environmental Engineer (P) of the Board. </span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">Thereafter, the project proponent applied for obtaining fresh consent to establish (NOC) from pollution angle under the provisions of the Water (Prevention &amp; Control of Pollution) Act, 1974 and Air (Prevention &amp; Control of Pollution) Act, 1981 for the establishment of Residential Project of 70 residential plots &amp; 16 Commercial Plots and same was processed through OCMMS.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">The project proponent had submitted the certificate of regularization issued by Deputy Director, Patiala vide no. 9530 dated 01.04.2021 subject to suitable terms and conditions. However, the project proponent has not submitted the site classification as per Master Plan, Zirakpur.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">It is appropriate to mention here that the project proponent has applied for development of residential plots. However, as already conveyed, the project proponent is developing highrise buildings having apartments / flats of different configuration. The project proponent has not submitted any detail of built up area of the project. The project proponent needs to submit the revised feasibility report especially w.r.t calculation of the effluent generation load from the project taking into consideration the water supply demand for fixed staff population &amp; floating population in light of National Building Code 2016 - Part 9 Section 4 (Water Supply) &ndash; 4.1 Water Supply Requirement for Buildings &ndash; For Mercantile Buildings) and revised the effluent generation, treatment &amp; disposal, accordingly.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">The project proponent has submitted the agreement signed for the disposal of treated effluent for plantation purpose for 03 acres. However, has not submitted any detail regarding the mode of carrying the treated effluent and have even earmarked on aks sajra plan, so as to evaluate its feasibility. No sewer exists in the vicinity of the project. The project proponent has not submitted any proposal for the installation of Mechanical composter. </span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">Thereafter, the consent to establish (NOC) applied by the project proponent was refused by the Board&rsquo;s letter no. CTE/Fresh/SAS/2022/18197383 dated 19.10.2022 due to various observations mentioned therein.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">The project proponent was given personal hearing before the Chief Environmental Engineer (P) of the Board on 20.09.2022, wherein, it was decided as under:</span></p> <p class="MsoListParagraphCxSpFirst" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l1 level1 lfo3;"><!-- [if !supportLists]--><em><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-ansi-language: EN-IN;">The project proponent shall install an STP of adequate capacity for the total generation of sewage/ domestic effluent generated from the premises of the said project. </span></em></p> <p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l1 level1 lfo3;"><!-- [if !supportLists]--><em><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; Control of Pollution) Act, 1981 alongwith requisite documents as well as adequate proposal for scientific disposal of treated wastewater as mentioned above at Sr. no. 2 and 3. </span></em></p> <p class="MsoListParagraphCxSpLast" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l1 level1 lfo3;"><!-- [if !supportLists]--><em><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-ansi-language: EN-IN;">The Environmental Engineer, Regional Office, SAS Nagar shall visit the site of the project proponent after 10-days to verify the progress made by the project proponent, to verify the compliances and to give comments/ recommendations with respect to the project proponent statement/ claim and shall process the application to be applied by the project proponent on merits.</span></em></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">Thereafter, the project proponent applied for fresh consent to establish (NOC) form pollution angle under the provisions of the Water (Prevention &amp; Control of Pollution) Act, 1974 and Air (Prevention &amp; Control of Pollution) Act, 1981 and same was returned due to various observations mentioned as under:</span></p> <p class="MsoListParagraphCxSpFirst" style="text-align: justify; No. 575768773 dated 20.11.2021 as NOC fee. The fee deposited by the project proponent could not be adjudged as the project proponent has not submitted any proof regarding date of start construction of the project.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">It is appropriate to mentioned there that the detail filled in the application form is incorrect and contradictory to the supporting document submitted by the project proponent i.e technical detail regarding under Water (Prevention &amp; Control of Pollution) Act, 1974 and Air (Prevention &amp; Control of Pollution) Act, 1981.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">Further, the project proponent has applied for development of residential plots. However, as already conveyed, the project proponent is developing highrise buildings having apartments / flats of different configuration. The project proponent has not submitted any detail of built up area of the project so as to adjudge the applicability of EIA notification 14.09.2006. The project proponent needs to submit the revised feasibility report especially w.r.t calculation of the effluent generation load from the project taking into consideration the water supply demand for fixed staff population &amp; floating population in light of National Building Code 2016 - Part 9 Section 4 (Water Supply) &ndash; 4.1 Water Supply Requirement for Buildings &ndash; For Mercantile Buildings) and revised the effluent generation, treatment &amp; disposal, accordingly.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">The project proponent has submitted the agreement signed for the disposal of treated effluent for plantation purpose for 03 acres. However, has not submitted any detail regarding the mode of carrying the treated effluent and hasn&rsquo;t earmarked on aks sajra plan, so as to evaluate its feasibility. No sewer exists in the vicinity of the project. The project proponent has not submitted any proposal for the installation of Mechanical composter. </span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">It is </span><span style="font-family: 'Tahoma','sans-serif';">relevant to mention here </span><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">that the Board vide letter no. SEE(HQ-2)/2022/F.No.82 dated 11.03.2022 has intimated that it has been observed that while filing application for Environment Clearance under EIA notification, 2006, the project proponents proposed to discharge their effluents into public sewer. AT times, the capacity of the STP is not adequate to handle the additional effluents load of such project. For instance, cities like Zirakpur and Kharar have treatment capacity much below the present effluent generation. Despite this, the MCs of these cities are giving NOCs for allowing the outlet of new projects to their sewer. In absence of environmentally sound disposal arrangements, untreated or partial treated effluent is being bypassed from these STPs causing serious environmental damages. In absence of sustainable disposal arrangements, the project proponents, resort to unhealthy practices, like disposal of effluents into the bore wells or for stagnation or to unknown places / drains / roadside / ponds through mobile tankers etc. Further requested State Level Environment Impact Assessment Authority that the Environment Clearance may not be granted for disposal of effluent into public sewer in case the city STPs have not adequate capacity to handle the additional wastewater from such new / expansion projects. There project proponents shall be advised to provide concrete proof for alternate modes of disposal like availability of adequate land for utilizing treated effluents for plantation or to adopt other environmentally sound effluent disposal arrangements. The project proponent needs to submit floor wise built up area of the project so as to adjudge the applicability of EIA notification 14.09.2006.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">Further, it is appropriate to mention here that the authority of the MC, Zirakpur was given personal hearing before the worthy Chairman of the Board on 11.04.2022, as per decision no. (iii) i.e. M.C. Zirakpur be directed not to approve new project plans till necessary infrastructure like sewer / STPs/ disposal mechanism is not put in place with copy to PSLG. The project proponent has not submitted permission regarding additional land for the disposal of treated effluent till the sewer line is not available at project site. Moreover, present STP of MC, Zirakpur is under capacity and is not adequate to handle the additional effluent load of such projects.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">In view of the above, it is recommended that consent to establish (NOC) from pollution angle under the provisions of the Water (Prevention &amp; Control of Pollution) Act, 1974 and Air (Prevention &amp; Control of Pollution) Act, 1981 may be refused and directions u/s 33-A of the Water (Prevention &amp; Control of Pollution) Act, 1974 may be issued please.</span></p>
