It is intimated that the industry is medium scale red category unit. The industry is engaged in manufacturing of Rounds, Square, Hexa & Flat Bars @ 160 MTPD. The industry was earlier granted consent to operate under Water Act, 1974 vide no. CTOW/Renewal/LDH2/2018/7322052 dated 13/04/2018 valid upto 31/03/2023 and under Air Act, 1981 vide no. CTOA/Renewal/LDH2/2018/7306859 dated 13/04/2018 valid upto 31/03/2023 subject to the certain conditions mentioned therein.           Now, the industry has applied for varied of consent to operate under Water Act, 1974 & Air Act, 1981 alongwith requisite documents for manufacturing of product Rounds, Square, Hexa and Flat Bars @ 330 MTPD. The industry has submitted in writing that the production capacity has increase only due to increase in working hours i.e. single shift to double shift. There is no increase in polluting machinery. The industry has submitted the details of non-polluting machinery added and has deposited NOC regularization fees for the same.           The site of industry was visited by the AEE of this office on 03.01.2023 and it was observed as under :- 1.    The industry was not in operation during the visit. 2.    The industry has installed 2 no. of pusher type reverberatory rolling furnaces. The industry has dual provision of using coal as well as furnace oil. The industry has provided multicyclone followed by wet scrubber with each of its furnace. 3.    The air emission samples of reverberatory furnace was collected by this office on 23.08.2022 & the SPM level 82 mg/NM3 which is within prescribed limits of the Board. Further, the industry has provided energy meter on both the APCDs and record is being maintained properly. 4.    The industry has also installed 1 electric and 2 diesel fired annealing furnaces with adequate stacks. 5.    The industry has also installed 2 no. D.G. sets of capacity @ 125KVA & 250 KVA, fitted with canopy. 6.    There is no trade effluent generation and only domestic effluent is discharged into sewer. Entire cooling water is being re-circulated. 7.    The industry is complying with the conditions of consents granted to it. 8.    The gross fixed assets of the industry have been increased from Rs. 1509.01/- Lacs to Rs 1923.27 Lacs from 31.03.2022 to 31.03.2023. The industry has given the detail of machinery/assets added. The industry has deposited Rs. 14400 as NOC regularization fees . The site of the industry falls in industrial zone, hence it can be regularized.   MoEF vide notification dated 20.07.2022 has issued following directions for reheating/rerolling units :-   "The Central Government is of the view that steel re-rolling operations fall under the purview of the secondary metallurgical processing industry and require Environment Clearance as per item 3(a), relating to Metallurgical Industries (Ferrous and Non-ferrous), of the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), vide notification number S.O. 1533 (E), dated the 14th September, 2006, mandating the requirement of prior environmental clearance for the projects covered in its Schedule (hereinafter referred to as the said notification), wherein all non–toxic secondary metallurgical processing units with capacities greater than 5000 tonnes/annum (TPA) fall under category B;   Now, therefore, in exercise of the powers conferred by section 3 of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby directs that all the standalone re-rolling units or cold rolling units, which are in existence and in operation as on the date of this notification, with valid Consent to Establish (CTE) and Consent to Operate (CTO) from the concerned State Pollution Control Board or the Union territory Pollution Control Committee, as the case may be, shall apply online for grant of Terms of Reference (ToR) followed by Environment Clearance and the said units shall be granted Standard Terms of Reference as per item 3(a) of the said notification and shall be exempted from the requirement of public consultation: Provided that the application for the grant of ToR shall be made within a period of one year from the date of this notification.   The industry in its application form has mentioned that its production capacity is 330 TPD and considering 350 days of standard operation for rolling mill in one year, 100000 Tons of re-rolling capacity is generated by the industry. As such the industry is covered under the purview of EIA Notification, 2006 as per the above mentioned notification and has to obtain environmental clearance under category B. However, as per above notification the industry has to apply for ToR followed by the EC within a period of one year from above notification.   As such it is recommended the consent to operate under Water Act, 1974 and Air Act, 1981 may be granted to the industry for short term of one year with special condition that :-   1.    The industry shall apply online for grant of Terms of Reference (ToR) followed by Environment Clearance as required under EIA Notification, 2006 and in accordance with MoEF notification no. S.O. 3250(E) dt 20.7.2022 within one month.   2.    The extension of consent to operate under Water Act, 1974 & Air Act, 1981 shall only be considered after the obtaining of EC under the above mentioned provisions by the industry.
