Earlier the project proponent had applied </span><span lang="EN-IN" style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-bidi-font-weight: bold;">for obtaining fresh consent to establish (NOC) under Water Act, 1974 & Air Act, 1981 </span><span lang="EN-IN" style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman';">for the production of fabric dyeing @ 5.0 T/day with discharge of trade effluent @ 400.0 KLD into CETP and domestic effluent @ 3.5 KLD onto land for plantation on 04.04.2022. Accordingly the show cause notice<span style="color: red;"> </span>for refusal of ‘consent to establish’/NOC under the Water Act, 1974 and Air Act, 1981 with the opportunity of personal hearing before Senior Environmental Engineer, Zonal Office-II, Ludhiana on 24.05.2022 was issued to the industry. During the hearing following decisions were taken:- </span></p>
<p class="MsoListParagraphCxSpFirst" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l1 level1 lfo3;"><!-- [if !supportLists]--><span lang="EN-IN" style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-IN" style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman';">Meantime, the application submitted by the industry for obtaining fresh 'consent to establish'/NOC under the Water Act, 1974 and Air Act, 1981 may not be considered and be returned.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l1 level1 lfo3;"><!-- [if !supportLists]--><span lang="EN-IN" style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-IN" style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman';">The industry may re-apply for obtaining NOC under the Water Act, 1974 and Air Act, 1981 after obtaining clarification from Company Secretary.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l1 level1 lfo3;"><!-- [if !supportLists]--><span lang="EN-IN" style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-IN" style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman';">The industry shall not carry out any construction activity and install machinery without obtaining NOC of the Board.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 0in; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: 1.5in; line-height: 150%;"><span lang="EN-IN" style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman';">In compliance of the above said decisions the application of the industry was returned on 25.05.2022.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 0in; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: 1.5in; line-height: 150%;"><span lang="EN-IN" style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman';">Thereafter the project proponent had again applied </span><span lang="EN-IN" style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-bidi-font-weight: bold;">for obtaining fresh consent to establish (NOC) under Water Act, 1974 & Air Act, 1981 and the application was processed by this office. Accordingly the industry was issued </span><span lang="EN-IN" style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman';">show cause notice for refusal of ‘consent to establish’/NOC under the Water Act, 1974 and Air Act, 1981 with the opportunity to submit the reply within 03 days vide no. 7110 dated 22.11.2022. <span style="mso-spacerun: yes;"> </span>In reply of the SCN, the industry had submitted online reply vide its letter dated 30.11.2022 stating that<em>, “Our industry shall carry out the dyeing of polyester & PC fabrics only. We shall not carry out the dyeing of cotton fabric inside our industrial unit. Polyester/PC garments generate less pollutant in the effluent as compared to the cotton. Further we shall also install an equalization tank inside the unit to equalize the effluent for the dilution of dyeing effluent discharge as well as washing batch discharge before discharging our effluent into the sewer of CETP. The equalization/mixing of dyeing batch and washing batch shall reduce the concentration of pollutants in the effluent &shall not cause the extra load on the CETP. It is further submitted that the SPV has also installed DAF system at the CETP for improving the quality of treated water & SPV is further doing efforts for the betterment of CETP. It is also requested that we shall comply with the CETP/inlet standards of untreated effluent if PPCB prescribes such standard in future.”</em> <span style="mso-spacerun: yes;"> </span>But the reply submitted by the industry was not found satisfactory and the application was again refused vide no. CTE/Fresh/LDH3/2023/19839071 dated 06.01.2023.</span></p>

<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><span lang="EN-IN" style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman';"><span style="mso-spacerun: yes;"> </span>The proposed site was visited by the officer of this office on 04.02.2023 and observed that:-</span></p>

The industry has now submitted a No Objection Certificate from SPV for changing the name vide SPV’s letter no. BKTK/CETP/04/13 dated 15.04.2022 as the proprietor of the firm is same. </span></p>

Hence, the site is suitable to set up the proposed unit at site.</span></p>

During the hearing, the industry was asked to submit the </span><span lang="EN-IN" style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman';">clarification from Company Secretary</span><span lang="EN-IN" style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-bidi-language: PA;"> regarding the proprietorship of the both firms but now the project proponent has submitted a certificate from the CA stating that, “Mr. Vikas Gupta is proprietor of is the proprietor of M/s Aadi Knit Fab, Kali sarak, Anand Puri Ludhiana. He is also the proprietor of his another business under the name of Inaaya International, Bahadurke Road, Ludhiana.” instead of the Company Secretary. The project proponent submitted that their unit is not a Pvt. Ltd. firm so they don’t have any Company Secretary. </span></p>
<p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><span lang="EN-IN" style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';"> </span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 0in; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: .5in; line-height: 150%;"><span lang="EN-IN" style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';"><span style="mso-spacerun: yes;"> </span>It is pertinent to mention here that a meeting was taken by the Hon’ble Chairman of the Board on 09.03.2021 with the Management Representative of the SPV for CETP of capacity 15 MLD located at Bahadurke Road, Ludhiana regarding allocation of shares, at Committee Room, Head Office, Patiala. During the meeting various decisions were taken by the Competent Authority of the Board including that the shares allotted to M/s Aadi Knit fab @ 400 KLD were cancelled. But later on Board has decided to kept the above said orders in abeyance till further orders vide Board’s letter no. 13968-70 dated 22.06.2021.<span style="background: white;"> Thereafter a meeting was taken by the Chairman of the Board on 08.10.2021 with the representative of SPV for 15 MLD CETP located at Bahdurke Road, Ludhiana at Committee Room, Pushpa Gujral Science City, Kapurthala. During the meeting following decisions were taken:-</span></span></p>

<p class="MsoListParagraphCxSpMiddle" style="margin-left: .75in; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><span lang="EN-IN" style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; background: white;"> </span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 0in; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: .5in; line-height: 150%;"><span lang="EN-IN" style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; background: white;"><span style="mso-spacerun: yes;"> </span>The compliance of the above said decisions were sent to the Competent Authority of the Board vide E-office no. 95339 dated 14.12.2021. Thereafter the Competent Authority of the Board vide note dated 15.02.2022 has decided to regularize the existing discharge effluent as per the allotment of shares and grant varied consents to the members of the SPV in<span style="mso-spacerun: yes;"> </span>view of the fact that the Board has already imposed environmental compensation to regularize the existing discharge of the member industries. </span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 0in; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><span lang="EN-IN" style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; background: white;"><span style="mso-tab-count: 1;"> </span>In view of above, it is recommended that the </span><span lang="EN-IN" style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-bidi-font-weight: bold;">consent to establish (NOC) under Water Act, 1974 & Air Act, 1981 may be granted to the industry for the period of one year with the suitable conditions and special conditions that:-</span></p>
<p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l2 level1 lfo5;"><!-- [if !supportLists]--><span lang="EN-IN" style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-IN" style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-bidi-font-weight: bold;"><span style="mso-spacerun: yes;"> </span>The industry shall not commission its process without obtaining consents to operate of the Board.</span></p>

<p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l2 level1 lfo5;"><!-- [if !supportLists]--><span lang="EN-IN" style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-IN" style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-bidi-font-weight: bold;">The industry shall also construct equalization tank of adequate capacity inside the premises to manage the quantum of discharge and to equalize the effluent from all baths.</span></p>
<p class="MsoListParagraphCxSpLast" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l2 level1 lfo5;"><!-- [if !supportLists]--><span lang="EN-IN" style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">4.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-IN" style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-bidi-font-weight: bold;">The industry shall make adequate arrangements to minimize the consumption of fresh water. </span></p> |
