(civil) no. 375/2012 titled as Parayavarn Surakhsha Sammitti &amp; Anr. Vs. Union of India &amp; Ors. before the National Green Tribunal vide order dated 19.02.2019 for assessing environmental compensation and action plan to utilize the fund the criteria of as under:- </span></p> <p class="MsoNormal" style="text-align: justify;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';">EC = PI X N X R X S X LF </span></p> <p class="MsoNormal" style="text-align: justify;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';">Where PI is calculated as per &ldquo;the industrial sectors have been categorized into Red, Orange and Green, based on their Pollution Index in the range of 60 to 100, 41 to 59 and 21 to 40, respectively. </span></p> <p class="MsoNormal" style="text-align: justify;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';">It was suggested that the average pollution index of 80, 50 and 30 may be taken for calculating the Environmental Compensation for Red, Orange and Green categories of industries, respectively.&rdquo; </span></p> <p class="MsoNormal" style="text-align: justify;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';">The industry is a large scale red category unit situated at, as such the various factors in this case could be considered as: </span></p> <p class="MsoNormal" style="text-align: justify;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';">PI= 60</span></p> <p class="MsoNormal" style="text-align: justify;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';">N= 42 (from the date of violation observed for the first time i.e. 10.08.2022 upto the date of visit on which industr was found to be complying 20.09.2022.) </span></p> <p class="MsoNormal" style="text-align: justify;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';">R= 250 </span></p> <p class="MsoNormal" style="text-align: justify;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';">S= 0.5 </span></p> <p class="MsoNormal" style="text-align: justify;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';">LF= 1.25 </span></p> <p><span style="font-family: Tahoma, 'sans-serif'; font-size: 12pt; text-align: justify;">EC = PI X N X R X S X LF = 40 X 42 X 250 X 0.5 X 1.25 = Rs. 2,62,500/-..</span></p> <p><span style="font-family: Tahoma, 'sans-serif'; font-size: 12pt; text-align: justify;">It is pertinent to mention here that the industry is a tiny scale unit carrying out electroplating on job basis.
