Bhagwanpura, Tehsil Amloh, Distt. Fatehgarh Sahib was granted 'consent to operate' under the Water (Prevention &amp; Control of Pollution) Act, 1974 vide no. CTOW/Fresh/FGS/2022/17304376 dated 23/02/2022 and under Air (Prevention &amp; Control of Pollution) Act, 1981 vide no. CTOA/Fresh/FGS/2022/17078363 dated 23/02/2022 both valid upto 22/08/2022 for the manufacturing of Zinc Sheets/Ingots @ 3600 MTA using raw material as APCD Dust (Category 35.1)@12000 MTA (36 TPD) and Ammonia Water 3500 MTA with suitable conditions.</span></p> <p class="MsoNormal" style="text-align: justify; text-indent: 1.0in; line-height: 115%;"><span lang="EN-IN" style="font-size: 11.0pt; line-height: 115%; mso-bidi-font-family: Tahoma;">M/s Madhav Alloys Ltd. (Waste Recycling Division) and M/s Madhav KRG Environmental Solutions Private Limited were given personal hearing before the Chairman of the Board u/s 5 of Environment (Protection) Act, 1985 on 18/05/2022 for violations of the provisions Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016. After hearing, the Chairman of the Board decided as under-</span></p> <p class="MsoNormal" style="text-align: justify; text-indent: 56.7pt; line-height: 115%;"><span lang="EN-IN" style="font-size: 11.0pt; line-height: 115%; mso-bidi-font-family: Tahoma;">In the case of M/s Madhav Alloys Ltd. (Waste Recycling Division) Environmental Compensation (EC) amounting to Rs. 3.00 lakhs be imposed for violations of the provisions of Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016. The industry has submitted EC of 3 Lacs in the Board vide R no. 77/5486 dated 20.06.2022.</span></p> <p class="MsoNormal" style="text-align: justify; text-indent: 56.7pt; line-height: 115%;"><span lang="EN-IN" style="font-size: 11.0pt; line-height: 115%; mso-bidi-font-family: Tahoma;">In the case of M/s Madhav KRG Environmental Solutions Private Limitedwhich was operating without having authorization under Hazardous and Other Waste (Management and Trans-boundary) Rules, 2016 and actual user certificate, the Board has imposed Environmental Compensation of Rs. 4.5 lac for violation of the provision of HOWM Rules, 2016. The industry has submitted EC of Rs. 4.5 Lacs vide R no. 75/5487 dated 20.06.2022.</span></p> <p class="MsoNormal" style="text-align: justify; text-indent: 56.7pt; line-height: 115%;"><span lang="EN-IN" style="font-size: 11.0pt; line-height: 115%; mso-bidi-font-family: Tahoma;">The Board had also found that the industry had stored thousand of bags illegally in a godown at Khanna and accordingly notice u/s -5 of EPA Act,1986 was issued. The industry was given personal hearing before the Chairman of the Board on 01/09/2022 wherein it was decided as under:</span></p> <p class="MsoListParagraph" style="text-align: justify; text-indent: -27.0pt; line-height: 115%; mso-list: l2 level1 lfo3;"><!-- [if !supportLists]--><span lang="EN-IN" style="font-size: 11.0pt; line-height: 115%; mso-fareast-font-family: Tahoma; mso-bidi-font-family: Tahoma;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span lang="EN-IN" style="font-size: 11.0pt; line-height: 115%; mso-bidi-font-family: Tahoma;">The industry shall shift the waste from the present location to M/s Madhav KRG Environmental solution pvt. Ltd., by 30/10/2022 as per the request made by the industry and will not dispose off/sell the same in illegal manner. Environmental Compensation (EC) of Rs. 10 lakh/month shall be imposed w.e.f. 01/11/2022 onwards till the entire HW is lifted from the said location in an environmentally sound manner.</span></p> <p class="MsoListParagraph" style="text-align: justify; text-indent: -27.0pt; line-height: 115%; mso-list: l2 level1 lfo3;"><!-- [if !supportLists]--><span lang="EN-IN" style="font-size: 11.0pt; line-height: 115%; mso-fareast-font-family: Tahoma; mso-bidi-font-family: Tahoma;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span lang="EN-IN" style="font-size: 11.0pt; line-height: 115%; mso-bidi-font-family: Tahoma;">As the violations are of the severe nature, affecting the environment to the far-reaching extent; the industry (M/s Madhav KRG Environmental Solution Pvt. Ltd.,) shall deposit EC of Rs. 50 lakh within 7 days for the violations of the provisions of HWM Rules, 2016.</span></p> <p class="MsoNormal" style="text-align: justify; text-indent: 70.9pt;"><span lang="EN-IN" style="font-size: 11.0pt; mso-bidi-font-family: Tahoma;">The decisions were conveyed to the industry vide Board&rsquo;s letter no. 2641 dated 20/09/2022 for ensuring compliance. Thereafter &nbsp;vide Board&rsquo;s letter no. 2641 dated 20/09/2022, Board&rsquo;s letter no. 2696 dated 27/09/2022 ,letter number2968 dated 30.9.2022 the industry was asked to submit compliance to the decision of the hearing. The matter was also perused telephonically and the industry has submitted reply letter addressed to Chairman of the Board. The industry in its reply dated 18/10/2022 has requested &nbsp;to shift the dust from present location to M/s Madhav KRG Environmental Solutions Pvt. Ltd by 30/11/2022 in place of current time line 30/11/2022 and has also requested that due to liquidity crunch because of festival season they require one month time upto 30/11/2022 to deposited EC. </span></p> <p class="MsoNormal" style="text-align: justify; text-indent: 70.9pt;"><span lang="EN-IN" style="font-size: 11.0pt; mso-bidi-font-family: Tahoma;">The industry has not deposited EC of Rs. 50 lacs till date therefore it has failed to comply with the decisions of the hearing. The matter w.r.t taking action under the provisions of EPA Act,1986 is being processed separately through e-office.</span></p> <p class="MsoNormal" style="text-align: justify; text-indent: 70.9pt;"><span lang="EN-IN" style="font-size: 11.0pt; mso-bidi-font-family: Tahoma;">Thereafter, the industry was given personal hearing by the Chairman of the Board on 29/09/2022<span style="mso-spacerun: yes;">&nbsp;&nbsp; </span>and after hearing it was decided as under:</span></p> <p class="MsoListParagraphCxSpFirst" style="margin-bottom: 10.0pt; mso-add-space: auto; text-align: justify; text-indent: -27.0pt; line-height: 115%; mso-list: l0 level1 lfo2;"><!-- [if !supportLists]--><span lang="EN-IN" style="font-size: 11.0pt; line-height: 115%; mso-fareast-font-family: Tahoma; mso-bidi-font-family: Tahoma;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span lang="EN-IN" style="font-size: 11.0pt; line-height: 115%; mso-bidi-font-family: Tahoma;">The industry shall attend all the observations as observed during the visit dated 05/07/2022 by the officer of the Board and submit compliance report at the Regional Office within 07 days.</span></p> <p class="MsoListParagraphCxSpMiddle" style="margin-bottom: 10.0pt; mso-add-space: auto; text-align: justify; text-indent: -27.0pt; line-height: 115%; mso-list: l0 level1 lfo2;"><!-- [if !supportLists]--><span lang="EN-IN" style="font-size: 11.0pt; line-height: 115%; mso-fareast-font-family: Tahoma; mso-bidi-font-family: Tahoma;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span lang="EN-IN" style="font-size: 11.0pt; line-height: 115%; mso-bidi-font-family: Tahoma;">The industry shall not operate the unit without getting consents to operate under the Water (Prevention &amp; Control of Pollution) Act, 1974 and the Air (Prevention &amp; Control of Pollution) Act, 1981 as well as <a name="_Hlk127224080"></a>authorization under the Hazardous and Other Wastes (Management, and Trans-boundary Movement) Rules, 2016<span style="mso-spacerun: yes;">&nbsp; </span>alongwith Actual user certificate-cum-red passbook form the Board.</span></p> <p class="MsoListParagraphCxSpLast" style="margin-bottom: 10.0pt; mso-add-space: auto; text-align: justify; text-indent: -27.0pt; line-height: 115%; mso-list: l0 level1 lfo2;"><!-- [if !supportLists]--><span lang="EN-IN" style="font-size: 11.0pt; line-height: 115%; mso-fareast-font-family: Tahoma; mso-bidi-font-family: Tahoma;"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span lang="EN-IN" style="font-size: 11.0pt; line-height: 115%; mso-bidi-font-family: Tahoma;">It was made clear to the industry, if the industry fails to comply with aforesaid decisions and any Environmental Law will invite strict action, which include imposition of Environmental Compensation.</span></p> <p class="MsoNormalCxSpFirst" style="margin-bottom: 10.0pt; mso-add-space: auto; text-align: justify; line-height: 115%;"><span lang="EN-IN" style="font-size: 11.0pt; line-height: 115%; mso-bidi-font-family: Tahoma;"><span style="mso-tab-count: 2;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span>In compliance to the decision of the hearing, the industry had applied for obtaining authorization under the Hazardous and Other Wastes (Management, and Trans-boundary Movement) Rules, 2016<span style="mso-spacerun: yes;">&nbsp; </span>alongwith Actual user certificate-cum-red passbook form the Board. In compliance to the decision of the hearing the industry was visited by the undersigned on 17/11/2022 . During the visit it was observed that the industry was not in operation. The application was processed and recommendations were sent to higher authorities. At that time the industry had applied for CTOs under said Acts but the applications were returned at scrutiny level due to incompletion.</span></p> <p class="MsoNormalCxSpMiddle" style="margin-bottom: 10.0pt; mso-add-space: auto; text-align: justify; line-height: 115%;"><span lang="EN-IN" style="font-size: 11.0pt; line-height: 115%; mso-bidi-font-family: Tahoma;"><span style="mso-tab-count: 2;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span>The industry has now again applied for CTOs under said Acts but in compliance to special condition of previous CTO<span style="mso-spacerun: yes;">&nbsp; </span>granted , it has not submitted&nbsp;adequacy certificate from PSCST, Chandigarh for its APCD attached to Zinc melting furnace. Clarification was raised on the application seeking documents and fees.</span></p> <p class="MsoNormal" style="text-align: justify;"><span lang="EN-IN" style="font-size: 11.0pt; mso-bidi-font-family: Tahoma;"><span style="mso-tab-count: 2;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span>Meanwhile, a compliant against the industry was received through e-mail dated 02/02/2023 from Sh. Satinder Paul that the said unit is creating air pollution, which is creating irritation in eyes and heavy dust from crusher is creating breathing problems. </span></p> <p class="MsoNormal" style="text-align: justify;"><span lang="EN-IN" style="font-size: 11.0pt; mso-bidi-font-family: Tahoma;"><span style="mso-tab-count: 2;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span>To verify the contents of the complaint, the compliant site was visited by the undersigned on 07/02/2023 and contacted Sh. Satinder Paul, complainant at site. The complaint site is a small scale industrial unit (Virgin Plastic moulding unit) and Sh. Satinder Paul is the owner of the unit. He informed that some chemicals are released in the atmosphere from the industry, which causes eye irritation and the workers working in their unit are facing lot of problems. Further, the dust is being generated<span style="mso-spacerun: yes;">&nbsp; </span>from the crushing equipment&rsquo;s installed by the subject cited industry is also causing lot of air pollution, thereby creating unhealthy environment for them &amp; their workers. </span></p> <p class="MsoNormal" style="text-align: justify;"><span lang="EN-IN" style="font-size: 11.0pt; mso-bidi-font-family: Tahoma;"><span style="mso-tab-count: 2;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span>During visit, while standing at the complaint site no air pollution/eye irritation from the subject cited unit could be sensed and emissions being generated from the unit especially through it stack could be seen going into the atmosphere and not affecting the complaint site. But, the representative insisted that at present although the problem is not seen, but they are facing regular issues of eye irritation and dust pollution at different hours in the day. The representatives of the subject cited industry Sh. Amit and Sh. Jagdeep were called at the complaint site and were made aware about the complaint/ issue being faced by the complainants. The complainant, through telephone, is regularly intimating/ complaining about the problem of eye irritation of chemicals released by the industry. <span style="mso-spacerun: yes;">&nbsp;</span></span></p> <p class="MsoNormal" style="text-align: justify;"><span lang="EN-IN" style="font-size: 11.0pt; mso-bidi-font-family: Tahoma;"><span style="mso-tab-count: 2;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span>Thereafter, the Zinc Waste Re-cycling unit was visited by the undersigned and contacted Sh. Munish, Plant Manager alongwith Sh. Amit &amp; Sh. Jagdeep at site. During visit, it was observed as under:</span></p> <p class="MsoListParagraph" style="text-align: justify; text-indent: -27.0pt; mso-list: l1 level1 lfo1;"><!-- [if !supportLists]--><span lang="EN-IN" style="font-size: 11.0pt; mso-fareast-font-family: Tahoma; mso-bidi-font-family: Tahoma;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span lang="EN-IN" style="font-size: 11.0pt; mso-bidi-font-family: Tahoma;">The industry was in operation. </span></p> <p class="MsoListParagraph" style="text-align: justify; text-indent: -27.0pt; mso-list: l1 level1 lfo1;"><!-- [if !supportLists]--><span lang="EN-IN" style="font-size: 11.0pt; mso-fareast-font-family: Tahoma; mso-bidi-font-family: Tahoma;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span lang="EN-IN" style="font-size: 11.0pt; mso-bidi-font-family: Tahoma;">The industry has provided 3 no. calcinations chambers and minor leakages were observed in one calcinations chamber, from where emissions were coming out. Major<span style="mso-spacerun: yes;">&nbsp; </span>emissions from the chamber were being conveyed to wet scrubber followed by mist eliminator, which were in operation. The rep. of the industry informed that Zn melting furnace is about 10 T/heat capacity.The industry has provided spark arrestor followed by bag filter as APCD with furnace, which was in operation. The industry uses liquid ammonia (2 no. liquied ammonia tanks kept near the re-circulation tank) to neutralize the pH of effluent generated from electrowining section and ammonia is injected in the re-circulation tank made in open. The electrowinning section is kept in enclosed shed and an arrangement has been provided to collect the emissions from this area and convey it to water scrubber as APCD. The machinery is not kept inside any closed building and/or no APCD has been provided to control dust generation from the operation of the said machinery. It is apprehended that the problem of dust pollution is from this activity being undertaken by the industry. The rep informed that the rain water shall be used in case of fire emergency. It was observed that pond was having effluent stored in it despite the fact that there has been no rains in the recent past. In effluent stored said pond is green in colour and also the said effluent has percolated in the adjoining kutcha land for stagnation. The green colour may be due to the presence of nitrogen in ammonia solution and which further helps in promotion of algae growth. In addition to this the same greenish effluent was lying stagnant outside the unit along the roadside and a pipeline is observed coming from inside the unit having its opening near the outer wall.
