CTOW/Renewal/SAS/2018/8486531 dated 27/11/2018, which had expired on </span><strong style="mso-bidi-font-weight: normal;"><span style="font-family: 'Bookman Old Style','serif';">30/09/2022 </span></strong><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-weight: bold;">and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/SAS/2018/8514848 dated 12/10/2018, which is valid upto </span><strong style="mso-bidi-font-weight: normal;"><span style="font-family: 'Bookman Old Style','serif';">30/09/2023</span></strong><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-weight: bold;">, for production of Moulded Furniture & Material Handling Crates @ 30 MTD Plastic Sheet @ 10 MTD, subject to certain condition as mentioned therein. </span></p>
<p class="MsoListParagraphCxSpFirst" style="margin: 0in; margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-weight: bold;">Thereafter, the industry was issued show cause notice u/s 33-A of Water (Prevention & Control of Pollution) Act, 1974 along with an opportunity of personal hearing before the Chief Environmental Engineer (P) on 17.11.2022, wherein, it was decided as under:</span></p>
<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -27.0pt; line-height: 150%; mso-list: l1 level1 lfo1; margin: 0in 0in .0001pt 76.5pt;"><!-- [if !supportLists]--><span style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style'; mso-bidi-font-weight: bold;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-weight: bold;">On the bases of best assessment and judgment, an environmental compensation of Rs. 50,000/- is imposed to the project proponent. The project proponent shall immediately deposit Rs. 50,000/- as environmental compensation within one week in the office of Environmental Engineer, Regional Office, SAS Nagar.</span></p>

<p class="MsoNoSpacing" style="text-align: justify; text-indent: 70.9pt; line-height: 150%; margin: 0in .2pt 12.0pt 0in;"><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-weight: bold;">It is worth to mention here that the industry has deposited a Bank Guarantee as Rs. 1.0 Lakh vide bank guarantee no. 004BG01203110001 dated 06.11.2020, which is valid upto 06.11.2023.</span></p>
<p class="MsoNoSpacing" style="text-align: justify; text-indent: 70.9pt; line-height: 150%; margin: 0in .2pt 6.0pt 0in;"><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-weight: bold;">Now, the industry has applied for obtaining renewal of ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 for manufacturing of Moulded Furniture & Material Handling Crates @ 30 MTD Plastic Sheet @ 10 MTD as products.</span></p>
<p class="MsoNoSpacing" style="text-align: justify; text-indent: 70.9pt; line-height: 150%; margin: 0in .2pt 12.0pt 0in;"><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-weight: bold;">As per the record file, the earlier fee deposited by the industry is adequate upto 30.09.2023. Now, the industry has deposited additional fee of Rs. 30,000/- vide R. no. 26/5462 dated 13.09.2022 and Rs. 57400/- vide R. no. 145397686 dated 20.01.2023 under the Water (Prevention & Control of Pollution) Act, 1974, which is adequate upto 30.09.2023 for both the Acts against the fixed assets of Rs. 7775.86 lakhs on 31.03.2022 (considering NOC regularization fee of Rs. 42000/- and late fee penalty of Rs. 8400/-). </span></p>
<p class="MsoNoSpacing" style="text-align: justify; text-indent: 70.9pt; line-height: 150%; margin: 0in .2pt 6.0pt 0in;"><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-weight: bold;">While processing the application of the industry, following clarifications were raised through online system:</span></p>
<p class="MsoNoSpacing" style="text-align: justify; text-indent: -22.5pt; line-height: 150%; mso-list: l0 level1 lfo2; margin: 0in 40.5pt .0001pt 1.25in;"><!-- [if !supportLists]--><em><span style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span></em><!--[endif]--><em><span style="font-family: 'Bookman Old Style','serif'; background: white;">The industry has mentioned the value of both, total cost of project as well as cost of plant and machinery as Rs. 77.75 cr., which is not in order. </span></em></p>
<p class="MsoNoSpacing" style="text-align: justify; text-indent: -22.5pt; line-height: 150%; mso-list: l0 level1 lfo2; margin: 0in 40.5pt .0001pt 1.25in;"><!-- [if !supportLists]--><em><span style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span></em><!--[endif]--><em><span style="font-family: 'Bookman Old Style','serif'; background: white;">The industry was granted previous ‘Consent to Operate’ for total cost of Rs. 44.33 cr. and now the industry has submitted CA Certificate mentioning the total value of assets as Rs. 77.75 cr. as such, the industry is required to clarify regarding the reasons for increase in the value of assets of the unit.</span></em></p>
<p class="MsoNoSpacing" style="text-align: justify; text-indent: -22.5pt; line-height: 150%; mso-list: l0 level1 lfo2; margin: 0in 40.5pt .0001pt 1.25in;"><!-- [if !supportLists]--><em><span style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span></em><!--[endif]--><em><span style="font-family: 'Bookman Old Style','serif'; background: white;">Further, the industry is also required to deposit corresponding consent to establish NOC regularization fee for increase in the value of assets. </span></em></p>

However, previous ‘consent to operate’ was granted to the industry for total land area of 26700 sq.mtr. and total built up area 8700 sq.mtr. as such, the industry is required to clarify regarding the same as to whether they have increased total area and built up area of the unit or not and give details of the same.</span></em></p>

<p class="MsoNoSpacing" style="text-align: justify; text-indent: 70.9pt; line-height: 150%; margin: 0in .2pt 12.0pt 0in;"><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-weight: bold;"><span style="mso-spacerun: yes;"> </span>Now, the industry has submitted its written reply, which is attached in agenda note.</span></p>
<p class="MsoNoSpacing" style="text-align: justify; text-indent: 70.9pt; line-height: 150%; margin: 0in .2pt 6.0pt 0in;"><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-weight: bold;">The industry has submitted a copy of building plan approved by Director of Factories, Punjab vide letter no. DOF190733081 dated 19.07.2019.</span></p>

<p class="MsoNoSpacing" style="text-align: justify; text-indent: 70.9pt; line-height: 150%; margin: 0in .2pt 6.0pt 0in;"><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-weight: bold;">Accordingly, the site of the industry was visited by the AEE of this office on 11.01.2023, during visit, it was observed as under:</span></p>
<p class="MsoNoSpacing" style="text-align: justify; text-indent: -22.5pt; line-height: 150%; mso-list: l0 level1 lfo1; margin: 0in .2pt .0001pt 22.5pt;"><!-- [if !supportLists]--><span style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style'; mso-bidi-font-weight: bold;">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-weight: bold;"> </span><span style="font-family: 'Bookman Old Style','serif';">The industry is engaged in manufacturing plastic injection moulded items like furniture and crates by using PP, HDPE and LLDPE as raw material in virgin form and was in operation during the visit. </span></p>
