<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma; mso-bidi-font-weight: bold;">It is submitted that the subject cited industry is a small scale forging unit and was granted consent to operate under the Water Act, 1974 vide no. CTOW/Renewal/FGS/2018/7896769 dated 25/07/2018 and under the Air Act, 1981 vide no. CTOA/Renewal/FGS/2018/7896699 dated 25/07/2018, both valid upto 30/09/2022 for the manufacturing of Forged Rolls, Gears, Shafts, cranks, Block etc @ 6 MTD. </span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma; mso-bidi-font-weight: bold;">Now, the industry has applied for varied consent to operate under the Water Act, 1974 and Air Act, 1981 with requisite documents under Orange category after increasing in the production capacity i.e. for manufacturing of Forged Rolls, Gears, Shafts, cranks, Block etc @ 12 MTD. The industry has deposited Rs. 56700/- vide UTR no. 232457379 dated 07/01/2023 under Water Act, 1974 and Rs. 57200/- vide UTR no. 297843351 dated 07/01/2023<span style="mso-spacerun: yes;"> </span><span style="mso-spacerun: yes;"> </span>under Air Act, 1981 against the un-depreciated fixed assets of Rs. 327.1 Lacs as on 30/09/2022 as per CA certificate dated 07/10/2022 which is adequate upto <strong>30/09/2027</strong> as per Board's Office Order dated 29/10/2018 </span><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: Calibri; mso-fareast-theme-font: minor-latin;">after deducting penalty charges 25 %.</span><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma; mso-bidi-font-weight: bold;"> The industry has submitted that cost of fixed assets decreased from Rs. 348 Lacs to Rs. 327 Lacs due to the reason that they have excluded cost of cars/vehicles from gross value of fixed assets. They further submitted that they have modifications in furnace for shifting from coal to PNG and with the modifications the capacity of furnace increased to 12 MT/D.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Calibri;">It is intimated that Hon’ble NGT while considering the issue of Polluting activities in Mandi Gobindgarh in the matter of OA no. 924/2019 titled as Neeraj Goyal Vs State of Punjab vide order dated 01-10-2020 has directed as under: </span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in;"><strong><em><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Calibri;">“In the context of directions to shift rolling mills from coal to PNG we direct the State PCB to ensure that if such shifting does not take place, the non-compliant units be closed till compliance. This should apply not only to rolling mills but also to other similarly placed industries operating on coal. Wherever there is non compliance, the State PCB may take coercive measures, including closure, recovery of compensations and initiating prosecution, following due process of laws.” </span></em></strong></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Calibri;">Accordingly, Punjab Pollution Control Board has issued directions u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 to all the industrial units (not only Rolling Mills) operating on coal as fuel in Mandi Gobindgarh as under: </span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Calibri;">“That all the industrial units in Mandi Gobindgarh operating on coal as fuel in any form shall shift from coal to PNG on or before 31-12-2020.”</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Calibri;">As the industry had not submitted the compliance of above said directions, therefore it was issued show cause notice for cancellation consent to operate under Air Act, 1981 vide Zonal Office-II, Patiala letter no. <strong>680 dated 09/02/2021.<span style="mso-spacerun: yes;"> </span></strong></span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; color: black; mso-themecolor: text1;">Undersigned has visited subject cited </span><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">industry on <strong>13.02.2023</strong> and<span style="color: black; mso-themecolor: text1;"> it was observed as under: </span></span></p>

Out of 2 no. furnaces, 1 is standby. One no. box type furna<span style="color: black; mso-themecolor: text1;">ce is based on PNG and 2<sup>nd</sup> on coal as a fuel. Presently, the industry is using coal based box type heating furnace due to price escalation in PNG.</span></span></p>

<p class="MsoNormal" style="margin-bottom: 12.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; mso-fareast-language: EN-IN;">In the meeting held under the Chairmanship of Shri Vijay Kumar Janju, Chief Secretary, Punjab with the representatives of rolling mills operating in Mandi Gobindgarh Area on 30/12/2022 at 12:00 noon regarding their conversion of fuel from Coal/ Furnace Oil to PNG, it was unanimously decided that the rolling mills operating in Mandi Gobindgarh area may be granted relaxation for some time for converting from their conventional fuels to cleaner fuels and the Competent Authority of the Board may consider/ decide regarding extending the validity of the Consents to Operate till finalization of State Fuel Policy or 31/12/2023, whichever is earlier subject to suitable conditions.</span></p>

However, aforesaid clearance shall not be insisted upon by the Board at the time of grant of CTE/CTO to the industries</strong>.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Arial;">In view of above, it is therefore recommended that the industry may be granted varied </span><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">consent to operate under the Water Act, 1974 & Air Act, 1981 <strong>upto 31/12/2023</strong><strong style="mso-bidi-font-weight: normal;"> </strong>to the industry with suitable conditions and special conditions that:</span></p>
