<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; background: white;">The rice sheller was granted ‘Consents to Operate’ under the Water Act, 1974 vide no. R15LDH3CTOW3279937 dated 28.10.2015 valid upto 30.06.2020 & the Air Act, 1981 vide no. CTOA/Renewal/LDH3/2019/9330181 dated 08.04.2019 valid upto 30.09.2023 for operation of Rice sheller unit with dryer section to manufacture Raw rice with dryer @ 05 TPH, Rice husk @ 1.95 TPH & Rice bran @ 0.233 TPH. </span><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman';">The industry was failed to apply for renewal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 despite of violation notice issued to the industry vide letter no.<span style="mso-bidi-font-weight: bold;"> 4797 dated 20.09.2021 and letter no. 2077 dated 19.05.2021</span>.</span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-indent: 70.9pt; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">Thereafter, show cause notice for violation of provisions of the Water (Prevention & Control of Pollution) Act, 1974 was issued to the industry with an opportunity of personal hearing before the </span><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman';">Environmental Engineer, Regional Office-III, Ludhiana on 06.02.2023.</span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-indent: 70.9pt; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman';">Sh. Mahesh Goel, Proprietor attended the hearing and submitted that the rice sheller was not in operation, he further informed that now rice sheller is in operation and has applied for renewal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman';">After hearing, officer of Board and representative of the industry, Environmental Engineer of the Board decided that the Assistant Environmental Engineer, Regional Office-III, Ludhiana shall visit the rice sheller, collect air emission samples and process the consent application applied by the industry on merits.</span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; background: white;"><span style="mso-tab-count: 2;"> </span>Now, the rice sheller has applied for renewal of ‘Consents to Operate’ under the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981 for operation of rice sheller unit with dryer to manufacture raw rice with dryer @ 05 TPH, Rice husk @ 1.95 TPH & Rice bran @ 0.233 TPH. The rice sheller has submitted C.A. certificate dated 02.02.2023 showing gross fixed assets value of Rs. 81,23,612/-, compliance of consent conditions. The industry has deposited Rs. 28,000/- vide UTR. No. AXSK230340006798 dated 03.02.2023 under Water Act, 1974 & Rs. 28,000/- vide UTR. No. AXSK230340006837 dated 03.02.2023 under Air Act, 1981. The fee deposited by the industry is adequate upto 31.08.2024 under the Water Act, 1974 after deduction of Rs. 16800/- as penalty & fee adequate upto 30.09.2028 under the Air Act, 1981. The industry has also deposited Rs. 2,900/- vide UTR. No. AXSK230340006767 dated 03.02.2023 as NOC regularization fee for increased fixed assets by Rs. 35.33 lac. </span></p>

The shelling was in operation during visit and air emission samples were collected during the visit and the results of the same are awaited. </span></p>

However, the industry has not provided the port hole & platform with its dryer APCD. The industry at site was advised to provide the port hole & platform with its APCD. </span></p>

The metallic sheets have been also provided above wall. The length of the brick wall in front of the discharge pipe of rice husk is more than 70 feet. </span></p>

<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';"><span style="mso-tab-count: 2;"> </span>Keeping in view of the above, it is recommended that:</span></p>
<p class="MsoListParagraph" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo2;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">A)<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">‘Consent to Operate’ under the Water Act, 1974 may be granted to the industry for operation of Rice sheller unit with dryer section to manufacture Raw rice with dryer @ 05 TPH for period upto 31.08.2024 i.e. adequacy of fee subject to suitable conditions and special condition that:</span></p>
