<p class="MsoNormal" style="text-align: justify; text-indent: .5in; line-height: 115%;"><span style="font-size: 14.0pt; line-height: 115%; font-family: 'Bookman Old Style',serif;">It is submitted that the industry is a small scale red category industry and has been granted Consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/LDH4/2021/14467689 dated 21.02.2021 valid upto 20.07.2021 and consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/LDH4/2021/14467743 dated 21.02.2021 valid upto 20.07.2021. The industry has obtained passbook with validity 24.06.2026 and industry has obtained Authorization under HWM Rules, 2016 valid upto 20.07.2021.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: .5in; line-height: 115%;"><span style="font-size: 14.0pt; line-height: 115%; font-family: 'Bookman Old Style',serif;">Earlier, the electric connection of the industry was disconnected vide Board letter no. 5895 dated 21.09.2022 due to industry operating without valid consent of the Board, without obtaining the actual user certificate and due to non-operation of APCD. <span style="mso-spacerun: yes;"> </span></span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: .5in; line-height: 115%;"><span style="font-size: 14.0pt; line-height: 115%; font-family: 'Bookman Old Style',serif;">In compliance to above, the electric connection of the industry has been disconnected by the PSPCL Authorities vide TDCO no. 1803 dated 16.01.2023.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: .5in; line-height: 115%;"><span style="font-size: 14.0pt; line-height: 115%; font-family: 'Bookman Old Style',serif;">Now, the industry has applied for varied consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 & under the Air (Prevention & Control of Pollution) Act, 1981 through OCMMS by changing the name of the Owner and has requested for restoring the electric connection and grant of consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. </span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: .5in; line-height: 115%;"><span style="font-size: 14.0pt; line-height: 115%; font-family: 'Bookman Old Style',serif;">The industry has earlier deposited Rs. 25200/- vide UTR No. <span style="mso-tab-count: 1;"> </span>YESIB22660030397 dated 23.07.2022 under the Water Act, 1974 and Rs. 25200/- vide UTR No. YESIB22660029284 dated 23.09.2022 under the Air Act, 1981, which is adequate upto 30.09.2027 (after deducting late penalty fees) against gross value of fixed assets Rs. 31,92,278/- and plant & machinery Rs. 25,94,494/- as on 31.07.2022.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: .5in;"><span style="font-size: 14.0pt; line-height: 107%; font-family: 'Bookman Old Style',serif;">To verify the facts, the industry was visited by the undersigned on 14.02.2023 and it was observed as under:-</span></p>
<p class="MsoListParagraphCxSpFirst" style="margin-left: .75in; mso-add-space: auto; text-align: justify; text-indent: -.25in; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-size: 14.0pt; line-height: 107%; font-family: 'Bookman Old Style',serif; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 14.0pt; line-height: 107%; font-family: 'Bookman Old Style',serif;">The industry was not in operation during visit and electric connection of the industry has been found disconnected vide TDCO no. 1803 dated 16.01.2023. The industry has obtained passbook valid upto 24.06.2026 (copy attached).</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: .75in; mso-add-space: auto; text-align: justify; text-indent: -.25in; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-size: 14.0pt; line-height: 107%; font-family: 'Bookman Old Style',serif; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 14.0pt; line-height: 107%; font-family: 'Bookman Old Style',serif;">During visit, no raw material i.e. lead scrap battery was found stored in the premises. The physical condition of the site reveals that the industry is not operated for such a long time.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: .75in; mso-add-space: auto; text-align: justify; text-indent: -.25in; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-size: 14.0pt; line-height: 107%; font-family: 'Bookman Old Style',serif; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 14.0pt; line-height: 107%; font-family: 'Bookman Old Style',serif;">The industry has installed 01 no. smelting furnace provided with gravity chamber followed by twin cyclone, bag filter and wet scrubber as APCD for containing the emissions of smelting furnace with adequate stack height and sample collection facilities. </span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: .75in; mso-add-space: auto; text-align: justify; text-indent: -.25in; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-size: 14.0pt; line-height: 107%; font-family: 'Bookman Old Style',serif; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">4.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 14.0pt; line-height: 107%; font-family: 'Bookman Old Style',serif;">The industry has installed 01no. melting furnace to melt the lead ingots and hood has been provided to contain the emissions, which connected with the APCD of the smelting section. </span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: .75in; mso-add-space: auto; text-align: justify; text-indent: -.25in; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-size: 14.0pt; line-height: 107%; font-family: 'Bookman Old Style',serif; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">5.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 14.0pt; line-height: 107%; font-family: 'Bookman Old Style',serif;">No trade effluent is generated by the industry and domestic effluent is discharged into sewer.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: .75in; mso-add-space: auto; text-align: justify; text-indent: -.25in; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-size: 14.0pt; line-height: 107%; font-family: 'Bookman Old Style',serif; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">6.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 14.0pt; line-height: 107%; font-family: 'Bookman Old Style',serif;">The industry has obtained passbook valid upto 24.06.2026.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: .75in; mso-add-space: auto; text-align: justify;"><span style="font-size: 14.0pt; line-height: 107%; font-family: 'Bookman Old Style',serif;"> </span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 0in; mso-add-space: auto; text-align: justify; text-indent: 1.0in;"><span style="font-size: 14.0pt; line-height: 107%; font-family: 'Bookman Old Style',serif;">It is pertinent to mention here that stack emission sampling of APCD could not be done due to non-operation of industry. Further, the adequacy of APCD will be adjudged only when the industry will come in its operation.<span style="mso-spacerun: yes;"> </span></span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 1.0in; mso-add-space: auto; text-align: justify;"><span style="font-size: 14.0pt; line-height: 107%; font-family: 'Bookman Old Style',serif;"><span style="mso-spacerun: yes;"> </span></span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 0in; mso-add-space: auto; text-align: justify; text-indent: 1.0in;"><span style="font-size: 14.0pt; line-height: 107%; font-family: 'Bookman Old Style',serif;">Keeping in view of the above it is recommended that the varied <span style="mso-spacerun: yes;"> </span>consent to operate may be granted to the industry under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for six months with temporary restoration of electric connection for six month with following special conditions :-</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 93.75pt; mso-add-space: auto; text-align: justify; text-indent: -.25in; mso-list: l1 level1 lfo2;"><!-- [if !supportLists]--><span style="font-size: 14.0pt; line-height: 107%; font-family: 'Bookman Old Style',serif; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 14.0pt; line-height: 107%; font-family: 'Bookman Old Style',serif;">The industry shall comply with the Standard Operating Procedures laid down by the MOEF & CC for lead recycling units vide its office memo dated 24/11/2015 in true letter and spirit.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 93.75pt; mso-add-space: auto; text-align: justify; text-indent: -.25in; mso-list: l1 level1 lfo2;"><!-- [if !supportLists]--><span style="font-size: 14.0pt; line-height: 107%; font-family: 'Bookman Old Style',serif; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 14.0pt; line-height: 107%; font-family: 'Bookman Old Style',serif;">The industry will get its stack emission sample analysed from Board Lab within one month. </span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 93.75pt; mso-add-space: auto; text-align: justify; text-indent: -.25in; mso-list: l1 level1 lfo2;"><!-- [if !supportLists]--><span style="font-size: 14.0pt; line-height: 107%; font-family: 'Bookman Old Style',serif; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 14.0pt; line-height: 107%; font-family: 'Bookman Old Style',serif;">The industry will obtain the permission for the use/abstraction of ground water as per the requirements of Central Ground Water Authority (CGWA). In absence of obtaining of permission, the operation of the industry is entirely at its risk and cost and the Board will not be responsible for any loss, in case the CGWA will prohibit the abstraction/use of water on account of non-obtaining of such permission. </span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 93.75pt; mso-add-space: auto; text-align: justify; text-indent: -.25in; mso-list: l1 level1 lfo2;"><!-- [if !supportLists]--><span style="font-size: 14.0pt; line-height: 107%; font-family: 'Bookman Old Style',serif; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">4.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 14.0pt; line-height: 107%; font-family: 'Bookman Old Style',serif;">The industry shall comply with the manufacture, storage and import of Hazardous Chemical Rules, 1989 (as amended) and submit the details on onside emergency plan, safety reports and safety audit reports in accordance with the manufacture, storage and import of hazardous chemical rules, 1989, in case the industry or installation handling hazardous chemicals quantity equal to or more than the threshold quantity specified in the said rules. </span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 93.75pt; mso-add-space: auto; text-align: justify; text-indent: -.25in; mso-list: l1 level1 lfo2;"><!-- [if !supportLists]--><span style="font-size: 14.0pt; line-height: 107%; font-family: 'Bookman Old Style',serif; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">5.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 14.0pt; line-height: 107%; font-family: 'Bookman Old Style',serif;">The industry shall provide adequate arrangement for fire</span><span style="font-size: 14.0pt; line-height: 107%; font-family: 'Bookman Old Style',serif; mso-bidi-language: PA;"> </span><span style="font-size: 14.0pt; line-height: 107%; font-family: 'Bookman Old Style',serif;">fighting and against any accidental leakage/discharge of any air pollutant/gas/ liquids from the vessels, mechanical equipment's etc, which are likely to cause environmental pollution.</span></p>
